Safe Access to Measuring Equipment. Commented [A26]: Deleted as duplicates clause 16.6 about access
Safe Access to Measuring Equipment. The proposed clause 16.1(b) has increased the User’s obligation to ensure that any area surrounding the Measuring Equipment is “safe” in addition to the continuing obligation to ensure that it complies at all times with applicable regulations, standards and Gas-fitting rules. The assessment of “safe” is subjective and clause 16.1(c) provides the Service Provider with an unfettered right to alter, move or install additional Measuring equipment at the User’s Cost. The clause does not provide for any process of notice to the User nor any process for addressing the issue of concern held by the Service Provider. The clause should be amended to provide a process for notification and reasonable time frames for the rectification of concerns.
