Unauthorised Overruns. (a) An Overrun which is not agreed to by the Service Provider in accordance with this Agreement before it occurs is an unauthorised Overrun (Unauthorised Overrun). (b) If an Unauthorised Overrun occurs, the Service Provider has the right, at the User's cost, to install flow control mechanisms on the Measuring Equipment at the relevant Delivery Point, allowing the Service Provider to control the amount of Gas taken by the User at that Delivery Point so as to restrict the Quantity of Gas taken to a Quantity equal to the Capacity Entitlement for that Delivery Point for any Hour or Day and/or ensure operational security or safety.

(b) If an Unauthorised Overrun occurs, Evoenergy may (subject to clause 6.1(c)), at the User's cost, install flow control mechanisms on the Measuring Equipment at the relevant Delivery Point, allowing Evoenergy to control the amount of Gas taken by the User at that Delivery Point so as to restrict the Quantity of Gas taken to a Quantity equal to the Capacity Entitlement for that Delivery Point. (c) Evoenergy will only exercise its rights under clause 6.1(b) where, after consultation with the User, Evoenergy reasonably considers that installation of such mechanisms is necessary for the safe, secure or efficient operation of the Network having regard to the number of occasions on which an Unauthorised Overrun has occurred, the likelihood of another Unauthorised Overrun occurring and the potential impact of such an Unauthorised Overrun on the Network, other Network Users and Customers of the Network.

Unauthorised Overruns. As proposed the Access Arrangement requires a User to pay for demand without an automatic change in the Capacity Entitlement. Clause 6.1(b) then gives the Service Provider the right to install at the User’s expense equipment which would restrict withdrawals to the Capacity Entitlement. EnergyAustralia does not believe JGN should have the right to restrict withdrawals under such wide conditions. As drafted JGN could restrict withdrawals after a single withdrawal in excess of the Capacity Entitlement. Clause 7.4(b)(ii) specifies the conditions upon which network may not approve the STTM balancing mechanism or any other new approved scheme. One of these conditions is the circumstance where the new mechanism is not “reflected in” the “service agreements” for each Network User. What are the "service agreements” referred to in this clause? EnergyAustralia believes if there is a balancing mechanism provided by the AEMO or a relevant industry scheme then JGN should not have what amounts to a power of veto over that scheme. Clauses 7.4b(ii) should be amended to require the Service Provider to approve such a scheme.

Unauthorised Overruns. An End User overruns when the Metered MHQ or MDQ for the End User exceeds the Agreed Demand or MDQ for that End User at the Delivery Point. An overrun can only occur when the Metering at the Delivery Point is in service and operating normally. When an overrun occurs within a single billing period, Allgas will not adjust the nominated MDQ/MHQ. However, if an overrun occurs in a second billing period during the same Contract Year, the nominated MDQ/MHQ for the remainder of the Contract Year will reflect the highest recorded MDQ/MHQ.

(b) If an Unauthorised Overrun occurs, ActewAGLEvoenergy has the right may (subject to clause 6.1(c)), at the User's cost, to install flow control mechanisms on the Measuring Equipment at the relevant Delivery Point, allowing ActewAGLEvoenergy to control the amount of Gas taken by the User at that Delivery Point so as to restrict the Quantity of Gas taken to a Quantity equal to the Capacity Entitlement for that Delivery Point for any Hour or Day and/or ensure operational security or safety.   • Unauthorised use We shall not be liable for any loss, liability or cost whatsoever arising from any unauthorised use of the Electronic Service.   • Unauthorised Use of Intellectual Property a) The Supplier/Service Provider agrees to notify Transnet in writing of any conflicting uses of, and applications of registrations of Patents, Designs and Trade Marks or any act of infringement, unfair competition or passing off involving the Intellectual Property of Transnet of which the Supplier/Service Provider acquires knowledge and Transnet shall have the right, as its own option, to proceed against any party infringing its Intellectual Property. b) It shall be within the sole and absolute discretion of Transnet to determine what steps shall be taken against the infringer and the Supplier/Service Provider shall co-operate fully with Transnet, at Transnet’s cost, in whatever measure including legal action to bring any infringement of illegal use to an end. c) The Supplier/Service Provider shall cooperate to provide Transnet promptly with all relevant ascertainable facts. d) If proceedings are commenced by Transnet alone, Transnet shall be responsible for all expenses but shall be entitled to all damages or other awards arising out of such proceedings. If proceedings are commenced by both Parties, both Parties will be responsible for the expenses and both Parties shall be entitled to damages or other awards arising out of proceedings.

  • Authorised Users individuals who are authorised by the Institution to access the Institution's information services whether on-site or off-site via Secure Authentication and who are affiliated to the Institution as a current student (including but not limited to undergraduates, postgraduates and guest students), member of staff (whether on a permanent or temporary basis including retired members of staff and any teacher who teaches Authorised Users) or contractor or registered user of the Institution. Persons who are not currently a student, member of staff, contractor or registered user of the Institution, but who are permitted to access the Institution's information services from computer terminals or otherwise within the physical premises of the Institution ["Walk-In Users"] are also deemed to be Authorised Users, only for the time they are within the physical premises of the Institution.

  • Unauthorized Use The Participating Institutions, or the Authorized Users shall not knowingly permit anyone other than the Authorized Users to access the Licensed Materials.

  • Unauthorised Use of Confidential Information The Supplier/Service Provider shall not authorise any party to act on or use in any way any Confidential Information belonging to Transnet whether or not such party is aware of such Confidential Information, and shall promptly notify Transnet of the information if it becomes aware of any party so acting, and shall provide Transnet the information with such assistance as Transnet reasonably requires, at Transnet’s cost and expense, to prevent such third party from so acting.

  • Authorised Persons If § 3.4 (Authorised Persons) is specified as applying to a Party in the Election Sheet, Individual Contracts may be negotiated, confirmed and signed on behalf of that Party exclusively by those persons listed by it for such purposes as may be specified in an Annex to this General Agreement. Each Party may unilaterally amend and supplement in writing the list of persons currently authorised to act on its behalf at any time. Such amendments and supplements shall become effective upon their receipt by the other Party.
