Safe Working Conditions. 43 A. The employer agrees to ensure safe and non-hazardous working conditions within the District's 44 facilities. Further, the District agrees to comply with the health and safety regulations as required 45 by all appropriate state and federal regulations. 46 47 In compliance with state law, the District will maintain a safety committee at each building to 48 collect, review and address employee safety concerns. The Association will appoint members 1 who will have a maximum term of one year, however, there is no limit on the number of terms 2 that may be served. The Committee will elect a chair, maintain a meeting schedule with at least 3 quarterly meetings, and post minutes to make them available to staff. Meetings must include 4 discussions of the following: 6 1. Review of safety and health inspection reports to help correct safety hazards; 7 8 2. Evaluate health and safety investigations conducted since the last meeting to determine if 9 unsafe situations were identified and corrected; and 10 11 3. Evaluate accident and illness prevention programs and discuss recommendations for 12 improvement, if needed. 13 14 B. It is unlawful for any person, singly or in concert with others, to interfere by force or violence 15 with any administrator, teacher, classified employee, or student of any common school who is in 16 the peaceful discharge or conduct of his or her duties. It is unlawful for any person, singly or in 17 concert with others, to intimidate by threat of force or violence any administrator, teacher, 18 classified employee, or student of any common school who is in the peaceful discharge or 19 conduct of his or her duties or studies. Any employee who feels verbally or physically threatened 20 by a parent or patron shall report such threat in writing and seek assistance from their supervisor. 21 The employee shall use reasonable professional judgment to avoid such threats including the 22 possibility of requesting police intervention if necessary. 23 24 C. If an employee feels like he/she is being treated inappropriately by a parent or a student in a 25 manner that interferes with his/her ability to do his/her job, then the employee should notify 26 his/her supervisor in writing. The supervisor will investigate the complaint consistent with any 27 applicable board policy and provide a written response. If the issue is not resolved to the 28 satisfaction of the employee, he or she will notify the Association President and the supervisor.

Safe Working Conditions. 43 A. The employer agrees to ensure District shall provide a safe and non-hazardous healthful working conditions environment for all employees, consistent with the law. Whenever possible, and within the District's 44 facilitiesknowledge of the District and the constraints of the law, a classroom teacher will be informed of a student assigned to the teacher’s class, when the building administrator believes the student creates a safety problem for students or staff. B. Committees will be organized in each building to address issues of safety, student behavior, and positive school environment. FurtherBuilding committees include, but are not limited to, the Building Safety Team, etc. Certified staff will have representation on these committees. Staff involvement on these committees is voluntary. Committees meet monthly or more frequently as necessary. C. The District agrees to comply reimburse employees whose personal property is damaged at school or at a school function as a result of theft or vandalism, subject to the following conditions: 1. Items to be covered will be listed on the personal property form along with a photograph of the health and safety regulations as required 45 by all appropriate state and federal regulationsitems to be kept on file in the administrator’s office; 2. 46 47 In compliance with state law, the employee shall report the theft or vandalism to the District will maintain a safety committee at each building to 48 collect, review and address employee safety concernswithin seventy-two (72) hours of knowledge of the incident. The Association report will appoint members 1 include a written statement explaining the circumstances surrounding the theft or vandalism and will include all pertinent documentation such as a police report, if applicable; 3. the employee shall submit the claim to the employee’s insurance company prior to submission to the District. D. The classified employees serving on a safety committee shall either be appointed by the chapter president or elected in a meeting of one yearthe classified employees at the worksite. The meeting shall be chaired by a chapter 98 union worksite representative. C. In the event that District is notified by the OHA or local county health organization of an outbreak or situations where employees are likely to be exposed to serious contagious diseases, howeverillnesses or other health hazards, there the District will make a reasonable effort to provide this information to the employees who are likely to be exposed, unless confidentiality laws prevent it from doing so. Furthermore, the District will follow all policies mandated by the OHA, local health organizations, and CDC. D. In the event District administrators are aware of situations where students, being assigned to employees have had severe behavioral problems in the past that are likely to pose safety problems in the future, the District shall make a reasonable effort to keep those employees informed of these facts unless prevented from doing so by the laws of confidentiality. This might include information related to safety protocols for individual students and behavior intervention plans the employee will participate in implementing, as well as information required by law related to illegal activity. E. School special education staff and administrators are responsible for providing to employees, with an educational need to know, specific information related to behaviors of students with disabilities. F. To reduce the potential for harm to staff members, the District may provide the following when appropriate (list is no limit not all inclusive and is based on individual statement and staff needs): 1. Training of employees on proper lifting techniques; 2. Lifting equipment (back supporter, mechanical lift) when the student’s size warrants; 3. Safety equipment such as bite guards, spit guards, and protective gloves. G. School administrators shall handle behavioral referrals through a process based on the number of terms 2 that may be served. The Committee District’s disciplinary standards. H. Safe Working Conditions. 43 A. 1. The employer agrees District acknowledges its obligation to ensure maintain a safe working environment for unit members and non-hazardous working for prescribing appropriate safety standards. In so doing, the District shall be cognizant of the provisions of the California Occupational Safety and Health Act and regulations relating thereto. 2. Unit members acknowledge their obligation to comply with District safety standards and to practice safety measures. 3. Unit members shall report, in writing, suspected unsafe conditions. The District shall supply a form for reporting unsafe conditions. Reports of suspected unsafe conditions within shall be investigated through the safety committee structure. Unit members shall be advised in writing of what steps, if any, will be taken to correct the reported unsafe condition. 4. Unit members shall be responsible for completing the District's 44 facilitiesaccident reporting form and submitting it to his/her immediate supervisor within 24 hours of an accident. 5. It is unlawful for any person, singly or in 17 concert with others, to intimidate by threat of force or violence directed toward school personnel which occurs at any administratortime or place and is related to any school activity. Reasonable release time shall be provided to unit members who are obligated to prepare any reports required by the District relating to such incidents. 6. No unit member will suffer any retaliation for reporting a condition believed to be a violation of safety practices. 7. The District shall have available at each school site adequate first aid supplies as recommended by the District Disaster Preparedness Committee. This committee shall be composed of nine members. Three of the members shall be selected by the Association and three selected by the employee organization representing classified employees. The other three members shall be appointed by management. 8. The District shall supply and maintain adequate means for two-way communication between a teacher and other staff members at the school for emergency situations. 9. In the event of an emergency school or District closure due to natural disaster, teacherquarantine or government order, 18 classified employee, or student the parties shall meet to negotiate the scheduling of any common school who is in the peaceful discharge or 19 conduct of his or her duties or studies. Any employee who feels verbally or physically threatened 20 make-up days required by a parent or patron shall report such threat in writing and seek assistance from their supervisor. 21 The employee shall use reasonable professional judgment to avoid such threats including the 22 possibility of requesting police intervention if necessary. 23 24 C. If an employee feels like he/she is being treated inappropriately by a parent or a student in a 25 manner that interferes with his/her ability to do his/her job, then the employee should notify 26 his/her supervisor in writing. The supervisor will investigate the complaint consistent with any 27 applicable board policy and provide a written response.
