SAFETY CONDITIONS OF EMPLOYMENT. A. The District and its employees shall be safety conscious in their conduct and actions and shall cooperate in the implementation of the District's safety program.
B. Employees shall report any unsafe or unhealthy conditions directly to their supervisor. The District shall conduct investigations of employee reports and take appropriate measures as soon as possible. The employee shall be informed by the principal or designee of the results of the investigation and of whatever action is to be taken. Safety violations will be corrected within ten (10) working days whenever possible.
C. Teachers shall not be required to work under unsafe conditions or to perform tasks which endanger their health and safety.
D. First aid supplies and first aid treatment shall be available to employees at each school site. A first aid kit shall be provided for each District vehicle used to transport pupils and shall be taken on all field trips.
E. Personal protection equipment required by an employee's job duties shall be available from the principal or designee at each school site.
F. An employee shall immediately report any assaults in connection with his/her employment to the principal or immediate supervisor who shall report the incident to the appropriate law enforcement agency and the District Office.
1. An employee may exercise the same degree of physical control over a pupil that a parent would be legally privileged to exercise, but which in no event shall exceed the amount of physical control reasonably necessary to maintain order, protect property, or protect the health and safety of pupils.
2. An employee shall receive applicable insurance and leave benefits for any injury incurred under the provisions of this Paragraph.
3. Employees shall be reimbursed for damage to personal property resulting from assault under the provisions of this Paragraph.
4. When the continued presence of a pupil in a class represents a physical danger to a teacher, the teacher may request that the principal institute suspension procedures in accordance with District policy.
5. The District's "Student Discipline Policy" shall be made available to employees.
SAFETY CONDITIONS OF EMPLOYMENT. The District shall be responsible for providing and maintaining buildings/facilities for unit 6 members consistent with state health and safety regulations. 7
SAFETY CONDITIONS OF EMPLOYMENT. The District shall conform to and comply with all health and safety conditions of 7 employment requirements imposed by State or Federal law or regulations adopted 8 under State or Federal law.
SAFETY CONDITIONS OF EMPLOYMENT. 5.1 The District and the exclusive representative shall cooperate in the objective of eliminating accidents and health hazards under State and Federal law. The District, exclusive representative, and members of the bargaining unit recognize their obligations and/or rights under existing federal and state laws with respect to safety and health matters. Members of the bargaining unit are encouraged to report alleged violations of such State and Federal law to the safety and health committee and will not be retaliated against by the District for reporting any such concerns. A claim of retaliation under this section shall be subject to the grievance procedure but shall not be subject to the arbitration provision set for in Article 10, Section 10.2.6.
5.2 The District shall maintain a safety and health committee and an emergency preparedness committee. The exclusive representative shall have the right to appoint a total of four representatives from the bargaining unit to the safety and health committee and two representatives to the emergency preparedness committee. The safety and health committee and the emergency preparedness committee shall hold regular meetings and may issue such reports as deemed necessary by the respective committee.
5.3 The safety and health committee shall advise and recommend to the District improvements and/or maintenance of the safety and health conditions for members of the bargaining unit. The safety and health committee shall meet at least six times each year. Minutes of all meetings and reports issued from these committees shall be distributed to committee representatives and the CSEA President. In addition, a notebook of all such minutes and reports shall be maintained in the Office of the Risk Manager and shall be available for inspection to all who request to see them.
5.4 The District shall provide appropriate safety guidelines for those employees who handle toxic materials which are used on campus.
5.5 The District shall provide all necessary and appropriate training in order to meet and fulfill the requirements set forth by all applicable laws and shall provide employees with required safety equipment. CSEA acknowledges that attendance at any such training shall be mandatory for its members. In addition, the District shall provide training in safety and emergency response.
5.6 The District will conduct at least one evacuation drill each fiscal year. Such evacuation drill shall be conducted between the hours of 7 a.m. and 10...
SAFETY CONDITIONS OF EMPLOYMENT. 11.1 The District shall comply with occupational health and safety for unit members which shall be governed by the provisions of the Federal and California Occupational Safety and Health Acts, as amended (California Labor Code, Section 6300 et. seq.) and regulations relating thereto (8 Calif. Admin, Code, Section 330 et. seq.)
SAFETY CONDITIONS OF EMPLOYMENT. 13.1 Upon the recommendation of a student's teacher, the District may exclude from a class any student who, in the teacher's opinion, has filthy or vicious habits; or suffers from a contagious or infectious disease; or suffers from a physical or mental disability which would cause his/her attendance to be inimical to the welfare of other students; or acts in such a way that the teacher believes good cause exists for such student's exclusion. The District shall notify the teacher of its decision within a reasonable period of time, and, upon request, provide the teacher reasons in writing should it not follow the teacher's recommendations.
13.2 Teachers may suspend, for good cause, any pupil from the class for not exceeding one school day, plus the remainder of the school day during which the suspension is ordered, if suspension is ordered during a school day, and shall immediately report the suspension to the principal of the school and send the pupil to the principal for appropriate action. Good cause includes, but is not limited to, the offenses enumerated in Education Code Section 48900.
13.3 The rights and duties of teachers with respect to student discipline, including use of corporal punishment and the exclusion and suspension of students under the Education Code, shall be communicated to teachers during the orientation week at the beginning of the school year. Upon request, the copy of the Education Code provisions relating to student suspension and exclusion shall be made available to teachers at each school site.
13.4 When, in the judgment of the teacher, a student requires attention of the counselor, psychologist, nurse, or District specialist, he/she shall so inform the principal. The principal shall arrange as soon as possible for a conference between the teacher and an appropriate District-employed specialist to discuss the problem and appropriate steps for its resolution.
13.5 Teachers may use reasonable lawful force under the circumstances in order to defend themselves or others against an assault or battery which occurs within the scope of employment.
13.6 Cases of assault suffered by teachers in connection with their employment shall be reported immediately to their principal. Thereafter, both the teacher and the principal shall immediately report the incident to the police. Any information concerning action taken by the police which is in the possession of the Superintendent shall be communicated to the teacher.

SAFETY CONDITIONS OF EMPLOYMENT. 15.1 It is the responsibility of the Principal/Supervisor to ensure safe and appropriate working conditions for County Office personnel serving in districts.
SAFETY CONDITIONS OF EMPLOYMENT. Safety conditions of employment in Article 11, except for Section 11.9, shall apply during the summer session. Each school site shall have a designated administrator. Accommodations will be made to meet operational problems and emergencies and these shall be made known to the staff.
SAFETY CONDITIONS OF EMPLOYMENT. 15.1 The Employer shall confer and provide assistance and/or appropriate legal representation as determined by the Employer for any employee assaulted by a student or a parent while in the lawful discharge of his/her duties. An assault shall be defined, as in the penal code, as an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another.
15.2 Any case of assault should be promptly reported to the employee's immediate supervisor, who shall immediately report the incident to the appropriate law enforcement agency. Such employee then shall submit a complete written report of the incident to the supervisor. The employee shall be entitled to reasonable release time to complete such report.
15.3 A unit member shall report to the immediate supervisor any conditions which he/she believes to endanger his/her health or safety. Such report shall be in writing, or shall be presented verbally followed as soon as practicable by a written report. The supervisor shall take responsive, reasonable, and appropriate action and shall so inform the employee in writing.
15.4 The Employer shall prepare and post rules for employee safety and the prevention of on-the-job accidents. Such rules shall provide regulations and precautions for the safety of employees in the performance of their duties.
SAFETY CONDITIONS OF EMPLOYMENT. 3 17.1 Pursuant to section 49079 of the Education Code, the District shall inform, 4 in writing, bargaining unit members of a pupil who has engaged in, or is 5 reasonably suspected of engaging in a suspendable or expellable act listed 6 in section 48900 of the Education Code. Such notification shall be prior to 7 the student’s return to class in the case of suspension or enrollment in a 8 new site in the case of expulsion. A written description of the rights and 9 duties of all administrators and teachers with respect to student discipline, 10 including the use of corporal punishment and the rights of the suspended 11 students, shall be included in the District’s insert in the bargaining unit 12 member’s faculty handbook.
13 17.2 When, in the judgment of the bargaining unit member, a student requires 14 the attention of the principal, assistant principal, counselor, psychologist, 15 physician, or other specialist, or the safety conditions of the classroom or 16 facilities require such attention, the bargaining unit member shall so in- 17 form the principal or immediate supervisor who shall immediately arrange 18 reasonable steps for resolution as soon as possible.
19 17.2.1 If resolution is not reached at the site regarding safety condi- 20 tions, bargaining unit members may refer such concerns to the 21 District/ESTA Problem Solving Committee, which may include 22 the Superintendent and/or designee, Cabinet, ESTA President, 23 ESTA Grievance Chairperson and ESTA Bargaining Chairper-
