Safekeeping of Equipment. You are responsible for the safekeeping of all leased equipment or CPE placed in or on your premises. Without limiting the preceding, you are responsible for protecting leased equipment by connection to a UL- certified surge protector/suppressor. In the event that leased equipment is destroyed, damaged (ordinary wear and tear excepted), lost or stolen while in your possession, you shall be liable for the cost of repair or replacement of the Equipment.

Neither Agent nor any Lender shall be responsible for: (i) the safekeeping of the Equipment; (ii) any loss or damage to the Equipment; (iii) any diminution in the value of the Equipment; or (iv) any act or default of any repairman, bailee or any other Person with respect to the Equipment. As between the Borrowers, Agent and Lenders, all risk of loss, damage, destruction or diminution in value of the Equipment shall be borne by the Borrowers.

Safekeeping of Equipment. The manager of the department in which the equipment is located and/or used will be responsible for the safeguarding of inventoried equipment. Sales, trades, or other disposition of equipment is not within a department manager’s authority. Rather, if equipment is deemed surplus by the department, the equipment should be transferred to the Physical Plant. The Physical Plant Director will attempt to reallocate the property to another department and/or arrange for sale/disposal. This also applies to the disposal of scrap, salvage, broken, or obsolete items. Sales, trades or other disposition of technology equipment will be coordinated by the Director of Computing Services. In accordance with state statutes, the use of University equipment by individuals or organizations for activities not directly related to the execution of University business or in the furtherance of the mission of the University is strictly prohibited. Pursuant to requests by private parties for use of University owned or controlled assets off-campus, prior approval shall be obtained from the President, or his designee (see ‘Use of Equipment Off-Campus’ below). Non-Technology equipment will be verified on an annual basis by Budget and Accounting. A detailed listing of equipment, by department, will be distributed to each respective department head, and physical verification of equipment will be performed, and a written report of findings will be returned to Budget and Accounting. As between Borrower and Lender, all risk of loss, damage, destruction or diminution in value of the Equipment shall be borne by Borrower.
Safekeeping of Equipment. (a) Unless otherwise agreed to by Us, the Client must keep the Equipment at the premises stated in this Hire Agreement at all times, excluding the collection or return of the Equipment.
(b) The Client must keep the Equipment in a safe place and accepts full responsibility for the safekeeping of the Equipment.
(c) The Client agrees to insure, or self-insure, Our interest in the Equipment and will indemnify Us and keep Us indemnified against any loss of, or damage to, the Equipment including, but not limited to, accident, fire, arson, flooding, theft, and all other risks.
(d) In the event of loss or damage to the Equipment, the Client agrees to immediately pay upon request:
(i) any lost hire charges We would have been entitled to under this Hire Agreement;
(ii) any insurance excess in relation to any claim regarding the Equipment;
(iii) any other amount reasonably incurred by Us in relation to the Equipment; and
(iv) in the event that the Client is unable to claim the loss from insurance, the cost of the repair or replacement of the Equipment.
