Common use of SAFETY NET CLAUSE Clause in Contracts

SAFETY NET CLAUSE. The parties recognize that our mutual exploration of SBDM may result in unforeseen difficulties or problem areas. Since our initial foray into SBDM is largely experimental, we agree that either party may want to slow down or halt, at least temporarily, the movement toward SBDM. The safety net process is established for this purpose. To initiate the safety net process, the Association or District must send the other a letter stating the concerns and reasons for instituting the safety net. The parties shall then have thirty (30) days to resolve the initiating parties’ concerns. If the concerns are not resolved after thirty (30) days, then all plans for extending approval for the addition of sites to SBDM shall be placed on “hold” until the parties reach agreement on how to proceed. The parties agree to use a mutually acceptable facilitator to bring resolution.
