Sanitary Sewer Collection. 1. The Developer shall furnish, construct and install all sanitary sewers in the Development. The location of the sanitary sewer shall be approved by the Director prior to commencement of work. 2. The Developer shall install sanitary sewer laterals to serve each lot in the Plat. All laterals shall be installed to the lot line and shall remain under the ownership and control of the Developer or owner of lot or its successor or assign. 3. All sanitary sewer main and lateral construction shall be completed prior to the start of street construction.
Sanitary Sewer Collection. Sanitary sewer treatment and disposal currently is, and will continue to be, provided to the Mall Facilities and the multi-family dwelling units by Broad Creek Public Service District pursuant to its availability letter attached hereto and marked Exhibit “L”. DEVELOPER will construct or cause to be constructed all necessary sanitary sewer collection infrastructure within the Mall Tract which is required as part of the redevelopment and modification of the Mall Tract, which will be maintained by Broad Creek Public Service District. The Town will not be responsible for any construction or maintenance of sanitary sewer service disposal infrastructure serving, or the treatment of sanitary sewer generated by, the Mall Tract. The Town agrees to use best efforts to assist in obtaining easements across properties not owned by DEVELOPER and relocating easements as necessary in order to facilitate timely connection to the Broad Creek Public Service District service line and facilities.
Sanitary Sewer Collection i. The Developer shall install a sanitary sewer service lateral to serve the Project. ii. All sanitary sewer main and lateral construction shall be completed prior to the application of aggregate base and the first course of asphalt street pavement. iii. No installation of sanitary sewer shall commence until Plans and Specifications have been approved by the Village Engineer and the Wisconsin Department of Natural Resources as it requires.
Sanitary Sewer Collection. (a) The Lands are serviced with a 250 mm sanitary service running through the upland adjacent to the Lake which will service the Marina and future Phase P3. The proposed future Phase P5 is serviced by a 200 mm sanitary service running in the loop road. (b) The Developer acknowledges that at the time of this Agreement, the sanitary services are not complete and operational. A section of sanitary service and the sanitary lift station remains to be constructed and installed by a third party. (c) Should the sanitary service and sanitary lift station not be completed and operational in time to accommodate the servicing of the Marina development under this Agreement, the parties agree that the sanitary sewer collection and treatment services for the Development shall be provided in accordance with the following provisions. (i) Subject to the Developer entering into an interim waste water agreement with the District, the District will accept trucked waste disposal from the Marina operations described in this Agreement until such time that the sanitary sewer collection system is completed and operational. (ii) Notwithstanding section 18.3(c)(i), such trucked waste shall not be permitted to be hauled directly to the District waste water treatment plant but shall be hauled to a District approved dump location within the District’s sanitary system.
