Schematic Design Phase Services. § 3.2.1 The Architect shall review the program and other information furnished by the Owner, and shall review laws, codes, and regulations applicable to the Architect’s services. § 3.2.2 The Architect shall prepare a preliminary evaluation of the Owner’s program, schedule, budget for the Cost of the Work, Project site, the proposed procurement and delivery method, and other Initial Information, each in terms of the other, to ascertain the requirements of the Project. If that estimate does not conform to the initial Owner-provided Stated Limitation on Cost of the Work (SLCW), as set forth in accordance with Exhibit A Section 6.3A.1.3 herein, and any Owner- approved amendments thereto, the Architect shall provide a written statement to the Owner describing the specific reasons for the deviation and suggesting alternative designs or changes that can be made to the design in order to bring the Cost of the Work within the then-current SLCW. § 3.2.7 The Architect shall submit the Schematic Design Documents to the Owner, and request the Owner’s approvalapproval in writing.

Preliminary selections of major building systems and construction materials shall be noted on the drawings or described in accordance with Section 6.3writing. § 3.2.7 The Architect 3.9.6 Consultant shall submit the Schematic Design Documents to the OwnerHistorical Design Review Commission (hereafter referred to as “HDRC”) for initial schematic approval, prior City’s acceptance of the Schematic Design. 3.9.7 Consultant shall submit to City an estimate of the Estimated Cost of Work, prepared in accordance with Article V herein. 3.9.8 Consultant shall submit the Schematic Design Documents to City and request the OwnerCity’s approval. Consultant shall submit two (2) full size and two (2) half size sets of Schematic Design Documents, two (2) sets of any reports and the Estimated Cost of Work. Consultant shall submit an evaluation and comparison of the Estimated Cost of Work to City’s budget and studies, as required. All models and documents also shall be provided in electronic format.

The Architect shall reach an understanding with the Owner regarding the requirements of the Project. § 3.2.4 Based on the Project requirements agreed upon with the Owner, the Architect shall prepare and presentpresent to the Owner and Construction Manager, for the Owner’s approval, a preliminary design illustrating the scale and relationship of the Project components. § 3.2.5 Based on the Owner’s approval of the preliminary design, the Architect shall prepare Schematic Design Documents for the Owner’s approvalapproval and the Construction Manager’s review. The Schematic Design Documents shall consist of drawings and other documents including a site plan, if appropriate, and preliminary building plans, sections and elevations; and may include some combination of study models, perspective sketches, or digital representationsmodeling. Preliminary selections of major building systems and construction materials shall be noted on the drawings or described in writing. § 3.2.5.1 The Architect shall consider sustainable environmentally responsible design alternatives, such as material choices and building orientation, together with other considerations based on program and aesthetics, in developing a design that is consistent with the Owner’s program, schedule and budget for the Cost of the Work. The Owner may obtain more advanced sustainable other environmentally responsible design services as a Supplemental Service under Section 4.1.1Article 4. § 3.2.5.2 The Architect shall consider with the Owner and the Construction Manager the value of alternative materials, building systems and equipment, together with other considerations based on program and aesthetics, aesthetics in developing a design for the Project that is consistent with the Owner’s program, schedule, schedule and budget for the Cost of the Work. § 3.2.6 The Architect shall submit to the Owner an estimate of the Cost of the Work prepared in accordance with Section 6.3. § 3.2.7 The Architect shall submit the Schematic Design Documents to the OwnerOwner and the Construction Manager. The Architect shall meet with the Construction Manager to review the Schematic Design Documents. § 3.2.7 Upon receipt of the Construction Manager’s review comments and cost estimate at the conclusion of the Schematic Design Phase, the Architect shall take action as required under Section 6.4, identify agreed upon adjustments to the Project’s size, quality or budget, and request the Owner’s approvalapproval of the Schematic Design Documents. If revisions to the Schematic Design Documents are required to comply with the Owner’s budget for the Cost of the Work at the conclusion of the Schematic Design Phase, the Architect shall incorporate the required revisions in the Design Development Phase. § 3.2.8 In the further development of the Drawings and Specifications during this and subsequent phases of design, the Architect shall be entitled to rely on the accuracy of the estimates of the Cost of the Work, which are to be provided by the Construction Manager under the Construction Manager’s agreement with the Owner.

The Owner may obtain more advanced sustainable design services as a Supplemental Service under Section 4.1.1. § 3.2.5.2 The Architect shall consider the value of alternative materials, building systems and equipment, together with other considerations based on program and aesthetics, in developing a design for the Project that is consistent with the Owner’s program, schedule, and budget for the Cost of the Work. § 3.2.6 The Architect shall submit to the Owner an estimate of the Cost of the Work prepared in accordance with Section 6.3. § 3.2.7 The Architect shall submit the Schematic Design Documents to the OwnerOwner and the Cost Consultant. Schematic Design Phase Services. § 3.2.1 Upon receipt of a Notice to Proceed with the schematic design phase from MassDevelopment, the Designer and its appropriate Consultants shall meet with agents of MassDevelopment to arrive at a mutual understanding of the requirements of the Study or Program furnished for MassDevelopment. The Architect Designer shall submit a proposed design work plan for the Designer's Services pursuant to this Contract including anticipated tasks and submittals. The Designer shall submit a proposed Contract Schedule consistent with any project schedule included in the Study or Scope of Services referenced in Attachment A. The schedule shall contain dates for submittals, deliverables, actions, milestones, design workshops, meetings and the critical path through all design service activities. It shall include allowances of time for MassDevelopment's review and Approval of submittals and for necessary submissions for Permits in connection with the program Project. When Approved by MassDevelopment, the work plan and other information furnished the Contract Schedule shall govern the Designer's duties hereunder. The work plan shall also include a Work Plan Schedule of Values consistent with the payment schedule for the Basic Fee specified in Section 8.2 which shall be the basis of which payments of the Basic Fee within each phase shall be made. The Work Plan Schedule of Values shall identify deliverables within each phase and percentages of the phase fee payable upon completion of such deliverable. When Approved by MassDevelopment, the Owner, Work Plan Schedule of Values shall govern the timing of payments of the Basic Fee upon completion of deliverables within each phase and shall review laws, codes, and regulations applicable to the Architect’s services. § 3.2.2 as each phase progresses. The Architect Designer shall prepare a preliminary evaluation of MassDevelopment’s Program, Study and construction budget requirements subject to the Owner’s programlimitations described in subsection iv below. If the Designer is the Designer that performed the Study, scheduleMassDevelopment may at its option permit the Designer to develop the preferred Study alternative. Otherwise the Designer shall develop at least three alternative designs to a pre-schematic level. For the purposes of the preceding sentence "pre-schematic" means a general design concept level including program space and building envelope, budget footprint, massing, volume, orientation, and site context. Each pre-schematic alternative shall include a Construction Cost Estimate in CSI Masterformat with revisions accepted in 2014 with 50 Divisions of work, or any more recent amendments, or as may be otherwise mutually accepted within individual delivery orders for specific projects. The Designer shall review with MassDevelopment the alternative designs and shall make a recommendation as to the preferred alternative. Upon selection by MassDevelopment of the preferred alternative, the Designer shall develop the preferred alternative to a full schematic design level. Designer shall provide the following schematic design-level documentation which shall include and incorporate MassDevelopment comments: drawings, concept sketches, three-dimensional representations, and specifications; a building code analysis; an environmental assessment; a preliminary life cycle cost analysis to determine which design decisions related to all energy and water consuming devices and overall building operation and maintenance are the most cost effective [M.G.L. c. 149, § 44M and c. 7C, §29]; a summary of applicable public-utility incentive-programs as determined by MassDevelopment and a plan for implementation or inclusion of such incentives; an analysis of the design's compliance with the Americans with Disabilities Act and Massachusetts Architectural Access Board requirements; a space measurement analysis for the design, which shall verify that the sum of all program floor areas in the Project plus all other floor areas in the Project equal the Gross Floor Area of the Project; and a Construction Cost Estimate for the design in CSI Masterformat with revisions accepted in 2014 with 50 Divisions of work, or any more recent amendments, or as may be otherwise mutually accepted within individual delivery orders for specific projects with aggregated unit rates and quantities supporting each item and verified as accurate and complete by the cost estimator and/or Owner's Project Manager, if any, employed by MassDevelopment. Schematic design level documentation shall also include a summary comparing the schematic plans, specifications and Estimated Construction Cost of the Workdesign to the Program and Study requirements and shall explain any deviation therefrom. Schematic design phase drawings, Project sitespecifications, Construction Cost Estimates and other submittals shall be subject to the written Approval of MassDevelopment. After review and approval by the Owner, these documents will serve as the "Basis of Design" for the mechanical and electrical systems of the Project. .3 Schematic Design documentation shall include drawings and/or narrative description of and performance criteria for all principal construction materials and systems proposed for the Project, including exterior and interior building materials and finishes; structural systems; plumbing and piping systems and fixtures, HVAC systems including major equipment items and control systems; lighting concept and fixture types; electrical power and telecommunications systems; and other significant building or site components as required to complete a detailed construction cost estimate for the full scope of the Project. .4 Tabular comparisons of all room areas shown in Owner’s building program compared to all room areas as shown in schematic design document. § 3.2.5.4 When Schematic Design Documents have been prepared by the Architect, the Architect shall submit to prepare for review by the Owner an estimate of construction costs with supporting data. The Estimate shall be in the Cost Construction Specification Institute’s (CSI’s) format and shall include separate line item costs, projected to the scheduled construction dates, for all major systems and components of the Work prepared in accordance with Section 6.3. § 3.2.7 Work. The Architect shall submit also prepare comparative estimates for cost evaluations of alternative materials and systems. The Owner is not required to approve the Schematic Design Documents unless and until all of the following conditions have been met: 1. The Schematic Design Documents have been completed; 2. The Owner has completed an estimate of construction costs based upon the Schematic Design Documents; 3. The Architect has completed an estimate of construction costs based on the Schematic Design Documents; 4. The construction cost estimates of the Owner and the Architect have been reconciled ("Reconciled Cost Estimates"); 5. The Reconciled Cost Estimates are mutually determined by the Architect and the Owner to be within the construction budget; 6. The Owner has reviewed the Schematic Design Documents; 7. The Architect has modified the Schematic Design Documents to conform with the Owner, budget reconciliation and request the Owner’s approvalreview comments. The modifications shall be as mutually agreed by the Architect and Owner to establish a revised construction scope which is within the budget constraints.
