Scope of Right. Subject to Section 12.1, at Tenant's cost and expense, Tenant shall have the right to: (a) seek any governmental approvals, including building permits, licenses, conditional use permits and any certificates of need that Tenant requires to construct any Tenant Improvement; (b) erect upon the Property such Tenant Improvements as Tenant deems desirable; and (c) engage in any other lawful activities that Tenant determines are necessary or desirable for the development of the Property in accordance with its Primary Intended Use.
Scope of Right. As used herein, the termBusiness Combination” shall mean any acquisition, through a merger, capital stock exchange, asset acquisition, stock purchase or other similar business combination, vessels or one or more operating businesses (each a “Target”) in the shipping or any other industry.
Scope of RightSubject to Section 8.01 herein and Section 7.03 -------------- concerning required alterations, at Tenant's cost and expense, Tenant shall have the right to: (a) seek any governmental approvals, including building permits, licenses, conditional use permits and any certificates of need that Tenant requires to construct any Tenant Improvement; (b) erect upon each Leased Property such Tenant Improvements as Tenant deems desirable; (c) make additions, alterations, changes and improvements in any Tenant Improvement so erected; and (d) engage in any other lawful activities that Tenant determines are necessary or desirable for the development of each Leased Property in accordance with the Tenant's Business; provided, however, Tenant shall not make any Tenant Improvement which would, in Landlord's reasonable judgment, impair the value of the Leased Property or the Tenant's Business without Landlord's prior written consent and provided, further that Tenant shall not be permitted to create a mortgage, lien or any other encumbrance on any Leased Property without Landlord's prior written consent.
Scope of RightTo the extent Sublandlord has consented to any Subtenant Improvement, and subject to Section 10.1 above, Subtenant shall have the right, at Subtenant's cost and expense, to: (a) seek any governmental approvals, including building permits, licenses, conditional use permits and any certificate of need that Subtenant requires to construct any Subtenant Improvement; (b) demolish, remove or otherwise dispose of any of the Subtenant Improvements; (c) erect upon the Subleased Property such Subtenant Improvement as Subtenant deems desirable; (d) make additions, alterations, changes and improvements in any Subtenant Improvement so erected; (e) raze and demolish any Subtenant Improvement together with the right to salvage therefrom; and (f) engage in any other lawful activities that Subtenant determines are necessary or desirable for the development of the Subleased Property in accordance with its Primary Intended Use; it being understood and agreed, however, that Subtenant shall not, in any event, make any Subtenant Improvement which would, in Sublandlord's reasonable judgment, impair the value or Primary Intended Use of the Subleased Property or otherwise violate the terms of the Master Lease.
Scope of RightSubject to Section 10.1, at Tenant's cost and expense, Tenant shall have the right to: (a) seek any governmental approvals, including building permits, licenses, conditional use permits and any certificates of need that Tenant requires to construct any Tenant Improvement; (b) demolish, remove or otherwise dispose of any of the Leased Improvements; (c) erect upon the Leased Property such Tenant Improvements as Tenant deems desirable; (d) make additions, alterations, changes and improvements in any Tenant Improvement so erected; (e) raze and demolish any Tenant Improvement together with the right to salvage therefrom; and (f) engage in any other lawful activities that Tenant determines are necessary or desirable for the development of the Leased Property in accordance with its Primary Intended use; provided, however, Tenant shall not make any Tenant Improvement which would, in Landlord's reasonable judgment, impair in any material respect the value or Primary Intended Use of the Leased Property without Landlord's prior written consent.
Scope of Right. Tenant’s right hereunder to maintain and operate the Generator and Tank is granted solely for the purpose of providing emergency electrical supply to the Premises, limited to the duration of any failure in the electrical power supplied to the Building and for routine testing, and for no other purpose. Tenant shall not permit the Generator and Tank to be utilized, directly or indirectly, by any person or entity other than Tenant and its agents.
Scope of Right. Prometheus will have the right at any time to terminate this Agreement in whole or as to any portion of Patent Rights by giving notice in writing to The Regents. Such Notice of Termination will be subject to Article 15 (Notices) and termination of this Agreement will be effective 90 days after the effective date thereof.

Scope of RightSubject to Section 8.01 herein and Section 7.03 -------------- concerning required alterations, at Tenant's cost and expense, Tenant shall have the right to: (a) seek any governmental approvals, including building permits, licenses, conditional use permits and any certificates of need that Tenant requires to construct any Tenant Improvement or Capital Addition; (b) erect upon each Leased Property such Tenant Improvements or Capital Additions as Tenant deems desirable; (c) make additions, alterations, changes and improvements in any Tenant Improvement or Capital Addition so erected; and (d) engage in any other lawful activities that Tenant determines are necessary or desirable for the development of each Leased Property in accordance with the Tenant's Business; provided, however, that in exercising the rights conferred on Tenant under this Section 8.02, Tenant shall not make any Tenant Improvement which would, in Landlord's reasonable judgment, impair the value of the Leased Property or the Tenant's Business without Landlord's prior written consent and provided, further that, except as otherwise specifically and expressly provided in this Lease, Tenant shall not be permitted to create a mortgage, lien or any other encumbrance on any Leased Property without Landlord's prior written consent.
