Securing special categories of personal data The BDSG requires appropriate and specific measures to safeguard the data subject’s interests when processing special categories of personal data (Section 22(2), BDSG). Security measures may include:  Technical and organizational measures to ensure that processing complies with the GDPR.  Measures to ensure that it is later possible to verify and establish whether and by which party personal data were input, altered, or removed.  Training staff involved in processing operations.  Designation of a DPO.  Restrictions on access to personal data within the data controller and by data processors.  Pseudonymization of personal data.  Encryption of personal data.  Measures to ensure the ability, confidentiality, integrity, availability, and resilience of processing systems and services related to personal data processing, including the ability to rapidly restore availability and access if a physical or technical incident occurs.  A process for regularly testing, assessing, and evaluating the effectiveness of technical and organizational measures for ensuring the security of processing.  Specific rules of procedure to ensure compliance with the BDSG and the GDPR if transfer or processing for secondary purposes occurs. The BDSG Permits processing for secondary purposes, unless the data subject has an overriding interest in not having the personal data processed, when processing is necessary:  To prevent threats to state or public security.  To prosecute criminal offences.  For the establishment, exercise, or defence of legal claims. (Section 24(1), BDSG.)
