Common use of Seniority Cancelled Clause in Contracts

Seniority Cancelled. Seniority standing shall be cancelled if an employee: (a) voluntarily leaves the employment of the Employer; (b) is discharged for just cause and not reinstated under the terms of this Agreement, or (c) is recalled to work and does not report to work as provided in Article 5.08. (d) (i) is not recalled within one (1) year of layoff if less than five (5) years of seniority;

Seniority Cancelled. Seniority standing shall be cancelled if an employee: (a) voluntarily leaves the employment of the EmployerEmployer or retires; (b) is discharged for just cause and not reinstated under the terms of this Agreement, or; (c) is on layoff for more than twenty-four (24) months; (d) is recalled to work and does not report to work as provided work; (e) is appointed to a position not covered by the Collective Agreement for a period in Article 5.08excess of three (3) calendar months; (f) is absent without permission for more than three (3) days. (d) (ig) is not recalled within one (1) year deemed to have resigned under the provisions of layoff if less than five (5) years of seniority;Article 11.06.

(d) fails to report for work upon the expiration of any leave of absence, without satisfactory reason. (ie) is not recalled within one laid off for a period in excess of nine (19) year of layoff if less than five (5) years of seniority;months.
