Common use of Seniority During Absences Clause in Contracts

Seniority During Absences. If an employee is absent from work because of sickness, accident, layoff, or leave of absence approved by the Employer, the employee shall not lose seniority rights. An employee shall only lose their seniority in the event: 1. They are discharged for just cause and are not reinstated. 2. They resign. 3. They are absent from work in excess of one (1) working day without notifying their Employer, unless such notice was not reasonably possible. 4. After a layoff, they fail to return to work within five (5) calendar days, after being notified by registered mail to do so, unless through sickness or other just cause. It shall be the responsibility of the employee to keep the Employer informed of their current address. 5. An employee who is laid off shall not attain seniority recall rights if employed for less than three (3) months. If they are employed in excess of three (3) months, the employee shall not retain seniority rights if they are laid off and not reemployed within twelve (12) months after layoff.
