SET OFF OF PAYMENTS. Where NDML is entitled to receive monies from Entity or entitled to set off payments, NDML/Third Party Service Provider may: Forthwith debit the amount from the aggregate amount’s being held by it for payment to Entity; and/or; Deduct the outstanding amount from subsequent credits due to Entity and/or; If there are insufficient funds available for such recovery, claim from Entity the amount paid to Entity by NDML in respect of the relative payment; which, Entity on receipt of the claim from NDML undertakes forthwith to pay to NDML, the amount of the refund to the extent to which such funds proves inadequate. The refund shall be paid within 30 days of receipt of claim/invoice from NDML.
