SETTLEMENT AGREEMENT AND ORDER. This Settlement Agreement is made by and between the staff (‘‘the staff’’) of the U.S. Consumer Product Safety Commission (‘‘the Commission’’) and Xxxxxx, Inc. (‘‘Xxxxxx’’ or ‘‘Respondent’’), a corporation, in accordance with 16 CFR 1118.20 of the Commission’s Procedures for Investigations, Inspections, and Inquiries under the Consumer Product Safety Act (‘‘CPSA’’). This Settlement Agreement settles the staff’s allegations set forth below.

Based upon the foregoing Findings of Fact, Conclusions of Law and Determinations, and the administrative record for the GASCO Sediments Site, it is hereby Ordered and Agreed that Respondents shall comply with all provisions of this Settlement Agreement, including, but not limited to, all appendices to this Settlement Agreement and all documents incorporated by reference into this Settlement Agreement.

Based upon EPA’s Findings of Fact, Conclusions of Law, and Determinations set forth above, and the administrative record for the Site, it is hereby Ordered and Agreed that Respondents shall comply with all provisions of this Settlement including, but not limited to, all appendices to this Settlement and all documents incorporated by reference into this Settlement. The United States on behalf of the SFAs agrees to comply with those provisions that establish requirements for the SFAs. a. Project Coordinators. (1) Respondents’ Project Coordinator must have sufficient technical expertise to coordinate the Work. Respondents’ Project Coordinator may not be an attorney representing any Respondent in this matter and may not act as the Supervising Contractor. Respondents’ Project Coordinator may assign other representatives, including other contractors, to assist in coordinating the Work. (2) EPA shall designate and notify Respondents of EPA’s Project Coordinator and Alternate Project Coordinator. EPA may designate other representatives, which may include its employees, contractors and/or consultants, to oversee the Work. EPA’s Project Coordinator/Alternate Project Coordinator will have the same authority as a remedial project manager and/or an on-scene coordinator, as described in the NCP. This includes the authority to halt the Work and/or to conduct or direct any necessary response action when he or she determines that conditions at the Willamette Cove Project Area constitute an emergency or may present an immediate threat to public health or welfare or the environment due to a release or threatened release of Waste Material. (3) Respondents’ Project Coordinators shall meet with EPA’s Project Coordinator at least quarterly.
