Shift Assignments. Eligible Employees as specified below shall be assigned to fixed shifts in accordance with the procedures and restrictions set forth below. (a) The shift-bidding procedure provided in this subsection applies to Dispatchers, provided that the Employee is within the upper sixty percent (60%) of overall rank seniority within the classification. “Rank seniority” shall be defined, for purposes of this Article, as the period of continuous service from the most recent date of hire or promotion or other assignment to the classification of Dispatcher. Employees do not accrue rank seniority while on part-time status. If an Employee is promoted to a position in the Xxxxxx County Sheriff’s Office outside the bargaining units represented by the Union but fails to successfully complete probation, the Employee’s prior rank seniority shall be restored upon returning to the prior position held, but he or she will not accrue rank seniority for the period in the promotional position. All other Employees shall have their work hours or shift assignments assigned by the Employer. (b) Eligible Employees shall bid for shift preferences within their Division or Unit in April and October of each year, at a time specified by the Employer, and such assignments shall be awarded on the basis of rank seniority. In the event that two or more Employees within the same division or unit have identical rank seniority, the bid order shall be determined by lot or other method agreed to among the affected Employees. (d) Notwithstanding the shift assignment procedure of subsection (b), the Employer may assign a particular Employee to a different shift in order to comply with Ohio Minimum Jail Standards or other specific operational needs. (e) Within one (1) year of the ratification of this Agreement in 2004, the parties agree to implement through the Labor-Management Committee work schedules eliminating the occurrence of work schedules with seven (7) consecutive work days. (f) With the prior approval of the Employer, and in the Employer’s discretion, Employees may trade scheduled shifts with other Employees assigned to the same classification and facility, provided that the Employees must each be presently qualified to perform the work and assignments in question. These assignments shall continue until April of the next shift bid following year, on a specific date determined by the Employer, subject to the provisions of subsections (b)(3) and (b)(4) below. In April and October of each year, eligible Employees shall rebid re-bid for preferred shift assignments for the following six (6) monthsyear, which new assignments shall commence within one (1) month of the selection date, on a date specified by the Employer, for a period of six (6) monthsone year.
(c) After the bidding process and the assignment of Employees to fixed shifts pursuant to subsection (b), the Employer may nevertheless reassign an Employee to another shift, with ten (10) days prior, written notice, based on operational needs, including but not limited to personnel shortages, vacancies, conflicts with supervision or co-workers, performance problems on the requested shift, or change in personal or family circumstances.
(d) Notwithstanding the shift assignment procedure of subsection (b), the Employer may assign a particular Employee to a different shift in order to comply with Ohio Minimum Jail Standards or other specific operational needs.
(e) Within one (1) year of the ratification of this Agreement in 2004If an Employee assigned to a shift is involuntarily transferred or reassigned to a position or section on another shift, and more than three months remain before annual shift bidding, the parties agree Employee may exercise his or her seniority to implement through bump a less senior Employee on the Labor-Management Committee work schedules eliminating shift on which the occurrence of work schedules with seven (7) consecutive work days.
(f) With the Employee was assigned prior approval of the Employer, and in the Employer’s discretion, Employees may trade scheduled shifts with other Employees assigned to the same classification and facility, provided that the Employees must each be presently qualified to perform the work and assignments in question. (f) With In the prior approval event that the Employer assigns Detectives to other than fixed shifts, Detectives shall bid for shifts in accordance with the procedures of this Article, but shift preference shall be determined by rank seniority, defined as the Employerlength of continuous service in the rank of Detective with the Xxxxxx County Sheriff’s Office.
(g) If an Employee assigned to a shift is involuntarily transferred or reassigned to a position or section on another shift, and more than three months remain before annual shift bidding, the Employee may exercise his or her seniority to bump a less senior Employee on the shift on which the Employee was assigned prior to the transfer or reassignment. Shift Assignments. Eligible There will be three (3) categories of shifts: AM, PM and Night. If, due to an emergency or operational circumstances, it becomes necessary to change a unit member’s scheduled days of work or shift assignment temporarily, and if no regular bargaining unit member volunteers for the shift change, the Hospital will use a shift rotation procedure that would be equitably applied to all qualified staff beginning with the least senior qualified Employee. However, if the assignment would result in overtime or other premium pay, the Hospital may move to the next qualified Employee in the rotation and go back to the skipped person when it does not cause overtime or premium pay. Absent circumstances where there are not qualified Employees, Employees as specified below shall in the top half of the seniority list will be assigned excluded from this rotation. If, due to fixed emergency or operational circumstances, it becomes necessary to change a unit member’s scheduled days of work or shift assignment permanently, and if no regular bargaining unit member volunteers for the shift change, the least senior regular unit member qualified to perform the available work will be assigned. Extra shifts and hours will be offered to full-time and part-time Employees in accordance with the procedures below procedure prior to per diem Employees so long as it does not result in the Hospital incurring overtime or other premium pay. For up to one (1) week after the draft schedule is posted, Employees may sign up for any additional shifts/hours, and restrictions set forth below.

The list will remain posted on the bulletin board for a period of not less than twenty (20) calendar days. All other Employees shall have their work hours or shift assignments assigned by the Employerof his previous selection subject to his seniority.
(b) Eligible Employees shall bid for shift preferences within their Division or Unit in April and October of each year, at a time specified by the Employer, and such assignments shall be awarded on the basis of rank seniority. SECTION C. In the event an employee anticipates that two or more Employees within he will be absent during the same division or unit have identical rank seniorityshift bidding period, he may supply his Supervisor and his Shop Xxxxxxx with a written listing of his shift preference. As such employee’s opportunity for this selection arises, he will be awarded the bid order shall most preferred shift among those he has listed which remain available at the time. The shift assignments will be determined by lot or other method effective no later than the 1st day of the calendar month following the shift selection unless mutual agreement is reached between the Company and the Union to extend the period.
SECTION D. No employee who changes shift in accordance with this Article will suffer any loss of regular straight time pay as a result of such shift change. The Company will also provide such employee with his regular consecutive days off and any overtime due in accordance with Article 7 during transition from one shift to another.
SECTION E. The preceding Sections of this Article will not apply to Crew Leaders and employees of the Maintenance and Tool and Die Departments. The Company will however consider requests for shift changes among these groups and will try and accommodate the employees.
SECTION F. Irrespective of the provisions contained in this Article, it is understood and agreed that newly hired employees may be assigned to among the affected Employees. These assignments shall continue until the next any shift bid on a specific date as determined by the Employer, subject to Company during the provisions of subsections first sixty (b)(3) and (b)(4) below.
