Shop Stewards. (a) There shall be a Shop Xxxxxxx appointed, if the Union so wishes, to see whether the members of the Union and the Employer live up to the provisions of this Agreement, and to report any infractions of such provisions to their supervisor who shall promptly deal with same. Such Shop Xxxxxxx shall be appointed by the Union and shall be an employee of the place in which he is a Xxxxxxx. There shall be no discrimination against the Shop Xxxxxxx for lawful Union activities. (b) The Shop Xxxxxxx shall have no authority to alter, amend, violate or otherwise change any part of this Agreement. Shop Stewards. A. Four (a4) There employees shall be named as Shop Stewards. These stewards shall be recognized by the Employer as the employee representatives. The Union shall use its best efforts to ensure that there is a Shop Xxxxxxx appointed, if the Union so wishes, to see whether the members for each of the Union major work locations at the University and will endeavor to ensure that no more than one Shop Xxxxxxx is named from a single department. Shop Stewards have no authority to take strike action or any other action interrupting the Employer’s business. If a Shop Xxxxxxx is absent or unavailable to transact legitimate Union business relating to his/her location, one of the other three (3) Stewards may substitute.
B. All notices shall report be sent to the Chief Shop Xxxxxxx.
C. The Shop Xxxxxxx involved in a particular dispute shall have the right to reach a final and binding settlement of any dispute with the Employer. So No Shop Xxxxxxx or Shop Stewards shall have a right to waive or modify any of the provisions of this Agreement except in the case of settlement of a dispute.
D. A Shop Xxxxxxx, upon notice to his/her immediate supervisor, shall be permitted such reasonable time as is required to attend to Union Officers any violation matters. The Shop Stewards will endeavor to minimize such time to the full extent possible under the circumstances. Such requests, so long as they do not disrupt the normal operations of the department, will not be unreasonably denied.
E. During the term of this Agreement, there shall be no strikes and no lockouts, except as provided in Article XVII, Section F.
F. If a Xxxxxxx or employee calls an unauthorized strike, the Employer may take such disciplinary action as the Employer deems necessary both as to the Xxxxxxx or employee who calls the strike and as to any employee who participates in the strike; the Union will endeavor to have the employees return to work.
(c) G. The Employer shall recognize agrees that it will not hold the Shop Stewards and Chief Xxxxxxx selected in accordance with Union rules and regulations, as liable for damages arising out of any such strike provided the representatives of Union makes every reasonable effort to direct the employees in the respective groups or departments for which they are chosen and hereby recognizes that the power to appoint and removal thereof is solely vested in the Union. (d) The Union will advise the Employer of the identity of all Stewards and will also give notice within twenty-four (24) hours of any new appointment or removal thereof.

Shop Stewards. (e) Stewards shall report 10.03 The Union acknowledges that Stewards, members of committees and Union Officers have regular duties to perform on behalf of the Employer, and that such persons will not leave their regular duties without obtaining permission of their Department Head, and will give any reasonable explanation which may be requested with respect to their immediate Supervisors and request absence. In the event that the Department Head is absent she will appoint an alternative person to act on their behalf.
10.04 Where a Shop Xxxxxxx, Union Committee member or Union Official employed by the Employer is temporarily absent with permission, which will as aforesaid, she shall receive her regular straight time rate of pay during such period of absence, provided that the Employer shall not be unduly withheldobliged to make any payment of time spent by a Xxxxxxx, to leave the job to conduct Committee member or Union business, which shall consist solely of the investigation of complaints that may lead to grievances, or to handle the adjustment thereof, or to attend to any meeting with representatives of the Employer or such other Union business as may be required by the Union during working hours. The Employer shall allow Stewards to conduct said Union business within their regularly established Official outside her regular working hours.
(f) Any employee being reprimanded shall be advised that he has the right to have a Shop Xxxxxxx present. Employees who have difficulty 10.05 Union Stewards appointed in accordance with the English language may provisions of the Collective Agreement and having at least one (1) year seniority shall not be sent home or laid off because of lack of work except where all employees in their department have an interpreter present at been laid off and so long as they have the meeting with Management, should one be skill and ability to perform any work available at the plantin their respective departments.

6.03 Time cards shall be made available to the stewards weekly, upon request, to determine the hours worked by various employees except with respect to Toronto which cards shall be made available by mutual Agreement. The business representative of the Union shall be admitted to the Employer’s premises at a mutually agreeable time during regular working hours upon proper identification and shall be permitted to inspect the time cards, payrolls and the equipment used by employees in the respective groups or departments for which they are chosen and hereby recognizes order to determine that the power terms of the Agreement are being observed, provided they shall have no right or access to appoint the security area. When the time cards become redundant and removal thereof a new electronic system is solely vested in place, the stewards, upon request, shall receive a computer printout of hours worked by employees.
6.04 Any employee with seniority elected or appointed to Union office or selected for other Union activities by the National Union, the Ontario Federation of Labour, Canadian Labour Congress and/or Local Union, shall be granted a leave of absence to match the time period(s) of elected or appointed office(s). (da) Any employee, who may be called into the office for disciplinary action or to receive a reprimand, shall have a xxxxxxx present. (c) For the purpose of investigation with respect to theft or loss, the following procedures shall apply;
(i) The Employer has the right to investigate.
(ii) The parties have a mutual obligation to uphold Brink’s reasonable rules and policies and the terms of the Collective Agreement.
(iii) The parties have a mutual understanding that both parties lose in cases of theft and dishonesty.
(iv) Both parties recognize that the purpose of an investigation is to find facts and that results could either be exoneration or confirmation of suspicion.
(v) Employees have a right to Union representation where an investigator concludes that there are reasonable grounds to suspect a particular employee(s) and intends to conduct a more focused investigation as to the particular employee(s) to confirm those reasonable grounds.
(vi) The Union will advise the Employer of the identity names of all Stewards the stewards and will also give notice within twenty-four (24) hours of any new appointment or removal thereofalternate stewards.
(evii) Stewards shall report to their immediate Supervisors and request permission, which will not be unduly withheld, to leave the job to conduct Union business, which representation shall consist solely of either a Union xxxxxxx, alternate xxxxxxx, another bargaining unit employee of the investigation of complaints that may lead suspect’s choice, subject to grievancesreasonable availability, or to handle the adjustment thereof, or to attend to any meeting with representatives of the Employer or such other Union business as may be required by the Union during working hours. Verbal warnings shall be advised confirmed in writing.
(c) Except where conflicting with other Articles of this Agreement, the conduct of all employees shall be guided by reasonable rules and regulations promulgated by the employer from time to time. The Union shall be provided with copies of newly promulgated rules and regulations. Simple letters of warning, i.e. letters that he have no disciplinary suspension associated with them, shall have no effect after one(1) year from date they are issued provided there is no further occurrence of similar circumstances.
(d) The employer agrees that any disciplinary record shall be removed from the employee’s file after eighteen (18) months from the date of issue provided there has been no recurrence of similar circumstances giving rise to any disciplinary action/notation during that period.
6.06 All disciplinary letters, suspensions, shall be in writing and copied to the right to have a Shop Xxxxxxx present. Shop Stewards. (a) There
51. 1. The Union shall furnish the Department of Human Resources Employee Relations Division with an accurate written list of shop stewards in designated units by July 1 of each fiscal year. The Union shall be limited to designating one (1) xxxxxxx for every thirty (30) employees in the bargaining unit and three additional stewards for representation at remote locations (Millbrae, Sunol, Hetch Hetchy). During the course of the year, the Union shall amend the list as needed to ensure that the list is accurate and up to date. 52. 2. The Union recognizes that it is the responsibility of the shop xxxxxxx to assist in the resolution of grievances at the lowest possible level.
53. 3. Upon notification of an appropriate management person, stewards or designated officers of the Union, subject to management approval which shall not be unreasonably withheld, shall be granted reasonable release time to investigate and process grievances and appeals. Subject to the operational needs of the releasing Department, the City shall not unreasonably withhold release time for stewards to participate in official functions. Stewards shall advise their supervisors of the area or work location where they will be investigating or processing grievances. The Union will attempt to ensure that shop xxxxxxx release time will be equitably distributed. 54. 4. In emergency situations, where immediate disciplinary action must be taken because of a violation of law or a City departmental rule (intoxication, theft, etc.) shop stewards shall not unreasonably be denied the right to leave their post or duty to assist in the grievance procedure.
55. 5. Shop Xxxxxxx appointedstewards shall not interfere with the work of an employee. It shall not constitute interference with the work of an employee for a shop xxxxxxx, in the course of investigating or processing a grievance, to interview an employee during the employee's duty time. A xxxxxxx shall not represent an employee in a disciplinary matter if the Union so wishes, to see whether xxxxxxx is a witness or otherwise personally involved in the members of matter.
56. 6. Shop Stewards. (a) There shall be a Shop Xxxxxxx appointeda. In the Instructional Assistant Unit, if the Union so wishesmay designate up to six (6) Shop Stewards for the purpose of processing grievances.
b. In the General Classified Unit, the Union may designate up to see whether six (6) Shop Stewards for the purpose of processing grievances.
c. The Union shall annually notify the Employer in writing by August 1 of those members of the Union designated as Shop Stewards and any subsequent changes.
d. For purposes of processing grievances, the Employer live up to the provisions of this Agreement, and to report any infractions of such provisions to their supervisor who shall promptly deal with same. Such Shop Xxxxxxx shall be appointed released upon request for a maximum of eight (8) hours, travel time inclusive, per month. That release shall not be unreasonably denied. Time spent at a hearing or conference with management or supervisor shall not be charged against this maximum.

The Shop Xxxxxxx may be denied permission by the Union and County Superintendent of Schools’ representative to talk to the employee on his/her duty time if that will unduly interfere with the employee’s work. f. Upon entering another work location, the Shop Xxxxxxx for lawful Union activitiesshall identify himself/herself, if possible, to the supervisor in charge of that location and state the purpose and expected duration of the visit.

1. Employees who are currently members of the Union or who have in effect a service fee deduction, or who may authorize in the future either deductions of dues or a service fee or initiation and/or assessment fees, shall have such dues and fees deducted for the remainder of this Agreement, as a condition of employment.
2. New employees, within the first thirty (30) calendar days of employment, shall either sign an authorization for deduction of dues or service fee deduction as a condition of employment.
3. The amounts deducted pursuant to Sections 7.1 and 7.2 shall be remitted promptly to the Union Officers any violation with an alphabetical list of this Agreementthe affected employees.

(c) The Employer shall recognize the Shop Stewards and Chief Xxxxxxx selected in accordance with Union rules and regulationsagrees to recognize, as selected by the representatives Union Stewards, one employee per xxxxxxx, to act as Alternate Stewards to assist in the presentation of any grievances that may arise, in the event that the Xxxxxxx is absent from work.
6.02 The stewards shall be permitted reasonable time to investigate, present and process grievances on the Employer‟s property without loss of time or pay during their regular working hours. Such time spent in handling grievances during the xxxxxxx‟s regular working hours shall be considered working hours in computing overtime if within the regular schedule of the stewards. The shop xxxxxxx‟s activities shall not interfere with the Employer‟s business.
6.03 Individual payroll records shall be made available to the employee or Union Representative, upon written request by the employee or the Union Representative, to determine the hours worked by various employees. A Representative of the Union shall be admitted to the Employer‟s premises at a mutually agreeable time during regular working hours upon proper identification and shall be permitted to inspect, payroll records and the equipment used by employees in the respective groups or departments for which they are chosen and hereby recognizes order to determine that the power terms of the Agreement are being observed, provided they shall have no right or access to appoint and removal thereof is solely vested in the Union. The number of Stewards will be consistent with the needsecurity area.
(da) Any employee, who may be called into the office for disciplinary action or to receive a reprimand, shall have a Union Representative present. The Employer reserves the right to suspend an employee immediately, when in its judgment circumstances warrant such action, but will delay final disposition until a Union Representative is available. Such actions will be taken only in extreme or unusual circumstances.
(b) Nothing herein shall restrict the Employer from calling an employee for investigation or questioning them on any phase of the Employer‟s operations.
(c) For the purpose of investigation with respect to theft or loss, the following procedures shall apply;
(i) The Employer has the right to investigate.
(ii) The parties have a mutual obligation to uphold Brink‟s reasonable rules and policies and the terms of the Collective Agreement.
(iii) The parties have a mutual understanding that both parties lose in cases of theft and dishonesty.
(iv) Both parties recognize that the purpose of an investigation is to find facts and that results could either be exoneration or confirmation of suspicion.
(v) Employees have a right to Union representation where an investigator concludes that there are reasonable grounds to suspect a particular employee(s) and intends to conduct a more focused investigation as to the particular employee(s) to confirm those reasonable grounds.
(vi) The Union will advise the Employer of the identity names of all Stewards the Union Representatives and will also give notice within twenty-four (24) hours of any new appointment or removal thereofalternate Union Representatives.
(evii) Stewards shall report to their immediate Supervisors and request permission, which will not be unduly withheld, to leave the job to conduct Union business, which representation shall consist solely of either a Union Representative, or alternate Union Representative. If there is no elected or appointed Union Representative another bargaining unit employee of the investigation of complaints that may lead suspect‟s choice, subject to grievancesreasonable availability, or to handle the adjustment thereof, or to attend to any meeting with representatives of the Employer or such other bargaining unit employee shall constitute Union business as may be required by the Union during working hours. The Employer shall allow Stewards to conduct said Union business within their regularly established working hoursrepresentation.
(fa) Any employee being reprimanded If a Unit Chairperson is not available (due to holidays, sickness, etc.) an alternate xxxxxxx will be named to take the place of the Unit Chairperson who is not available. The Union will notify the Employer in writing the names of any alternate Union representatives.
(b) Except where conflicting with other Articles of this Agreement, the conduct of all employees shall be advised that he has guided by reasonable rules and regulations promulgated by the right employer from time to have a Shop Xxxxxxx presenttime. (f) Any employee being reprimanded shall be advised that he has reserves the right to have a limit such time if the time requested is unreasonable. 20.04 Shop Stewards shall be allowed to wear their Shop Xxxxxxx’x badge while on duty.
20.05 Employees who have difficulty will be allowed to wear clothing with insignia provided that such insignia is not the English language may have an interpreter present at Union insignia or offensive to the meeting with ManagementEmployer, should one be available at the plantemployees or the Union.
