Should Xx. Xxxxxxxx die during the term of this Service Agreement, his widow and his unmarried legitimate children, if and as long as they have not reached the age of 21 or if and as long as they are in education and have not reached the age of 27, have a right as joint and several creditors to an unreduced granting of monthly installments of the annual compensation according to Section II. 1. of this Agreement for the three months following the month in which the death occurred, however, at the latest until the planned end of the Service Agreement; and in addition a pro rata amount of the annual bonus
Should Xx. Xxxxx, Ms. Black and/or Xx. Xxxxxxxxx choose to remain as part-time employees, at their current hours, their vacated Security Monitor positions at the time of separation of either employee from the District (or transfer of either to a position other than Security Monitor), shall thereafter become full-time positions at the discretion of the Board, if or when determined to be filled by the Board.
Should Xx. Xxxxxx Xxxxxxx vacate his research position at The Ohio State University or abandons his research work while at The Ohio State University, donor is not obligated to fulfill said commitment.
Should Xx. Xxxxxxx die during the duration of his Employment Agreement, his widow and legitimate children as joint and several creditors shall be entitled to continued payment of his salary according to § 2 para. 1 for the month of his death and the three following months, however no longer than until termination of the Employment Agreement. For this period, the benefits to be paid to the widow and the legitimate children on the basis of the pension commitment made towards Xx. Xxxxxxx shall be cancelled. (compare § 6).
Should Xx. Xxxx die while the contract is in force, his widow or--if she is no longer living--his children shall be entitled to the fixed salary, per (S) 3, paragraph 1 a), for the duration of three months after the month of his death as well as to a prorated, profit-based bonus, per (S) 3, paragraph 1b).
Should Xx. Xxxx no longer be married at the time of his death, or should his widow die later, each child shall receive 30% of the payments arranged for in (S) 8 and (S) 9; however, together the children may receive no more than 60% of the pension entitlement described in (S)
Should Xx. Xxxxxxxx be unfit for work as a result of the actions of third parties, Xx. Xxxxxxxx shall transfer to the Company the amount of any claim for damages and / or compensation made on the person(s) liable corresponding to the remuneration and other benefits paid or being paid by the Company.
Should Xx. Xxxxxxxx die during the period of validity of this Contract of Employment his surviving dependents (widow and dependent children) have a claim as a single creditor to the continued payment of the basic salary as detailed in Section 3.1. of this Contract of Employment for the month in which death occurred and the three following months. The surviving dependents are entitled to the proportion of the bonus due up to and including the month in which death occurs. The bonus for the preceding period of the business year will be as detailed in Section 3.5.
Should Xx. Xxxxxxx die after the effective date of this agreement but on or before payment has been made pursuant to this Agreement, any unpaid amount shall be paid in a lump sum to Xx. Xxxxxxx’x estate.
Should Xx. XXXXXX die during the duration of this Agreement, his widow and his children who are entitled to maintenance and have not turned 25 years yet, shall, in their capacity of joint creditors, be entitled to claim the remuneration according section 2 no. 1 lit a), on a pro-rata-temporis basis, for two months, beginning with the end of the month in which Xx. XXXXXX died, but not longer than the point of time at which the Employment would have come to an end by Notice of Termination of Employment, by Termination of Employment by Mutual Agreement, or by lapse of time.
