SPAM AND UNSOLICITED COMMERCIAL EMAIL. (UCE) Nurved takes a zero tolerance approach to the sending of UCE or SPAM over our network. This means that you may not use or permit others to use the Nurved network to transact in UCE. You may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of Service. Violation of Nurved's SPAM policy will result in severe penalties. Upon notification of an alleged violation of our SPAM policy, Nurved will initiate an immediate investigation (within 48 hours of notification). During the investigation, Nurved may restrict customer access to the network to prevent further violations. If a customer is found to be in violation of our SPAM policy, Nurved may, at its sole discretion, restrict, suspend or terminate customer's account. Further, Nurved reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. Nurved will notify the Police or other law enforcement agencies if the violation is believed to be a criminal offence. First violations of this policy will result in an "Administrative Fee" of £250 and your account will be reviewed for possible immediate termination. A second violation will result in an "Administrative Fee" of £500 and immediate termination of your account. Users who violate this policy agree that in addition to these "Administrative" penalties, they will pay "Research Fees" not to exceed £175 per hour that Nurved personnel must spend to investigate the matter. If any Nurved IP addresses are found to be listed in any of the various Spam Databases / blacklists, it is the customer’s responsibility to get the address removed from the database / blacklist. Failure to do so may result in removal of the server from the network and termination of your hosting account without notice. As you are ultimately responsible for the actions of your clients over the Nurved network, it is advisable that you develop a similar, or stricter, policy for your clients.

MacStadium takes a zero-tolerance approach to the sending of mass Unsolicited Commercial Email (“UCE”) or spam over our network. UCE is any message where the primary purpose is commercial advertisement or promotion of a commercial product or service, which is sent to a recipient who has not requested it or opted out of such communication. This means that Customers of MacStadium may not use or permit others to use our network to transact in UCE. In order to prevent unnecessary blacklisting due to spam, we reserve the right to occasionally sample bulk email being sent from servers. To reiterate the strength of our zero-tolerance approach regarding the sending of UCE or spam over our network, the following activities are strictly prohibited:

Using the MacStadium network to send or receive replies from UCE; hosting sites or information that is advertised by UCE from other networks; transmitting bulk email through remote SOCKS, HTTP or other similar proxies who in turn make a SMTP connection to the destination mail servers; forging email headers (i.e., “spoofing”); spamming using third-party proxy, aggregation of proxy lists, or proxy mailing software installation; or hosting any web pages or providing any services that support spam. • Landing Sites. The hosting of any web site or other content in any form intended to be intentionally or unintentionally retrieved or viewed by any recipient of any unsolicited email sent in violation of the spirit or letter of the terms defined in this document, whether sent from our network or any other network.

Client may not use or permit others to use Service Provider’s network to transact in UCE. Spamming, the sending of unsolicited mass email from or through a Jupiterzone server or using an email address that is maintained on a Jupiterzone machine is STRICTLY prohibited. Jupiterzone will be the sole arbiter as to what constitutes a violation of this provision. Clients are also in violation of this provision if they engage in spamming using the service of another ISP or IPP, but channel activities through a Jupiterzone server as a mail drop for responses. Violators will be assessed a minimum fine of €600 and will face immediate suspension.
