Special Data. In the event that Buyer intends to integrate any Buyer Data considered to be sensitive or otherwise subject to specific protections under applicable laws exceeding any requirements that apply to Personal Data generally, such as, for illustrative purposes, information that is regulated by the Health Information Portability and Accountability Act, the Payment Card Industry Data Security Standard, the Xxxxx- Xxxxx-Xxxxxx Act and other U.S. federal, state, or foreign laws applying specific security standards (collectively, “Special Data”), Buyer shall evaluate whether the technical and organizational measures described in the Data Processing Addendum are sufficient to protect Special Data. Buyer shall not integrate any Special Data to the Licensed Materials or related systems if Customer does not determine that such technical and organizational measures are sufficient to protect Special Data in conformance with applicable laws.
Special Data. We do not collect any Special Categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.
Special Data. In no event will Customer provide to Publisher any Special Data unless first anonymized, encrypted, or masked such that no specific individual can be identified. Customer is solely responsible for any cost or expense associated with removal of Special Data from the services or with any security incident involving any Special Data. Notwithstanding anything to the contrary, Publisher will have no liability to subscriber or any other third party for any cost, loss, liability, damage or expense caused by, arising from, or relating to Customer’s failure to comply with this section 2.5.
4. Section 5 (Verifying Compliance) is deleted in its entirety and replaced by the following new section 5: Customer must keep records relating to Offerings it and its Affiliates use or distribution. Publisher may verify Customer's and its Affiliates' compliance with this Agreement and request any information necessary in accordance with the audit rights under Exhibit C (Security Addendum).
5. Section 7.2 (By Publisher) of the Agreement is deleted in its entirety and replaced by the following new section 7.2 (By Publisher):
Special Data. In no event will Subscriber provide to Trintech any Special Data unless first anonymized, encrypted, or masked such that no specific individual can be identified. SUBSCRIBER IS SOLELY RESPONSIBLE FOR ANY COST OR EXPENSE ASSOCIATED WITH REMOVAL OF SPECIAL DATA FROM THE SERVICES OR WITH ANY SECURITY INCIDENT INVOLVING ANY SPECIAL DATA. NOTWITHSTANDING ANYTHING TO THE CONTRARY, TRINTECH WILL HAVE NO LIABILITY TO SUBSCRIBER OR ANY OTHER THIRD PARTY FOR ANY COST, LOSS, LIABILITY, DAMAGE OR EXPENSE CAUSED BY, ARISING FROM, OR RELATING TO SUBSCRIBER’S FAILURE TO COMPLY WITH THIS SECTION 6.4
Special Data the consent of the clause 2 above is applied as given explicit consent to the processing of personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, data concerning health or data concerning a natural person’s sex life or sexual orientation.
