Special Master’s Costs. The Party requesting the Special Master to hear disputes pursuant to Section 5.03 shall be required to pay costs of the Special Master in hearing the dispute, which shall be fixed at $300 per dispute. The Party appealing a decision of the Claims Administrator to the Special Master pursuant to Section 5.04 shall be required to pay the costs of the Special Master in considering the appeal, which costs shall be fixed in the amount of $300 per appeal. With respect to all other motions, petitions, or appeals to the Special Master, in the event that the Special Master shall find that a motion, petition or appeal, or opposition thereto, is without good faith or foundation under the terms of this Agreement, the Party making such submission shall pay the costs of the Special Master for his consideration of such motion. In the absence of such a finding, the Special Master’s costs shall be paid by Organon, pursuant to Section 6.04.

Special Master’s Costs. In the event that the Special Master shall find that a motion or appeal, or opposition thereto, is without good faith or foundation under the terms of this Agreement, the Party making such submission shall pay the costs of the Special Master for his consideration of such motion. In the absence of such a finding, BHCP shall pay the Special Master’s costs.
