Special-Status Plants. A qualified botanist shall conduct surveys for special status plant species in the work area and a 25-foot radius during the growing season within one year prior to the start of Project activities using the CDFW 2018 Protocols for Surveying and Evaluating Impacts to Special Status Native Plant Populations and Natural Communities (xxxxx://xxx.xxx.xx.xxx/FileHandler.ashx?DocumentID=18959&inline). Permittee shall submit survey results to CDFW at least seven days prior to the start of Project activity. If special status plant species are identified, the population shall be delineated with flagging and protected with a 25-foot no disturbance buffer. If this avoidance is not feasible, Permittee shall consult with CDFW to determine whether a buffer reduction or alternative minimization for non-listed species is possible. Permittee shall not encroach on the 25-foot buffer unless CDFW provides advance, written approval to do so. If take of any State listed plant species, including live plant parts and seeds, cannot be avoided, Permittee is advised that a State Incidental Take Permit for the species would be warranted to proceed with any Project activity that would result in take.

Botanical survey reporting shall be provided to CDFW within seven days prior to the start of Project activities. If special status plant species are identified, Permittee shall identify them with flagging and avoid with a 25-foot no-disturbance buffer. If avoidance is not feasible, Permittee shall consult with CDFW to determine whether alternate minimization measures for non-listed species are possible. Permittee may request a reduced buffer for non-listed plant species, but shall not encroach on the 25-foot buffer unless CDFW provides advance, written approval.

This contract shall not be valid and the Board will not compensate the Superintendent for any service performed prior to the date that he registers his certificate.

  • Legal Status of School Pursuant to Sec. 302D-25, HRS, the School is a public school and entity of the State and may not bring suit against any other entity or agency of the State. The School shall be nonsectarian in its operations.

The books and records of the Company have been, and are being, maintained in all material respects in accordance with GAAP and any other applicable legal and accounting requirements. The Company does not have any material liability of any nature whatsoever (whether absolute, accrued, contingent or otherwise and whether due or to become due), except for those liabilities that are reflected or reserved against on the consolidated balance sheet of the Company contained in the Company’s Reports for the Company’s most recently completed quarterly or annual fiscal period, as applicable, and for liabilities incurred in the ordinary course of business consistent with past practice or in connection with this Agreement and the transactions contemplated hereby.
