Staff Reduction Procedure. It is within the discretion of the Board of Education to reduce the educational program, curriculum and staff. In order to promote an orderly reduction of personnel when the education program, curriculum, or staff is curtailed, the following procedures shall be followed. 10.1.1 The Board will communicate to the recognized negotiating body president its intention to implement the staff reduction procedure. If two or more certified staff members on lay-off status are both certified and qualified for a vacated position within the recall period, the certified staff member to be recalled pursuant to this provision shall be determined by the Board after consideration of the factors to be considered within the staff reduction policy. The certified staff member(s) on lay-off status shall have the responsibility to keep the District’s Business Manager informed as to the certified staff member’s mailing address. After 15 months, recall rights shall terminate and also if written recall offer is given to the certified staff member and he/she does not accept the recall offer in writing within seven (7) calendar days of receipt of the recall offer. 4. An employee electing a right under Article VI B.3. shall be placed on the recall list for the job vacated.
5. An employee who does not exercise the right to bump shall be laid off and is eligible only for recall to the classification from which the employee was laid off.

Upon return to work after recall, any laid off employee will have his/her seniority date adjusted to give him/her credit for past seniority and all unused sick days previously earned shall be restored. An employee on layoff who is recalled for service shall get credit for a full month for which the employee worked more than ten (10) days.
E. An employee may retain District insurance coverage during the period of layoff by paying the premium in full to the District insurer, if permissible under the master insurance policy.
F. A person may be employed by the District as a temporary employee for the following reasons: --to replace an employee granted a leave of absence; --to fill a position created by special circumstances. A temporary employee shall not be entitled to recall as described in this Article. A temporary employee shall be advised of the employee's status at the time of hire and advised of the expected duration of employment as a temporary employee.
G. Employees on District-approved leaves of absence shall be subject to the layoff provision of this Article.
H. An employee on the recall offer. Recall rights list may refuse a part-time position without jeopardizing his/her position on the recall list.
I. No district employee outside the bargaining unit shall not apply be allowed to a certified staff member who is under contract with another South Dakota public school district for the same school year (or portion thereof, if the vacancy occurs during the school year) to which recall rights would otherwise exist"bump" any bargaining unit employee.

3. Staff selection to fill all program requirements will be made as follows:

b) Second, remaining positions shall be filled with current part-time teachers on the seniority list in descending order using the next most senior teacher with certification and/or satisfactory experience in the subject area;
c) and, third, remaining positions shall be filled by posting and new hires, or by placing non-bargaining-unit certificated personnel into those assignments, with the proviso that under no circumstances shall such non-bargaining-unit certificated personnel receive such assignments before all eligible bargaining unit members have been recalled.
4. Teachers to be laid-off will be notified in writing by May 15th of the school year.
5. Notification of staff member reduction will be in accordance with applicable statute, regulations, and this Agreement.
6. While in the rehiring pool, individuals may continue group insurance program benefits, subject to insurance carrier regulations, by payment in advance of the premiums in a manner arranged through the district office.
7. Affected teachers shall, unless they request otherwise, be placed on District substitute teacher lists and shall be called on a priority rotation basis for short and long-term duty. Acceptance of a long-term sub position does not affect pool or rehire status.
B. Each laid-off teacher shall be considered to have priority rehirement rights for three (3) years following expiration of the contract in effect at the time of the staff reduction. A laid-off teacher shall have seniority until he/she does not submits a written resignation or fails to accept a position pursuant to the recall offer in writing within seven (7) calendar days Certificated Staff Recall Procedure herein.
C.
