Stage 2 – Superintendent Clause Samples
The 'Stage 2 – Superintendent' clause defines the role and responsibilities of the superintendent during the second stage of a project. Typically, this clause outlines the superintendent’s authority to oversee construction activities, issue instructions, and ensure that the contractor’s work complies with the contract requirements. For example, the superintendent may be responsible for inspecting work, certifying progress claims, or resolving site issues. The core function of this clause is to establish clear oversight and communication protocols, ensuring that the project proceeds smoothly and in accordance with contractual obligations.
Stage 2 – Superintendent a. If the grievance is not resolved at Stage 1, the Association may appeal to the Superintendent within ten (10) days after receipt of the decision from the Supervisor.
b. Within fifteen (15) days after receipt of the appeal, the Superintendent, or his/her representative, shall meet with the Association to review the relevant facts and circumstances of the grievance. The Association shall have the right to bring the aggrieved employee(s) to this meeting.
c. The Superintendent of his/her designee shall render a written decision to the Association within fifteen (15) days after the conclusion of the meeting.
Stage 2 – Superintendent. If the aggrieved party is not satisfied with the written decision at the conclusion of Stage 1 and wishes to proceed further under this grievance procedure, he shall file a written appeal of the decision at Stage 1 with the Superintendent within five (5) school days after the aggrieved party has received such written decision. Copies of the written decision at Stage 1 shall be submitted with the appeal. Within five (5) school days after receipt of the appeal, the Superintendent, or his authorized representative shall meet with the aggrieved party and his representative and all other parties in interest, if any of the foregoing request it. The Superintendent shall render a decision in writing to the aggrieved party, the Association (or other representative) within five (5) school days after conclusion of the meeting.
