Temporary Promotions. 1. Any vacancy in positions represented by the Association bargaining unit which cannot be filled due to the lack of an active eligible list shall be filled on a temporary basis after the vacancy exists for two pay periods from the name highest on the expired eligible list. An appointment so made shall be approved by the Fire and Police Commission and shall be effective until a regular appointment can be made from a new eligible list. Temporary appointees shall have the same authority of command as though they were regular appointees. When a temporary promotion is made, the employee receiving such promotion shall execute a waiver indicating his/her understanding that no promotional seniority credit shall accrue through such appointment and when the vacancy can be filled through promotion from a new eligible list, the appointee reverts back to the former latest position held; provided however, that when an employee temporarily promoted to a higher position subsequently receives a regular appointment to that position without reverting back to his/her former position prior to the effective date of such regular appointment, the employee shall accrue promotional seniority credit from the effective date of such temporary promotion. 2. An employee filling such vacancy on a temporary basis shall be paid at the pay rate in the vacant position's pay range the employee would have been paid had he/she been promoted to that position under Fire and Police Commission Rule XI, Section 7(b) effective on the date he/she began filling the position on a temporary basis. The employee shall be paid at this pay rate for the time he/she fills the position on a temporary basis; in the event that time exceeds one year, the employee shall be entitled to any additional annual pay increments he/she would have received had he/she been promoted to the position on a regular basis. 3. Administration and control of the provisions of this Article shall be by the City.

An appointment so made shall be approved by the Fire and Police Commission and shall be effective until a regular appointment can be made from a new eligible list. When a temporary promotion is madecalendar week, the employee receiving such promotion shall execute will be entitled to payment of wages at a waiver indicating his/her understanding that no promotional seniority credit shall accrue through such appointment and when higher salary range for all time worked in the vacancy can be filled through promotion from a new eligible listhigher paid position, as follows:
(i) If, at the appointee reverts back to the former latest position held; provided howevertime of promotion, that when an employee temporarily promoted to is on Step 3 or a higher position subsequently receives a regular appointment to that position without reverting back to his/her former position prior to lower step in the effective date of such regular appointmentsalary range, the employee shall accrue promotional seniority credit from will move to the effective date of such temporary promotionsame step in the new salary range.
2. An employee filling such vacancy on a temporary basis shall be paid (ii) If, at the pay rate time of promotion, an employee is at a step above Step 3 in the vacant position's pay range the employee would have been paid had he/she been promoted to that position under Fire and Police Commission Rule XI, Section 7(b) effective on the date he/she began filling the position on a temporary basis. The employee shall be paid at this pay rate for the time he/she fills the position on a temporary basis; in the event that time exceeds one yearrange, the employee shall be entitled to any additional annual pay increments he/she would have received had he/she been will move back one step in the new salary range for each salary group promoted to excepting that such retrogression will not place the position on a regular basisemployee below Step 3 in the new salary range.
3. Administration and control (iii) If the move as noted in (ii) above will not result in an increase, the employee will be placed at the next step in the new salary range which will produce this result, but not more than the top of the provisions new salary range which for purposes of this Clause will be read as including the special increment.
(b) Employees who receive a higher rate of pay for the entire pay period preceding a paid leave, annual vacation or public holiday and/or who re-assume the higher rated job they assumed prior to taking such leave will receive the higher rate of pay during such absences.
(c) A promotional opportunity will first be offered on an equitable basis to appropriately back-up trained permanent employees in the department and work location within which the opportunity exists.
(d) If no permanent employee is available under (c) above, then the promotional opportunity will be offered on an equitable basis to back-up trained permanent employees in the division and work location within which the opportunity exists.
(e) If the promotional opportunity is one hundred twenty (120) working days or less in duration and there are no permanent employees available under either (c) or (d) above, then a temporary employee may be assigned under Article shall 20 to perform the work.
(f) If the promotional opportunity is more than one hundred twenty (120) working days in duration and no permanent employee in (c) or (d) above is available, then the temporary opportunity must be by the Cityposted in accordance with Clause 15.08.
(g) Back-up trained employees should not refuse a promotional opportunity for reasons which are within their control.

Temporary Promotions. Employees in Group who wish to be considered for a posted back-up position, must place their name in the job book. When a position is to be filled, applicants will be selected by plant seniority and assigned to the shift where the vacant backup position exists and will hold the job until they resign from it. Appropriate training will be provided. The applicant must accept or decline immediately upon being contacted for a job, or it will be assumed as a decline. An employee may hold only one relief position. The need for posted backups in classifications where none currently exist will be determined by the Company. An employee does not have to give up an existing backup posting until training commences. Pursuant to Article (a), should any employee within a twelve month period: Resign from two (2) jobs for which he the successful applicant; or Decline three (3) jobs for which he has applied, he then will be ineligible for another posted relief position for a period of one (1) year. Any employee who commences training or Xxxx Inspector training and then resigns from that posting within a twelve (12) month period will be ineligible for another posted relief position for a period of six (6) months. The Company shall post on the bulletin board the name of the successful applicant and the position for which he had applied within five (5) days of his selection. A short term Vacancy is defined as follows: Less than days for day workers; or Less than days for and hour shift workers; or Vacation coverage. The senior designated backup on the shift where the vacancy in positions represented exists will fill a short-term vacancy. Where no backup exists it will be filled by the Association bargaining unit senior person able to do the job within the shift and Department. If the Vacancy exceeds the above time frame it will be considered a long-term vacancy and will be filled by the senior backup available. Where no backups exist, it is to be filled by the senior person able to do the job in the department, if necessary, familiarization will be provided. The Company will post the name of the employee placed in a long term vacancy. Copy of posting will be provided to the Union. Experience gained on a temporary transfer will not count in the selection process the job become permanent. An employee will hold a vacancy for its duration. On completion of the temporary job or in the case of unsatisfactory performance the employee will return to his former position. A vacancy, which concludes then recommences will be considered a new vacancy and be filled accordingly. Successive, uninterrupted vacation periods upcoming in the same classification, shift and department will be treated as one vacancy. Vacancies which cannot be filled as above due to the lack of an active eligible list shall employees or impracticalitywill be filled on a temporary basis after the vacancy exists for two pay periods by displaced employees from the name highest on the expired eligible list. An appointment so made shall be approved by the Fire department who have training and Police Commission and shall be effective until a regular appointment can be made from a new eligible list. Temporary appointees shall have the same authority of command as though they were regular appointees. When a temporary promotion is made, the employee receiving such promotion shall execute a waiver indicating his/her understanding that no promotional seniority credit shall accrue through such appointment and when the vacancy can be filled through promotion from a new eligible list, the appointee reverts back to the former latest position held; provided however, that when an employee temporarily promoted to a higher position subsequently receives a regular appointment to that position without reverting back to his/her former position prior to the effective date of such regular appointment, the employee shall accrue promotional seniority credit from the effective date of such temporary promotion.
2. An employee filling such vacancy on a temporary basis shall be paid at the pay rate experience in the vacant position's pay range the employee would have been paid had he/she been promoted to that position under Fire and Police Commission Rule XI, Section 7(b) effective on the date he/she began filling the position on a temporary basis. The employee shall be paid at this pay rate for the time he/she fills the position on a temporary basis; in the event that time exceeds one year, the employee shall be entitled to any additional annual pay increments he/she would have received had he/she been promoted to the position on a regular basisjob.
3. Administration and control of the provisions of this Article shall be by the City.
