Temporary Schedule Changes. Overtime-eligible employees’ workweeks and/or work schedules may be temporarily changed with prior notice from the Employer. A temporary schedule change is defined as a change lasting thirty (30) calendar days or less. With the exception of the job classifications listed in Appendix B, overtime-eligible employees will receive three (3) calendar days’ written notice of any temporary schedule change. The day that notification is given is considered the first day of notice. Adjustments in the hours of work of daily work shifts during a workweek do not constitute a temporary schedule change.

If the employee uses leave to reach forty (40) hours in the workweek, the Agency may still require the employee to work the last workday.

Temporary changes to such employee’s work schedule may be made with less than seven (7) days’ notice (two (2) days for 7(k) schedules); provided that in the event a scheduled employee is assigned a temporary schedule change with less notice for reasons other than the employee’s request, the employee will be given the option to work his or her normal schedule in addition to the modified schedule. A temporary schedule change is defined as a change lasting twenty-one (21) calendar days or less. Upon written request the supervisor may allow the employee to waive the seven (7) days’ notice period. The supervisor will notify the employee of their decision in writing.

Failure to provide the proper notice under this provision will result in payment at one and one-half (1 1/2) times their base rate for the duration of the notice period not to exceed eight (8) hours. This payment will not be paid for any portion of the temporary schedule change that overlaps the employee’s regular work schedule and/or shift. Daily work shift adjustments, as defined in Subsection 6.4 B or extensions in the hours of work of an employee’s daily work schedule and/or shift or a return to the employee’s regular work schedule and/or shift do not constitute a temporary schedule change.

a. by providing two (2) calendar days’ notice to the employee (the day of notice counts as one day); or
b. because of emergency conditions (excludes instances that could reasonably have been foreseen and planned for in advance); or
c. for operational convenience (instance where conditions above do not exist); or
d. when the change is requested in writing by the employee and approved by the employing official. In no event will the provisions of this Article be utilized to limit the employee’s hours to work less than the normally assigned hours in a work week. The Employer will not change an employee’s schedule to avoid the payment of overtime.
