Common use of Temporary Service Reduction Clause in Contracts

Temporary Service Reduction. (a) When the Company intends to reduce services in whole or in part at a Branch for one (1) day, employees in their respective Branches will be informed as far in advance as practicable of the staffing implications so they may schedule vacation, lieu time, take an unpaid leave of absence or request a temporary transfer to the other Branch. (b) Such Temporary Service Reductions (of up to three (3) days in any calendar year) as defined herein, will not be considered a “lay-off” for the purpose of exercising bumping rights, however, the Company will make every reasonable effort to ensure that those who wish to continue working will be afforded such an opportunity by aligning employees who wish to work with other employees in the same classification who would be willing to take time off so that both could be accommodated by a temporary transfer. In the event that there are no employees willing to take time off, those affected by the Temporary Service reduction will be allowed to take lieu time and/or vacation time (so long as such entitlements are standing to their credit) for the period of the reduction. If an employee is required to accept an unpaid leave of absence during a temporary service reduction, a Record of Employment indicating “a shortage of work” will be provided in accordance with the Employment Standards Act if requested.
