Tenant Utilities. Recoveries from the utility expense reimbursements payable by the tenants pursuant to the Leases regardless of whether or not collected by Seller (or a third party service provider) shall be prorated based upon, and shall relate back to, the months in which the billed expenses were incurred.
Tenant Utilities. Tenant shall, at its expense, install, configure, maintain, and/or procure the utilities and services to be solely used by Tenant and required for Tenant to accomplish the Purpose as reasonably determined by Tenant (collectively, “Tenant Utilities”). As of the date of this Agreement, the Tenant Utilities shall be the utilities and services set forth in Appendix B as the Tenant Utilities. Tesla will use Commercially Reasonable Efforts not to interfere with Tenant’s use of Tenant Utilities. Tesla shall not be responsible for providing any Tenant Utilities to Tenant. Tesla shall not be liable to Tenant for any interruption or failure of service of any Tenant Utilities to the Premises from any cause whatsoever, except to the extent of Tesla’s gross negligence or willful misconduct, nor shall such interruption or failure constitute a constructive eviction or [***] or affect the obligations of Tenant under this Lease or the General Terms in any other way whatsoever. If Tesla and/or any of its other tenants at the Factory desire to use any portion of the Tenant Utilities, the Parties shall discuss in good faith the terms and conditions of the use, including but not limited to Tenant’s charges for such use.
Tenant Utilities. The Landlord will bill the Tenant its pro-rata share of electric and gas expenses on a monthly basis based on then-current and historical data in monthly statements provided by the respective utility company. At Tenant’s election, Tenant may have separate metering equipment installed at Tenant’s expense whereupon Tenant would pay separately metered electric and/or gas.
Tenant Utilities. The Tenant shall pay for all utilities consumed by Tenant on or in connection with the use and occupancy of the Premises, including, without limitation, water, gas, sewer and electricity, the amounts of such utilities attributable to Tenant’s use to be determined in accordance with separate meters for the Premises.

Tenant Utilities. Except as provided below in subparagraphs C, D, and E, Tenant shall be responsible to arrange for and pay for all utilities furnished to the Premises and, at its cost, install separate meters for the utilities, including but not limited to electricity, propane, gas, water, sewer treatment, waste management services, telephone service, fiber optic service and any other similar service required by Tenant.
Tenant Utilities. All LESSEE'S utilities will be separately metered or billed on a pro-rata basis.
Tenant Utilities. Tenant shall be responsible to directly pay the utility companies for power, gas, telephone, cable service, alarm service if any, internet service and any janitorial expenses for its occupied space. All other utilities such as water, sewer and trash shall be paid by Landlord and shall be included in Tenant’s monthly C.A.M.
Tenant Utilities. Tenant shall make application for, obtain directly, pay for and be solely responsible for all utilities consumed at the Premises, including, but not limited to, all water, gas, telephone service, garbage and trash collection, and electricity used or consumed by Tenant, and hold harmless Landlord against any charge, lien, claim or demand arising out of Tenant's use or consumption of such utilities.
Tenant Utilities. 11C. It shall be the responsibility of Tenant to pay for all utilities with respect to the Premises when due to Landlord or to utility companies, as applicable. Tenant shall take all necessary actions to assure that no liens arise against the Premises or other portion of the Project as a result of Tenant's failure to pay for electricity, telephone or other charges. To the extent any utility(ies) servicing the Premises are not separately metered for the Premises, then the expense of such utility service shall be included as part of the Operating Expenses. In no event shall Landlord be responsible for the quality, quantity, failure or interruption of any of such utility services to the Premises and/or any other portion of the Project. TENANT IMPROVEMENTS
