The Contractor's Design. The Contractor shall carry out, and be responsible for the design and execution of part of the temporary traffic arrangements for the Project, as further detailed in the Volume 3 (Prerequisites and Introduction to engineering) ("the Contractor's Design"). The Contractor undertakes that the Contractor's Design, will be in accordance with the Law and the Contract.

The Contractor's Design. The Contractor will complete the Design documentation and submit it to the Employer for review, once accepted, the Contractor will Approve the Design (ECSA Registered) and the Employer will then authorize the Design. Only when the Design have been authorised by the Employer, may the Contractor start with implementation of the works. Where additional information is required, the Contractor collects all data for the design to enable the completion of the Works. The Contractor clarifies and co-ordinates all interfaces and displays.

  • Contractor’s Documents Any licensing and maintenance agreement, or any order-specific agreement or document, including any pre-installation, linked or “click through” agreement that is allowed by, referenced within or incorporated within the Contract whenever the Contract is used for a State procurement, whether directly by the Contractor or through a Contractor’s agent, subcontractor or reseller, is agreed to only to the extent the terms within any such agreement or document do not conflict with the Contract or applicable Minnesota or Federal law, and only to the extent that the terms do not modify, diminish or derogate the terms of the Contract or create an additional financial obligation to the State.   • Contractor’s Duties The Contractor shall perform all duties described in this Contract to the satisfaction of the State. Representations and Warranties Under Minn. Stat. §§ 15.061 and 16C.03, subd. 3, and other applicable law the State is empowered to engage such assistance as deemed necessary. Contractor warrants that it is duly qualified and shall perform its obligations under this Contract in accordance with the commercially reasonable standards of care, skill, and diligence in Contractor’s industry, trade, or profession, and in accordance with the specifications set forth in this Contract, to the satisfaction of the State.   • Contractor’s Submittals The Contract shall submit with reasonable promptness consistent with the Work Project Schedule and in orderly sequence all Shop Drawings, Samples, or other information required by the Contract Documents, or subsequently required by Change Order. Prior to submitting, the Contractor shall review each submittal for compliance with the Contract Documents and certify its approval by an approval stamp affixed to each copy. Submittal data presented without the Contractor’s certification will be returned without review or comment, and any delay resulting from such certification is the Contractor's responsibility.
