the NES. A Party for the purposes of this clause is the Employee/s or the Employer that are subject to the dispute.
the NES. (a) Employees are entitled to personal/carer’s leave in accordance with the NES.
(b) Casual employees have no entitlement to paid personal/carer’s leave, but do have an entitlement to unpaid carer’s leave.
the NES. Where an issue under clause 22.1 arises which an Employee seeks to be resolved, the issue must first be referred for discussion between the Employee and their immediate Supervisor to attempt to resolve the issue.
the NES. 44.1 It is the intention of this Agreement that the NES, as it may be varied from time to time, shall apply to the employees the subject of this Agreement. Any provisions of the NES that are also referred to or set out in this Agreement are for the ease of the parties.
44.2 Where the NES provides, or is varied to provide, a condition or entitlement more favourable to the employee in a particular respect than that set out in this Agreement, the better entitlement will apply.
44.3 The minimum guarantees provided by the NES will override less favourable provisions in this Agreement.
the NES. In the first instance, the Parties to the Dispute must try to resolve the Dispute at the workplace level, by discussion between the Employee and the Employee's Supervisor.

the NES. The National Employment Standards (NES) for annual leave is four weeks per year which accrues progressively throughout the year and from year to year. Annual leave must be paid at a rate which is no less than the base rate of pay for ordinary hours the employee is paid at the time of taking the leave. Non-award employees can cash out annual leave by agreement with the employer.
