Common use of Tier 2 Clause in Contracts

Tier 2. Settlement Class Members who elect to fill out the Claim Form for Tier 2 and do have valid Proof of Purchase may recover $0.40 per Unit for up to one hundred (100) Units or $40.00 per Household, subject to adjustments based upon, among other things, the number of Valid Claims submitted.

Tier 2. Settlement Class Members who elect to fill out the Claim Form section for Tier 2 and do have who provide valid Proof Proof(s) of Purchase may recover $0.40 .80 per Unit purchased for up to one hundred (100) Units or $40.00 per Household, subject to adjustments based upon, among other things, the number of Valid Claims submittedUnits for which a valid Proof of Purchase has been provided, up to a maximum reimbursement of twenty-five dollars ($25.00) per Household. For the avoidance of doubt, a Settlement Class Member may file a single Claim only, electing either Tier 1 or Tier 2 per Household.

Tier 2. Settlement Class Members who elect to fill out the Claim Form section for Tier 2 and do have who provide valid Proof Proof(s) of Purchase may recover $0.40 1.00 per Unit purchased for up to one hundred (100) Units or $40.00 per Household, subject to adjustments based upon, among other things, the number of Valid Claims submittedUnits for which a valid Proof of Purchase has been provided, up to a maximum of $30.00 per Household. For the avoidance of doubt, a Settlement Class Member may file a single Claim only, electing either Tier 1 or Tier 2 per Household.

Tier 2. Settlement Class Members who elect to fill out the Claim Form section for Tier 2 and do have who provide valid Proof Proof(s) of Purchase may recover $0.40 3.00 per Unit purchased for up to one hundred (100) Units or $40.00 per Household, subject to adjustments based upon, among other things, the number of Valid Claims submittedUnits for which a valid Proof of Purchase has been provided, up to a maximum of 15 units, for a benefit of up to a maximum of $45.00 per Household.
