Timing of Infrastructure Commencement. Seller shall begin construction of Project infrastructure within nine (9) months following the Effective Date, subject only to Force Majeure (as defined in section 5(e) below). Seller shall notify Purchaser in writing that it has initiated construction by providing a copy of the Project Infrastructure Commencement Milestone Certificate. If the Project Infrastructure Construction Commencement Milestone Certificate is not provided within nine (9) months following the Effective Date, either party shall have the right to terminate this Agreement and upon receipt by either Seller or Purchaser of written notice from Purchaser or Seller terminating this Agreement, any Deposits made by Purchaser shall be fully refundable to Purchaser. Upon delivery of such written notice and the return of any and all Deposits, this Agreement shall terminate and be null and void, and neither party shall have any further liability or obligation to the other.

  • Pre-Commencement Phase Services The services required to be provided by the Contractor for the Pre- Commencement Phase of the Project in accordance with the Contract Documents.

  • PRE-CONSTRUCTION PHASE SERVICES The Pre-Construction Phase shall be deemed to commence upon the date specified in a written Notice to Proceed with Pre-Construction Phase Services issued by Owner and shall continue through completion of the Construction Documents and procurement of all major Subcontractor agreements. Contractor is not entitled to reimbursement for any costs incurred for Pre-Construction Phase Services performed before issuance of the written Notice to Proceed. Pre-Construction Phase Services may overlap Construction Phase Services. Contractor shall perform the following Pre-Construction Phase Services:

  • Preconstruction Phase Services Preconstruction Phase Services shall mean all services described in Article 3.1, and any similar services described in the Request for Proposals, including such similar services as are described in the Construction Manager at Risk’s Response to the Request for Proposals to the extent they are accepted by Owner, but excluding any Early Work. Early Work shall be considered part of Construction Phase Services.

  • Construction Phase Services 3.1.1 – Basic Construction Services

  • Building Commissioning Services The Owner may provide as a part of its testing services the Building Commissioning services involving the project’s HVAC and exhaust systems, temperature control systems, fire detection and alarm systems, emergency power and lighting system, fire suppression system, security locks and security locking control systems, food service equipment (if applicable), and laundry equipment (if applicable). In the event the Using Agency’s Program specifies additional commissioning services, the Owner shall procure such services as well. The Owner, through its Executive Administrator, may engage an independent Commissioning Authority. It is the intent of this Article that the Commissioning Authority enforce the requirements mentioned herein and certify that the systems and equipment listed all function properly prior to the initiation of each final inspection.

  • Scope of Interconnection Service 1.3.1 The NYISO will provide Energy Resource Interconnection Service to Interconnection Customer at the Point of Interconnection.

  • COMPENSATION FOR CONSTRUCTION PHASE SERVICES 5.1 For the Construction Manager’s performance of the Work as described in Section 2.3, the Owner shall pay the Construction Manager the Contract Sum in current funds.   • Synchronization, Commissioning and Commercial Operation 4.1.1 The Power Producer shall give at least thirty (30) days written notice to the SLDC and GUVNL, of the date on which it intends to synchronize the Power Project to the Grid System.
