Individual PAGA Payments. The Administrator will calculate Individual PAGA Payments by (a) dividing $ by the total number of PAGA Pay Periods worked by all Aggrieved Employees and (b) multiplying the result by the number of PAGA Period Pay Periods worked by each individual Aggrieved Employee.
Individual PAGA Payments. The amount payable to each Eligible Aggrieved Employee from the portion of the PAGA Payment allocated to the Eligible Aggrieved Employee under the terms of this Settlement Agreement. Eligible Aggrieved Employees are not required to submit a claim form to receive their Individual PAGA Payment.
Individual PAGA Payments. The Administrator will calculate Individual PAGA Payments by (a) dividing the Aggrieved Employees’ Share of the PAGA Penalties Amount 1 ($50,000.00) by the total number of PAGA Pay Periods worked by all Aggrieved Employees 2 and (b) multiplying the result by the number of PAGA Period Pay Periods worked by each 3 individual Aggrieved Employee.
Individual PAGA Payments. The Administrator will calculate Individual PAGA Payments by
Individual PAGA Payments. Aggrieved Employees will be entitled to 14 payments calculated in accordance with the number of pay periods in which they worked during the 15 PAGA Period, in relation to the total number of pay periods worked by all Aggrieved Employees during 16 the PAGA Period.
Individual PAGA Payments. Individual PAGA Payments will be calculated and 14 apportioned from the PAGA Employee Amount based on the PAGA Members number of Qualified 15 PAGA Workweeks as follows: The Settlement Administrator will divide the PAGA Employee Amount,
16 i. e., 25% of the PAGA Penalty Amount, by the total number of Qualified PAGA Workweeks of all 18 Qualified PAGA Workweeks by the PAGA Workweek Value to yield his or her Individual PAGA
Individual PAGA Payments. The Administrator will calculate Individual PAGA Payments by (a) dividing $ by the total number of PAGA Months worked by all Aggrieved Employees and (b) multiplying the result by the number of PAGA Period Months worked by each individual Aggrieved Employee, as adjusted in the following sentence. PAGA Period months will be adjusted as follows: (i) each PAGA Period month worked by an Aggrieved Employee who had a company-issued cell phone will be counted as 0.5 months for purposes of the calculation; (ii) each PAGA Period month worked by an Aggrieved Employee who entered into an arbitration agreement (and/or signed an employment contract with an arbitration provision) with Fox will be counted as 0.25 months for purposes of the calculation;
Individual PAGA Payments. The Administrator will calculate each Individual PAGA Payment by (a) dividing the amount of the Participating and Non-Participating Class Members’ 25% share of the $38,000 in PAGA Penalties ($9,500) by the total number of Adjusted PAGA Pay Periods worked by all Participating and Non-Participating Class Members during the Class Period and (b) multiplying the result by each Class Member’s Adjusted PAGA Pay Periods. Under the terms of the Settlement, a Pay Period occurring between January 30, 2020 and July 31, 2020 is counted as two (2) “Adjusted PAGA Pay Periods,” and any other Pay Period occurring during the Class Period is counted as one (1) “Adjusted PAGA Pay Period.”
Individual PAGA Payments. The Administrator will divide the 25% portion of the PAGA Penalties attributed to Aggrieved Employees, i.e., $50,000.00, by the PAGA Pay Periods worked by all Aggrieved Employees during the PAGA Period resulting in the PAGA Pay Period Value and then multiplying the PAGA Pay Period Value by the number of PAGA Pay Periods worked by each individual Aggrieved Employee during the PAGA Period.
Individual PAGA Payments. The amount payable to each PAGA Member from their individual portion of the PAGA Payment allocation under the terms of this Settlement Agreement. PAGA Members are not required to submit a claim form to receive their Individual PAGA Payments. Rather, PAGA Members will receive an Individual PAGA Payment automatically, without the return of a claim form. PAGA Members will also be unable to opt out of their Individual PAGA Payment.
