TRANSFER OF TEACHERS. (a) The parties acknowledge that priority placements of displaced teachers are the paramount consideration in this Article. (b) At the earliest possible date the Board, in consultation with the Union, shall seek alternatives for the teachers on the priority placement list. 21.2 The Board shall make all reasonable best efforts to fill vacant and unfilled administrative positions on or before May 7th of each year. 21.3 Only permanent contract teachers and teachers on the priority placement list are eligible for transfer pursuant to the provisions of subsection 21.4 – 21.7 of this Article 21.4 In order to encourage and promote voluntary teacher transfer, the Board shall: (a) by May 1st but in no event later than May 7th, compile a list of all vacant and unfilled (one year) positions available for the following school year. In the event that the Board is unable to complete its staffing requirements by May 1st, but in no event later than May 7th, then an alternate schedule of posting may be mutually agreed upon by the parties; and (b) continue to publish a list of positions to include any new positions created by the transfer of teachers or as a result of any administrative appointment or any other position that becomes available. The Board shall carry out two rounds of voluntary transfers. The positions shall be posted for four (4) calendar days. 21.5 Voluntary transfers shall not commence until all teachers have been given their teaching assignments. (c) Notwithstanding Article 21.6 (a), but following the close of the competition for each of the two (2) voluntary rounds of transfer, in the event that an obvious solution to a problem placement of a teacher on the priority placement list exists, the Board, may invoke the provisions of Article 22 – Board-Initiated Transfer - to accomplish same. 21.7 (a) If the position awarded pursuant to Article 21.6 ceases to exist or the teaching assignment is significantly changed, the teacher has the right to return to his/her original position.

21.9 The Director of Human Resources shall meet with representatives of the Union to discuss all voluntary transfers and shall provide all necessary information to monitor the process.
21.10 A permanent contract teacher who is the successful applicant in one round of positions shall have the opportunity to apply for vacant positions which become available on subsequent lists.
21.11 Where staff reduction necessitates displacement from a school, teachers shall be transferred out of the school according to their positions in the system seniority list.
21.12 Notwithstanding Article 21.11, the Centre for Education may determine that a program(s), taught by the least senior teacher(s) is/are essential to that school’s overall program:
(a) The school Principal in consultation with the Director of Human Resources shall endeavour to fill the declared essential program(s) within the existing staff of the affected school.
(b) If in the judgement of the Centre for Education the quality of the declared essential program(s) cannot be maintained through a rearrangement of staff in the school, then the next junior teacher in the school shall be placed on the priority placement list.
(c) In the event that the Union does not agree with the Centre for Education’s decision, then a committee, as referred to in Article 20.10 (b), consisting of three (3) members of the Union and a committee of three (3) members of the Centre for Education shall meet within ten

(c) Notwithstanding Article 21.6 (a), but following the close of the competition for each of the two (2) voluntary rounds of transfer, in the event that an obvious solution to a problem placement of a teacher on the priority placement list exists, the BoardCentre for Education, may invoke the provisions of Article 22 – Board-Centre for Education – Initiated Transfer - – to accomplish same.

(c) include positions that become available as a result of retirements, resignations, deaths, dismissals for just cause, newly created positions and all other full year leaves. Semester leaves may be offered for consideration;
(d) publish a permanent vacancy list of positions on at least a bi-weekly basis after May 1st to include any new positions created by the transfer of teachers or as a result of any administrative appointment permanent teachers, or any other additional position that becomes availableas identified in (b). The For greater certainty the Board shall carry out publish at least two (2) permanent vacancy lists and complete two rounds of voluntary transfers. The length of the school year shall not exceed one hundred ninety-five (195) days taught or deemed to be taught. Included in the one hundred ninety-five school days pursuant to there shall. be at least eight (8) days available for In-service Education and organization. The days pursuant to shall with the approval of the Director be designated for use as follows: organization purposes; pupil evaluation and classification and administrative purposes; attendance at school board or Department of Education sponsored and approved in-service programs. The calendar arrangement of teaching days and holidays for each Centre in any school year, within the period September to June both dates inclusive, shall be offered the responsibility of the Director in consultation with the President of the respective Local of the Union. Notwithstanding the calendar arrangement of teaching days and holidays €or a position on teacher employed in an extension class outside a Centre in any school year, shall parallel the basis calendar of seniority provided they the local school district within which the extension class is located. An interview for disciplinary purposes shall be understood to his/her original positionmean an interview convened for the purpose of dealing with a warning or reprimand, a suspension or the dismissal of the teacher. Any interview in which it is not intended to deal with I' any of the aforementioned disciplines shall not be considered a meeting for disciplinary purposes. The exercise of this right by a teacher shall not result in a delay of said interview by more than forty-eight (48) hours.
