POSTING AND FILLING VACANT POSITIONS. 1. In this Article vacancy means a newly created teaching position or an existing teaching position for which there is a continuing need to which a teacher is not assigned. All teachers in the District are eligible to apply for all vacancies except those vacancies filled by teachers on the Recall List. A teaching position filled by a temporary appointee does not become a vacancy on expiration of the temporary contract if that temporary appointee is re-engaged and assigned to that position. 2. The Board will undertake to make vacancies or possible vacancies known to all potential candidates through a variety of internal and external advertising. During the regular work year the Board shall post notices of vacancies as soon as they become known in all work sites where teachers are assigned and at the District Office. A copy will be forwarded to the CTA office. At times other than the regular work year, notices of vacancies will be posted in the District Office with a copy forwarded to the CTA office. 3. All vacancies covered by this Agreement will be posted for a period of five (5) teaching days during the work year and seven (7) days during the summer prior to the deadline for applications. Postings shall include at least a. identification of the work site, b. description of the position to be filled, c. type of contract (continuing or temporary), d. effective date and, if applicable, end date, and e. closing date for applications. 4. Postings shall not include references to extra-curricular activities. 5. Vacancies created by Leaves of Absence including Maternity/Paternity Leave shall be posted and filled by temporary appointment. On return from leave, the teacher shall be assigned to the same position held prior to taking the leave; however his/her assignment may not be identical to his/her previous assignment. 6. The Board shall fill a vacant position from the applicants in the priority set out below on the basis of qualifications (Article C.20.3)

POSTING AND FILLING VACANT POSITIONS. 1. An effort shall be made to recruit, appoint and assign the finest teachers available to staff the schools in the District. 2. In this Article, vacancy means an existing or newly created teaching position which the Board intends to post and fill in accordance with this Article exclusive of any temporary adjustment of 0.4 FTE or less which does not require posting to fill and to which a teacher is not assigned or transferred.
POSTING AND FILLING VACANT POSITIONS. 21.1 When a teaching position is known and confirmed to be vacant for the subsequent entire school year (September 1 to June 30), the position shall be posted through the district‘s electronic communication system provided that: a. the vacancy is confirmed no later than four (4) days before the end of the regular work year for teachers as defined in Article D.20; b. the position is a full-time or part-time continuing position, or a limited duration assignment of 0.5 or greater; c. all teachers on the Recall List with the necessary qualifications have declined the position; and d. the position is not required for a Teacher or Board initiated transfer (priority reassignment, surplus staff reassignment, special circumstances reassignment or administrative transfer) as per the Board's Teacher Transfer Policy. 21.2 Positions identified in Article E.21.1 above may be advertised through the district electronic communication system if the position is known and confirmed to be vacant before May 1. 21.3 Positions posted as per Article E.21.1 or E.21.2 above will be offered to new applicants only if no applications are received from internal applicants (continuing assignment teachers or Limited Duration assignment teachers who are eligible for the Service Record List) with the necessary qualifications. Applicants must apply electronically to Human Resources by the closing date specified in the posting. 21.4 When a teaching position of more than twenty (20) consecutive working days becomes available after the last posting date identified in Article E.21.1 above, it shall be filled as a Limited Duration assignment. The position will first be offered to teachers on the Recall List as per the process described in Article C.23. If the position is not filled from the Recall List, it will be offered to teachers on the Limited Duration Service Record List who have the necessary qualifications. If the position is not filled from the Limited Duration Service Record List, it will be offered to new applicants, including Teachers Teaching On Call.

All vacancies of 20 days or more shall be posted. All teachers in the District are eligible to apply for all vacancies. During spring post and fill (May to June 30), when a teacher has applied for and accepted an assignment for the coming year, that teacher will not be eligible to apply for further assignments which are posted unless the assignments are continuing or will increase their FTE for the following year. a. Positions that become vacant during the school year shall be filled with a teacher on a temporary contract except for a position requiring special skills that may be filled as continuing in accordance with Article E.22. b. In such circumstances where the Board intends to fill such a vacancy on a continuing basis during the school year the BVTU president will be consulted before any decision is made by the Board. c. Where a position has been posted on a temporary basis and a decision has been made to fill this position on a continuing basis, the position shall be re-posted in the District. d. The fact that a local teacher applying for a position that will be filled on a continuing basis causes disruption to that teacher's school shall not be a factor influencing consideration of their application.

POSTING AND FILLING VACANT POSITIONS. 1. The Board and Local agree that it is desirable to minimize the occurrences of students in the same class being taught by a succession of teachers in the same school year. The circumstances which give rise to such occurrences can arise for reasons beyond the control of either the Board or the Local. The Board and the Local will make every reasonable effort to minimize these occurrences. a. Where a problem arises in the application of a posting and filling provision the Board and the Local may agree to a solution which is inconsistent with the provision. In such cases, the solution is without prejudice and does not constitute a waiver of rights by the Board and the Local. b. For greater clarity, the obligation set out in this section is an obligation to make every reasonable effort. Despite paragraphs (1) and (2), this section does not take away from nor add to the rights of any employee, nor does it require a local union or a school district to amend or waive a provision of the agreement. 2. Prior to a position being posted consideration will be given to candidates in the following order of priority: a. first within the geographical areas known as the “zones”; i. reassignment of continuing teachers of that school or teachers returning to their assignment after completion of a leave of absence of up to one year, ii. reassignment of teachers returning from a leave of absence of more than one year, administrative officers returning to full-time teaching, teacher transfers, or teachers on the recall list b. after all teachers within a zone described by the provisions in a, i and ii above have been assigned to positions for which they are qualified, the teachers employed in other zones within the district shall be considered for positions for which they are qualified in the following order of priority. i. reassignment of continuing teachers or teachers returning to a position after completion of a leave of absence of up to one year, ii. reassignment of teachers returning from a leave of absence of more than one year, administrative officers returning to full-time teaching, teacher transfers, or teachers on the recall list 2. Reassignment shall be based on the qualifications, training, experience, equitable distribution of workload, personal preference of the Teacher and the overall educational requirements of the school. 3. In this Article "vacancy" means an existing or newly created teaching assignment or position to which a Teacher is not assigned following the completion of item 1 above, and which the District intends to fill.
