Common use of Transfers and Seniority Outside Bargaining Unit Clause in Contracts

Transfers and Seniority Outside Bargaining Unit. (a) No employee shall be transferred to a position outside the bargaining unit without her written consent. An employee who is transferred or promoted to a position outside the bargaining unit shall not accumulate seniority. In the event the employee is returned by the Employer to a position in the bargaining unit within twelve (12) months, he or she shall be credited with the seniority held at the time of transfer and/or promotion and resume accumulation from the date of her return to the bargaining unit. An Employee not returned to the bargaining unit within twelve (12) months shall forfeit her bargaining unit seniority. (b) In the event an Employee transferred out of the bargaining unit is returned to the bargaining unit within a period of six (6) months he or she shall accumulate seniority during the period time outside the bargaining unit. (c) In the event the employee’s former position is eliminated, or the hours are reduced, during the period of her absence the employee shall be given Notice of Layoff in accordance with the Layoff articles of this agreement at the time the position is eliminated. The employee will make her election in accordance with the collective agreement. When the employee returns to the bargaining unit she shall then return to the position she received in accordance with the layoff procedures.
