Common use of Transfers and Seniority Outside the Bargaining Unit Clause in Contracts

Transfers and Seniority Outside the Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without their consent. If an employee is transferred to a position outside of the bargaining unit, seniority acquired at the date of leaving the unit shall be retained for two (2) years, but no further accumulation shall occur. Should the employee return within two (2) years, this will not result in any layoff, bumping or reduction of hours of any employee(s).

If he returns within the twelve (12) months, he shall be retained for two (2) years, but no further accumulation placed in a job consistent with his seniority. Such return shall occur. Should the employee return within two (2) years, this will not result in any layoff, the layoff or bumping or reduction of hours of any employee(s)an employee holding greater seniority.

Employees promoted or transferred to a non-bargaining unit position shall be retained retain their seniority for two three (23) yearsmonths after which time, but no further accumulation the individual shall occur. Should the employee return within two (2) years, this will not result in any layoff, bumping or reduction of hours of any employee(s)lose all seniority rights.

If an employee applies for and is promoted or transferred to a position outside of the bargaining unit, he shall retain his seniority acquired at the date of leaving the bargaining unit shall for the period of their probation in the new position (not to exceed 60 days). If an employee returns to the bargaining unit during this probationary period they will be retained for two (2) years, but no further accumulation shall occur. Should the employee return within two (2) years, this will not result placed in any layoff, bumping or reduction of hours of any employee(s)their former position.
