TRANSFERS AND VACANCIES. 8.3.1 School Directors willA. A request by a teacher for transfer shall be made to the Human Resources Department in writing prior to April 30 on forms furnished by the Board, through and a copy of the transfer request shall be forwarded by the Human Resources Department to the current principal(s) and, unless the teacher prohibits such notification, the HVEA president. After consideration of the transfer requests, any vacancy must be posted. The application shall set forth the reasons for transfer, the school, grade and/or position sought and the applicant's academic qualifications, certifications, and endorsements on file with Human Resources as of March 31. The teacher requesting a transfer will notify and discuss the matter with the principal of the school to which he/she wishes to be transferred. If all parties - the teacher, the principal of the school to which the teacher wishes to transfer, and the Board are in favor of such transfer, then the transfer shall take place. In each case where a teacher has requested a transfer under this Section and where the request is not granted for any reason, the teacher will receive an explanation in a timely manner. However, it is understood that transfers after the close of school shall be granted at the discretion of the Superintendent’s Designee.
B. It is recognized by both parties that involuntary transfers may be necessary; however, announce the Board agrees that involuntary transfers will be made only for good cause. Following one week notification, plus consultation with the teacher or teachers and post principals concerned at a meeting, including the Superintendent or his/her designee and the association President or his/her designee, it shall be up to the Superintendent of Schools as to whether an involuntary transfer is necessary. Upon written request of the teacher, the association shall also be notified of the reasons for such unrequested transfer.
C. When involuntary transfers are effected for a necessary reduction in a school's staff allocation due to reduced student enrollment, reduced finances or the closing of a building, qualifications, program needs and seniority shall be considered in such transfer decisions. When qualifications and program needs are predominately equal, seniority shall prevail.
D. The filling of instructional vacancies shall be accomplished by using the following procedures:
1. Review all intratransfer requests.
2. Provide the association President with appropriate postings including qualifications and job descriptions (where possible), as vacancies occur. All known instructional vacancies will be posted in each school building in the district between April 1 and April 15.
1. The posting of extra-school curricular vacancies when they occur or become known. Teachers within that school will have shall be for a period of five (5) school days from workdays.
2. The vacancies shall be posted district-wide, with first preference given to bargaining unit members within the date of posting in which to apply for building. Candidates that meet the vacancyqualifications shall receive an interview.
3. If this vacancy the position is not filled from within the building, then qualified district-wide candidates shall be interviewed.
4. Internal candidates not selected for a position shall receive, in writing, the reasons for not being selected. In addition, the District is encouraged to provide suggestions for training and/or experience opportunities that may increase skills and improve the possibility of successful selection for future vacancies.
5. Should the position remain unfilled, the district may post the position to the public.
E. The Board and the association recognize that transfers of personnel to fill vacant instructional staff positions arising during the school year are disruptive to the educational process. However, to insure that recognition is given to the aspirations and abilities of its staff, all such vacant instructional staff positions occurring during the school year will be considered to be filled on a temporary basis when personnel outside the district are hired. All transfer requests made by an intra-current staff to these positions shall be given priority in filling these vacancies for the following school teacheryear. Teachers desiring a transfer shall endeavor to submit their requests within five (5) working days after the postings. If no transfer request for the position has been made by April 30, then the vacancy position may be otherwise filled by the district. Notice will be posted as stated sent to the association President when a vacancy has been filled on a temporary basis. The Board agrees to inform temporary teachers in Section 8.3.3writing of this contract provision prior to their employment.
8.3.2 Teachers returning from leave F. All vacant supervisory positions within the instructional staff shall be posted in every school building. A supervisory position is defined as one having the scope and authority of hiring, promoting, demoting, or dismissing employees. No such vacancy shall be filled, except on a temporary basis, until such vacancy shall have been posted for at least two (2) weeks.
G. A Screening Committee including a Huron Valley teacher representing the association may interview candidates for Huron Valley instructional administrative positions.
H. Any qualified teacher may apply for any school vacancies posted for instructional supervisory vacancy. In filling such vacancy, the Board shall consider the professional qualifications, background, attainments, and other relevant factors, including seniority of all applicants from within the school district, as well as applicants from outside the school district. Provided, however, in all appointments to which they were assigned when their leave commencedpositions, the Board's decision shall be final and not subject to the grievance procedure.
8.3.3 All school vacancies I. Any teacher who shall be transferred to an administrative or executive position and shall later return to a teacher status shall be entitled to retain such rights as he/she may have had under this Agreement prior to such transfer to supervisory or executive status.
J. A bargaining unit member, who has not previously attained tenure under the Michigan Teacher Tenure Act (MCLA 38.71, et seq.) in a position other than as a classroom teacher, who is placed in a position other than a classroom teacher, shall not be deemed to have tenure in such non-classroom teaching position by virtue of this contract or any individual contract for such non-classroom position, but shall be deemed to have continuing tenure as an active classroom teacher after the probationary period if applicable.
K. Whenever vacancies occur during the normal summer months the following procedures shall be followed:
1. Teachers with specific interests in possible vacancies will notify the Human Resources Department of their interest in writing during the last regular week of school and shall include a summer address.
2. Should a vacancy occur, the teachers who have expressed an interest in said position or similar position shall be contacted by the Human Resources Department and notified of the vacancy.
3. The teachers so notified shall have the responsibility of contacting the Human Resources Department indicating their interest in said position within three (3) days of notification.
4. Notice of summer postings shall be sent to the association President.
5. Vacancies will be posted on at the District’s website district's administration office for at least a period of five (5) days as these vacancies occur. Teachers will be given the opportunity to apply for these vacancies or openings as they are posted. Applications will be submitted to the Superintendent’s Designeeworking days.
8.3.4 Teachers returning from any leave of absence will be notified all available vacancies for the next school year and may apply for these vacancies as they are posted. To ensure positions, these teachers may also be assigned to positions by the Superintendent’s Designee.

The District shall send a notice of vacancy to unit members on leave of absence by first class mail to the unit member's last known address provided the unit member has filed both a written request for consideration for such vacancy within three (3) months prior to the initial posting and may apply for these vacancies as they are posted. To ensure positionswritten notice with the District Human Resources Office of his/her leave-of-absence, these teachers may also be assigned to positions by citing the Superintendent’s Designeedates of anticipated leave.
8.3.5 Notification of vacancies occurring after the regular school year will be posted 15.2 The District shall post vacant positions on the District website as well as e-mailed to all district staff via the district e-mail system. During the ten calendar employment opportunities webpage for a period of not less than six (6) working days prior to the first teacher workdayclosing of the vacancy. 8.3.6 All qualified in-district applicants for teacher vacancies shall be interviewed by 3) months prior to the appropriate administrator initial posting and school hiring team when possible. Each interviewed applicant shall be notified in writing of written notice with the disposition District Human Resources Office of his/her applicationleave-of- absence, citing the dates of anticipated leave.
8.3.7 The Association 15.4 A request for transfer with the same job classification may be submitted at any time to the Office of Human Resources. Unit members on the transfer request list as of the closing date of the recruitment shall be offered an interview with the hiring manager along with other eligible applicants. Following the interview, the District will inform the unit member if the transfer request is approved or denied. An employee initiated transfer request shall be submitted via email to the Human Resources Office and Board of Education agree that collaboration shall remain on file in the teacher hiring process Human Resources Office for twelve (12) months, or when the transfer occurs, or when the employee is desirable and that every opportunity should promoted or leaves the District, whichever occurs first.
15.5 Lateral transfer of unit members may be initiated by the District for identifiable operational related needs. Prior to such transfer, the District shall attempt to seek volunteers within the bargaining unit. The unit member selected shall be given a minimum of ten (10) working days notice, and a conference shall be held with the Superintendent/President or designee to district teachers to provide their input on hiring teamsdiscuss the basis for the transfer. We collectively understand that circumstances may lead to the need for hiring decisions to be made by administration without consultation. TRANSFERS AND VACANCIES. 8.3.1 Although the Committee and the Association recognize that frequent transfers of teachers disrupt the educational process and interfere with the optimum teaching performance, they do also recognize that some transfer of teachers is unavoidable.
A. When the need for a transfer or a reassignment of teachers from one school to another or within a school arises for some justifiable cause including a vacancy, request for voluntary reassignment and/or transfer will be considered.
B. When involuntary transfers are necessary, a teacher's area of competence, major and/or minor field of study, quality of teaching performance, and length of service in the Fall River School Directors will, through the Superintendent’s Designee, announce and post all intra-school vacancies when they occur or become knownSystem will be considered. Teachers within that school being involuntarily transferred will have five be transferred only to a comparable position. L. Teachers-in-charge who are assigned on an intermediate basis will continue to be paid five dollars ($5.00) per day. A long-term teacher-in-charge is defined as one who will serve as teacher-in-charge beyond fifteen (15) school days. A vacancy occurring in long-term teacher-in-charge will be filled through a system-wide advertising process. The advertising process will take place at the above philosophybeginning of the school year. FinallyThe Superintendent or his/her designee will choose long-term teacher-in-charge from the system-wide application list. A short-term teacher-in-charge is defined as one who will serve for fifteen (15) school days or less. Advertisements for short-term teacher-in-charge will be restricted to an individual building. The Superintendent or his/her designee will choose short-term teachers-in-charge from the building-wide application list. If a teacher will act as teacher-in-charge for seventy-five percent (75%) or more of any workday, we a substitute shall be hired to replace the teacher for that day if he/she desires one.
M. The Fall River School Committee and the Fall River Educators’ Association agree that all vacancies which are to be filled will be advertised. The parties further agree that a vacancy is any opening caused by death, promotion, resignation, retirement, dismissal, creation of a new position, or transfer. Any temporary vacancies which will last at least a full year will be filled by a teacher not a substitute. Vacancies occurring after the Superintendent opening of school will make final hiring recommendations be advertised for the next school year. Voluntary transfers to the Board of Educationexchange positions by two or more teachers will not have to be advertised.

8.3.5 Notification of vacancies occurring after the regular school year Such bulletins will be posted on the bulletin boards in all work areas. The bulletin will state the number of jobs to be filled, the scheduled location of the job, the shift, the rate of pay for each job to be filled, and a description of the work required. When vacancies occur as a result of either attrition or contract expansion, the opportunity for additional qualifications will be afforded to instructors who meet contract criteria for the particular course(s) in which there is a vacancy. All bids will be made in two (2) written copies. One of each shall be furnished to the District website as well as e-mailed and one to the Shop xxxxxxx in the department in which the vacancy or new job exists.
(A) An advisory board consisting of the Associate Deans and the appropriate Lead Instructor(s) will be formed to:
(1) Analyze vacancies and to ascertain the feasibility of meeting contract requirements by distributing the assigned work to all district staff via qualified faculty in that discipline in lieu of hiring replacement personnel. The board’s primary consideration is to assure adequate staffing levels to meet the district e-mail systemdemands of the contract. During The board will submit a plan of action to the ten calendar days Contract Manager for his concurrence.
(2) Determine the feasibility of expanding work hours of current qualified faculty to undertake curriculum development projects prior to hiring additional staff to perform these functions.
(3) Examine the first teacher workday, qualifications and seniority of current faculty members desiring/required to transfer to other school areas to ascertain their fitness for such transfer and to make appropriate recommendations to the five Contract Manager.
(4) Examine the qualifications and seniority of current faculty and make appropriate recommendations to the Contract Manager when it becomes necessary to decrease the number of instructors.

Administrators will make every effort to contact teachers who have previously expressed an interest through a Request of Transfer submitted to the Superintendent’s Designee by March 15 (8.2.1.1).
8.3.6 All qualified in-district applicants for teacher vacancies shall be interviewed by the appropriate administrator and school hiring team when possible. Each interviewed applicant shall be notified in writing of the disposition of his/her application.
8.3.7 The Association and the Board of Education agree that collaboration in the teacher hiring process is desirable and that every opportunity should be given to district teachers to provide their input on hiring teams. We collectively understand that circumstances may lead to the need for hiring decisions to be made by administration without consultation. We understand this should not be a consistent occurrence and all efforts will be made to follow the above philosophy. Finally, we agree that the Superintendent transfers of such employees should be minimized.
B. ASSIGNMENTS TO ASSURE STUDENT NEEDS ARE FIRST Preamble The District and the Association recognize the capabilities, training, experience and interests of all employees. To assure accountability and to eliminate the possibility of arbitrary and capricious action, and to assure that student needs are met, the following criteria will be utilized to fill ancillary staff vacancies, grant ancillary staff transfers and make final hiring recommendations to ancillary staff assignments. The Superintendent, as granted by the Board of Education, has the sole right to assign employees to positions for which they are qualified. The following are listed as factors for placement of teachers and are factors listed in order of priority regarding teachers and ancillary staff:
1. Teacher’s Certification (HQ, Certification and Endorsement);
2. Teachers and ancillary staff - Qualifications or willingness to perform the extra training, duties and responsibilities shall apply (i.e. District Trainings – Reading First, Balanced Literacy, Read-180, SIOP, 5-E Instructional Model, IFL, etc.), provided the extra training could have reasonably* been completed and available as of the first day of the assignment. Job expectations will be described in the position posting (see Article 9, K. 5 & 6). If a teacher or ancillary staff has not completed the training as outlined above, the District may reassign them or require them to take the next available training. * NOTE: The following factors shall be considered: availability of training, including the frequency of the training, teacher, ancillary staff or immediate family member extended illness, disability or death of the immediate family member.
3. Student needs: defined as the need for endorsed bilingual or certificated ESL staff or staff who are able to receive a permit from the State of Michigan, the need to not have all brand new staff in a location or classification. (See Article 9. C.
4. Teacher and ancillary staff’s willingness to obtain necessary building training, within a reasonable time frame (see note below). Job expectations will be described in the position posting (see Article 9, K. 5 & 6). NOTE: Normally up to one calendar year from the start of the assignment, e.g., bid into the position in June 2009, start assignment August of 2009, have until August 2010 to complete.
5. When a teacher and ancillary staff are in a program affected by new requirements/trainings, the teacher and ancillary staff must sign an agreement to obtain the necessary requirements/trainings within a reasonable timeframe (see note below). If the teacher or ancillary staff are not willing to meet the necessary requirements/trainings, they have the option to voluntarily transfer out of the building/program. NOTE: Up to one calendar year from the start of the assignment, e.g., bid into the position in June 2009, start assignment August of 2009, have until August 2010 to complete.
6. Ancillary staff’s length of service in the district (seniority) – Article 10 A.

TRANSFERS AND VACANCIES. 8.3.1 School Directors will, through the Superintendent’s Designee, announce and post all intra-school vacancies when they occur or become known. Teachers within that school will have five (5) school days from the date of posting in which to apply for the vacancy. If this vacancy is not filled by an intra-school teacher, then the vacancy will be posted as stated in Section 8.3.3.
8.3.2 Teachers returning from leave 15.1 Unit members may apply for any school vacancies posted new permanent unit member positions or existing unit member positions which become vacant. Application for the school to which they were assigned when their leave commenced.
8.3.3 All school such vacancies shall be posted on filed by the unit member in writing with the Human Resources Office within the posting period. The selection of a unit member to fill a vacancy is at the discretion of the District’s website for at least five (5) days as these vacancies occur. Teachers will In all cases, applicants who are not selected, upon request, shall be given a written explanation of the opportunity to apply for these District's decision within 30 days of the request. Unit members shall have preference over non-unit members in filling vacancies or openings as they when the District determines that the qualifications, abilities and experience are postedequal. Applications will be submitted to the Superintendent’s Designee.
8.3.4 Teachers returning from any Unit members on leave of absence will be notified all available vacancies who cannot personally file an application for vacancy due to illness or injury, may contact the next school year District to arrange for an alternative procedure. The District shall send a notice of vacancy to unit members on leave of absence by first class mail to the unit member's last known address provided the unit member has filed both a written request for consideration for such vacancy within three (3) months prior to the initial posting and may apply for these vacancies as they are posted. To ensure positionswritten notice with the District Human Resources Office of his/her leave-of-absence, these teachers may also be assigned to positions by citing the Superintendent’s Designeedates of anticipated leave.
8.3.5 Notification of vacancies occurring after the regular school year will be posted 15.2 The District shall post vacant positions on the District website as well as e-mailed to all district staff via the district e-mail system. During the ten calendar employment opportunities webpage for a period of not less than six (6) working days prior to the first teacher workdayclosing of the vacancy. The District shall provide an accessible PDF copy of each vacancy posting to the CSEA Chapter President or designee via email not less than six (6) working days prior to the closing of the vacancy. In cases where a vacancy reoccurs with six (6) months of the District having previously filled the vacancy, the five (5) day posting District may be waivedconsider finalists who previously applied for the position. Administrators The District will make every effort repost internally for six working days should the District consider this option for refilling the vacancy. Internal applicants who apply and meet the minimum qualifications shall receive an interview with the hiring manager.
15.3 Unit members on leave of absence who cannot personally file an application for vacancy due to illness or injury, may contact teachers who have previously expressed the District to arrange for an interest through alternative procedure. The District shall send a Request notice of Transfer submitted vacancy to unit members on leave of absence by first class mail to the Superintendentunit member’s Designee by March 15 last known address provided the unit member has filed both a written request for consideration for such vacancy with three (8.2.1.1).
8.3.6 All qualified in-district applicants for teacher vacancies shall be interviewed by 3) months prior to the appropriate administrator initial posting and school hiring team when possible. Each interviewed applicant shall be notified in writing of written notice with the disposition District Human Resources Office of his/her applicationleave-of-absence, citing the dates of anticipated leave.
8.3.7 The Association 15.4 A request for transfer with the same job classification may be submitted at any time to the Office of Human Resources. Unit members on the transfer request list as of the closing date of the recruitment shall be offered an interview with the hiring manager along with other eligible applicants. Following the interview, the District will inform the unit member if the transfer request is approved or denied. An employee initiated transfer request shall be submitted via email to the Human Resources Office and Board of Education agree that collaboration shall remain on file in the teacher hiring process Human Resources Office for twelve (12) months, or when the transfer occurs, or when the employee is desirable and that every opportunity should promoted or leaves the District, whichever occurs first.
15.5 Lateral transfer of unit members may be initiated by the District for identifiable operational related needs. Prior to such transfer, the District shall attempt to seek volunteers within the bargaining unit. The unit member selected shall be given a minimum of ten (10) working days’ notice, and a conference shall be held with the Superintendent/President or designee to district teachers to provide their input on hiring teamsdiscuss the basis for the transfer. We collectively understand that circumstances may lead to the need for hiring decisions to be made by administration without consultation. We understand this should Lateral transfers shall not be used to affect a consistent occurrence layoff in lieu of statutory layoff procedures.
15.6 Transfer into a vacancy between sites may be initiated by a unit member or immediate supervisor and all efforts will shall be made to follow granted upon mutual agreement between unit member and immediate supervisor when hours and assignment shall remain the above philosophy. Finally, we agree that the Superintendent will make final hiring recommendations to the Board of Educationsame.
