Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 Where the employee rejects an offer of employment with the transmittee: o in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a the business is before or after the date of this Agreement, transmitted from an the employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

The provisions of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 29.4.2. Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; oror‌ 19.7.1.2 29.4.3. Where the employee rejects an offer of employment with the transmittee: o . a. in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o and b. which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 9.4.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreementaward, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 6.1 The provisions of this clause are not applicable where a business is before or after the date of this the Agreement, transmitted from an employer the Company (in this subclause sub clause called the transmittortransmitter) to another employer (in this subclause sub clause called the transmitteetransmitee), in any of the following circumstances: 19.7.1.1 (i) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor transmitter and any prior transmittor transmitter to be continuous service of the employee with the transmittee; or 19.7.1.2 (ii) Where the employee rejects an offer of employment with the transmittee: o in • In which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittortransmitter; and o which • Which recognises the period of continuous service which the employee had with the transmittor transmitter and any prior transmittor transmitter to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a the business is before or after the date of this Agreement, transmitted from an employer (in this subclause called the transmittor) to another employer (in this his subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an the employer (in this subclause called the transmittor) to another employer (in this subclause sub clause called the transmittee), in any of the following circumstances:; 19.7.1.1 34.5.1. Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; ortransmitee 19.7.1.2 34.5.2. Where the employee rejects an offer of employment with the transmittee: o in : 34.5.2.1. In which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which and 34.5.2.2. Which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 (a) The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an the employer (in this subclause sub- clause called the transmittor) to another employer (in this subclause sub-clause called the transmittee), in any of the following circumstances: 19.7.1.1 (i) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (ii) Where the employee rejects an offer of employment with the transmittee: o in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a the business is before or after the date of this Agreement, agreement is transmitted from an employer Linde Gas Pty Limited (in this subclause called "the transmittor") to another employer (in this subclause called "the transmittee"), in any of the following circumstances: 19.7.1.1 30.5.1 Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 30.5.2 Where the employee rejects an offer of employment with the transmittee: o in In which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which Which recognises the period of continuous service service, which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause (clause 20) are not applicable where a business is is, before or after the date of this Agreement, agreement transmitted from an employer (in this subclause called the transmittortransmitter) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (i) Where the employee accepts employment with the transmittee transmitter which recognises the period prior of continuous service which the employee had with the transmittor transmitter and any prior transmittor transmitter to be continuous service of the employee with the transmittee; or 19.7.1.2 (ii) Where the employee rejects an offer of employment with the transmittee: o in • In which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittortransmitter; and o which • Which recognises the period of continuous service which the employee had with the transmittor transmitter and any prior transmittor transmitter to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 24.11.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o : i. in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o and ii. which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 a) The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer (in this subclause called the transmittortransmittee) to another employer (in this subclause called the transmittee), in any of the following circumstances:. 19.7.1.1 b) Where the employee Employee accepts employment with the transmittee which recognises the period of continuous service which the employee Employee had with the transmittor transmitter and any prior transmittor transmitted to be continuous service of the employee Employee with the transmittee; or. 19.7.1.2 c) Where the employee Employee rejects an offer of employment with the transmittee: o : i. in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee Employee at the time of ceasing employment with the transmittortransmitter; and o and ii. which recognises the period of continuous service which the employee Employee had with the transmittor transmitter and any prior transmittor transmitted to be continuous service of the employee Employee with the transmittee.

Transmission of business. 19.7.1 13.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an the employer (in this subclause called the transmittor) to another employer (in this subclause sub- clause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o : (i) in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o and (ii) which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 (a) The provisions of this clause are not applicable where a business is before or after the date of this Agreementaward, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called ‘the transmittee), ’) in any of the following circumstances: 19.7.1.1 Where (i) where the employee accepts employment with the transmittee which recognises the period of continuous service employment which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 Where (ii) where the employee rejects an offer of employment with the transmittee: o in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which recognises the period of continuous service employment which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which that the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions provision of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an employer (in this subclause called the transmittor) Xxxxxx to another employer Company (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor Xxxxxx and any prior transmittor Xxxxxx to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o : (i) in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittorXxxxxx; and o and (ii) which recognises the period of continuous service which the employee had with the transmittor Xxxxxx and any prior transmittor Xxxxxx to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 1. Transmission of business. 19.7.1 18.8.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an the employer (in this subclause sub clause called the transmittor) to another employer (in this subclause sub clause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 3.10.4.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreementaward, transmitted from an employer the company (in this subclause called the transmittortransmittor ) to another employer (in this subclause called the transmitteetransmittee ), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an employer the Employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o : (i) in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o transmittor; and (ii) which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer BIC (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 17.7.1 Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 17.7.2 Where the employee rejects an offer of employment with the transmittee: o : (i) in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o and (ii) which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 1.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o : (i) in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o and (ii) which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 i. Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an employer (in this subclause sub clause called the transmittor) to another employer (in this subclause sub clause called the transmittee), in any of the following circumstances: 19.7.1.1 Where (a) where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 Where (b) where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer the company (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (i) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (ii) Where the employee rejects an offer of employment with the transmittee: o ▪ in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o ▪ which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 45.3.1 The provisions of this clause Clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer (in this subclause sub-Clause called the transmittor) to another employer to (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; oror 45.3.1 19.7.1.2 Where (b) where the employee rejects an offer of employment with the transmittee: o - in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o - which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an the employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (i) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (ii) Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 (a) The provisions of this clause are not applicable where a the business is before or after the date of this Agreementagreement, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (i) Where the employee accepts employment with the transmittee which recognises recognizes the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (ii) Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 (a) The provisions of this clause are not applicable where a transmission of business is before or after the date of this Agreement, transmitted from an the employer (in this subclause sub clause called the transmittor) to another employer (in this subclause sub clause called the transmittee), in any of the following circumstances: 19.7.1.1 (i) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (ii) Where the employee rejects an offer of employment with the transmittee: o ● in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o ● which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer (in this subclause sub-clause called the transmittor) to another employer (in this subclause sub-clause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an employer the Employer (in this subclause sub clause called the transmittor) to another employer Employer (in this subclause sub clause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o : (i) in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o and (ii) which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 (i) The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer Armaguard (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 20.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances:. 19.7.1.1 20.7.1.1 Where the employee Employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor transmitter and any prior transmittor transmitter to be continuous service of the employee with the transmittee; or 19.7.1.2 20.7.1.2 Where the employee Employee rejects an offer of employment with the transmittee: o in : a) In which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittortransmitter; and o which and b) Which recognises the period of continuous service which the employee Employee had with the transmittor transmitter and any prior transmittor transmitter to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 13.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 ‌ The provisions of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an employer the Employer (in this subclause sub clause called the transmittor) to another employer (in this subclause sub clause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o : (i) in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o and (ii) which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 18.3.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this in clause 2.8 are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an employer the Employer (in this subclause called “the transmittor”) to another employer (in this subclause called “the transmittee”), in any of the following circumstances: 19.7.1.1 (1) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (2) Where the employee rejects an offer of employment with the transmittee: o in : (a) In which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which and (b) Which recognises the period of continuous service which the employee had with the transmittor tranmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 14.8.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer (in this subclause called the transmittortransmittor ) to another employer (in this subclause called the transmitteetransmittee ), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o : (i) in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o and (ii) which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause Clause 5.3 are not applicable where a the business is before or after the date of this Agreement, transmitted from an the employer (in this subclause called the transmittor) to another employer (in this subclause called the transmitteetransmittee ), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 (i) The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an the employer (in this subclause called the transmittortransmitter) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 A. Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor transmitter and any prior transmittor transmitter to be continuous service of the employee with the transmittee; or 19.7.1.2 B. Where the employee rejects an offer of employment with the transmittee: o , in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittortransmitter; and o which recognises the period of continuous service which the employee had with the transmittor transmitter and any prior transmittor transmitter to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer ISS (in this subclause sub-clause called the transmittortransmittor ) to another employer (in this subclause sub-clause called the transmitteetransmittee ), in any of the following circumstances: 19.7.1.1 25.9.1 Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 25.9.2 Where the employee rejects an offer of employment with the transmittee: o : (a) in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o and (b) which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a the business is before or after the date of this Agreement, transmitted from an the employer (in this subclause called the transmittortransmittor ) to another employer (in this subclause called the transmitteetransmittee ), in any of the following circumstances: 19.7.1.1 (a) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (b) Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o which • Which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreementagreement, transmitted from an employer (in this subclause thus sub clause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 Where (i) where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; : or 19.7.1.2 Where (ii) where the employee rejects an offer of employment with the transmittee: o transmittee in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittortransmitter; and o which recognises the period of continuous service which the employee had with the transmittor transmitter and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 (a) The provisions of this clause are not applicable where a the business is before or after the date of this Agreement, transmitted from an employer Patties Foods (in this subclause called the transmittortransmitter) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (i) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor transmitter and any prior transmittor transmitter to be continuous service of the employee with the transmittee; or 19.7.1.2 . Where the employee rejects an offer of employment with the transmittee: o * in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o * which recognises the period of continuous service which the employee had with the transmittor transmitter and any prior transmittor transmitter to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause are not applicable where a business is before or after the date of this Agreement, transmitted from an employer the Company (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 Where (a) where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 Where (b) where the employee rejects an offer of employment with the transmittee: o : (i) in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o and (ii) which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.

Transmission of business. 19.7.1 The provisions of this clause Clause 17.5 and 17.12 are not applicable where a business is before or after the date of this Agreement, transmitted from an the employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee), in any of the following circumstances: 19.7.1.1 (i) Where the employee accepts employment with the transmittee which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee; or 19.7.1.2 (ii) Where the employee rejects an offer of employment with the transmittee: o • in which the terms and conditions are substantially similar and no less favourable, considered on an overall basis, than the terms and conditions applicable to the employee at the time of ceasing employment with the transmittor; and o • which recognises the period of continuous service which the employee had with the transmittor and any prior transmittor to be continuous service of the employee with the transmittee.
