Employees exempted. This clause does not apply to: • employees terminated as a consequence of serious misconduct that justifies dismissal without notice; • probationary employees; • apprentices; • trainees; • employees engaged for a specific period of time or for a specified task or tasks; or • casual employees.
Employees exempted. This clause shall not apply where the employment is terminated as a consequence of conduct that justifies instant dismissal including inefficiency within the first fourteen days, neglect of duty or misconduct, and in the case of casual employees, or employees engaged for a specific period of time or for a specific task or tasks.
Employees exempted. Clause 5.3 shall not apply:
(a) where employment is terminated as a consequence of misconduct on the part of the employee; or
(b) to employees engaged for a specific period or task(s); or
(c) to casual employees.
Employees exempted. This clause shall not apply to relief or temporary employees or where employment is terminated as a consequence of conduct that justifies instant dismissal.

This clause does not apply to: • employees terminated as a consequence of serious misconduct that justifies dismissal without notice; • probationary employees; • apprentices; • trainees; • employees engaged for a specific period of time or for a specified task or tasks; • casual employees; or • employees in New South Wales, Queensland and South Australia who are in receipt of the wage rates prescribed for metal trades employees engaged in on-site air conditioning work and on-site refrigeration work.

This clause does not apply where an Employee’s employment is terminated for a reason other than redundancy, or if the Employee is a casual employee, an employee serving a probationary period, trainees or an employee engaged for a specific period of time or for a specific task or tasks.
Employees exempted. (a) Clause 2.7 - REDUNDANCY shall not apply:
(i) where employment is terminated as a consequence of misconduct on the part of the employee; or
(ii) to employees engaged for a specific period or task(s)*; or
(iii) to casual employees*. (*A reference to seasonal employees, or employees engaged by the hour or day, may be included where such employees are a feature of the Award.)
