Transmitting the Budget and Payment Terms. The treasurer shall certify and transmit the budget and the tuition rates, membership dues and fees-for-service for the upcoming fiscal year to each member district not later than June 30 of the preceding fiscal year. Tuition payments shall be paid by member and non-member districts on a quarterly basis in September, December, March, and June. Fees-for-service shall be paid within thirty (30) days of service delivery. Membership dues and non-member surcharges shall be paid on a quarterly basis in September, December, March, and June. The agreement must outline a timeline and process for amending the budget, tuition rates, membership dues and fees-for-service. 603 CMR 50.03(5)(b)8. Any amendment to the budget must be approved by the collaborative board. 603 CMR 50.07(7)(a). The collaborative agreement must indicate that any amendment to the budget that results in an increase in tuition rates, membership dues or fees-for-service shall also be provided to the member districts in accordance with a timeframe and process outlined in the collaborative agreement. 603 CMR 50.07(7)(b). Procedure for Amending the Budget: All budget amendments shall be proposed at a public meeting of the board, and must be approved by a majority vote of the board to take effect. All amendments shall be voted on by the board at a second public meeting of the board no earlier than thirty (30) working days after the board meeting at which the amendment was first proposed; adoption shall require a majority vote. The treasurer shall certify and transmit the amended tuition rates, membership dues and fees-for-service to each member district not later than ten (10) working days following the affirmative vote of the board. The board has the authority to reduce tuition rates, membership dues, and fees-for- service to member and non-member districts when doing so is determined to be in the best interest of the collaborative.
