Common use of Unauthorized Leave Clause in Contracts

Unauthorized Leave. (a) Any unauthorized absence of an employee from duty shall be deemed to be an absence without pay. (b) Any employee who absents himself/herself for five (5) consecutive workdays without authorized leave shall be deemed to have resigned and shall be considered a voluntary separation from State service. (c) Any absence described in (a) or (b) may be covered by a subsequent grant of leave with or without pay, when extenuating circumstances are found to have existed. Decisions to grant such leave shall not be arbitrarily denied. (See Letter of Agreement 61.5A-15-254 in Appendix A.)
