UNCONDITIONAL WAIVER AND RELEASE. I hereby waive all rights to make or bring any claims, demands, actions, suits or proceedings (collectively, “Claims”) which I, my Child or our Legal Representatives, successors or assigns have or may in the future have against the Releasees and hereby release and forever discharge the Releasees from any and all Claims and liability for or in respect of any illness, injury, death, property damage, loss, cost or expense suffered or incurred as a result of or related to my Child participating in or observing the Activities or attending the Facility, due to any cause whatsoever including, but not limited to, negligence, willful acts or omissions, breach of contract or breach of any statutory or other duty of care or supervision by any of the Releasees or any other person.
UNCONDITIONAL WAIVER AND RELEASE. If SUBCONTRACTOR uses subcontractors to complete any part of the Construction Work, prior to PG&E ES making any progress or final payment to SUBCONTRACTOR, SUBCONTRACTOR shall provide to POSE ES from each Construction subcontractor an Unconditional Waiver and Release at time of invoicing, in a form acceptable to PG&E ES. that states that the subcontractor has been paid in full to date for all labor, services, equipment or materials furnished to the Project at SUBCONTRACTOR's request, and thereby waives and releases any right to a mechanic's lien, stop notice, or any right against any bond. except for any disputed amount identified in the release.

The undersigned person (herein referred to as “Card Holder”), leasing space at Carillon, hereby agrees to release Xxxxx Interests Limited Partnership (herein referred to as “Property Manager”), Xxxxx Xxxxxxxxx Xxxxxxxx LP (herein referred to as “Owner”) its partners, tenants, employees, and/or affiliates from any and all responsibility or liability for any injury, death, damage or loss which Card Holder may suffer resulting from the participation in any activities or services performed at any facilities sponsored or owned by Property Manager and/or Owner (herein referred to as “Facilities”) located on Level SL-1 of the building commonly know as Carillon and located at 000 Xxxx Xxxxx Xxxxxx, Xxxxxxxxx, Xxxxx Xxxxxxxx (the “Building”) regardless of whether or not the injury or loss is caused by any act, omission or negligence of any of the aforementioned parties or persons. Card Holder agrees to indemnify and hold Property Manager and/or Owner harmless from and against any and all liabilities, losses, damages, costs and expenses (including attorney’s fees), suits, claims and judgments of whatsoever kind and nature arising from, out of, or in connection with any injury to, loss to or of, or death of any person or any damage to any property resulting from or in any way relating to Card Holder’s involvement with or actions at Facilities. Property Manager and Owner do not sponsor, endorse, or affiliate with any personnel for instruction, guidance, or program development for use of or actions at Facilities. Card Holder is using Facilities at his/her sole discretion and risk and assumes any and all responsibility associated with use of Facilities, including any injuries that may result from Card Holder’s actions. By sponsoring and or owning Facilities, Property Manager and Owner do not imply or express advice, opinion or instruction as to the suitability of Facilities for any purpose or use herein engaged by the signatory parties.
