Common use of Union Rights Clause in Contracts

Union Rights. 4.1 A reasonable number of AFT Part-Time Faculty United representatives shall have the right of access to areas in which employees work so long as the representatives do not interfere with the work performance of any employee. AFT Part-Time Faculty United representatives may not have access to classrooms during class time for Union business or may not disrupt the learning and/or work environment. 4.2 Six bulletin boards shall be designated for the exclusive use of AFT Part-Time Faculty United at the following locations/buildings: Vocational Education, Gym, Academic Commons, Allied Health, Liberal Arts, and the Advanced Technology Center (ATC). Items posted on this and other campus bulletin boards shall only contain official business of AFT Part-Time Faculty United. 4.3 All items to be posted by the Union on other campus bulletin boards shall bear the date of posting and the designation of AFT Part-Time Faculty United and shall be removed by AFT Part-Time Faculty United no later than ten (10) days from the posting date. A copy of any posted materials shall be provided to the superintendent/president on the same day the item is posted. 4.4 A mailbox in the mailroom/staffroom, located in the same building as the AFT office, shall be provided for exclusive use of AFT Part-Time Faculty United. 4.5 Communications placed by AFT Part-Time Faculty United in institutional mailboxes shall bear the designation of AFT Part-Time Faculty United. 4.6 AFT Part-Time Faculty United will pay for its own supplies. 4.7 AFT Part-Time Faculty United shall be permitted free office space on the main campus. 4.8 AFT Part-Time Faculty United shall be permitted the use of other facilities and equipment subject to District policies and procedures governing their use. AFT Part-Time Faculty United may schedule the occasional use of classrooms and meeting facilities in the same manner as do other campus organizations and college departments, divisions, and committees. For such uses, the Union shall follow the same procedures for scheduling and use of campus facilities as are required of other campus organizations and college departments, divisions, and committees. 4.9 Upon request, AFT Part-Time Faculty United shall be provided existing District information and documents that are available to the public. In addition, the District shall provide to AFT Part-Time Faculty United existing documents and data necessary for the purposes of negotiations, administration of this Agreement, processing of grievances, and representation of the members of the Bargaining Unit. Such materials include, but are not limited to, existing financial reports and audits, rosters of all personnel, budget plans and projections, allocation of state and federal funds, and student enrollment data. Union requests for information not contained in existing documents can be submitted in writing. The District need not provide the requested information when to do so would be overly burdensome. If the District agrees to provide the information, AFT Part-Time Faculty United will bear the cost associated with complying with the request. The District shall provide AFT Part-Time Faculty United with an estimated date of completion. 4.10 In satisfaction of the requirements of Chapter 10.7 of Division 4 of Title 1 of the Government Code, during the regular semesters, the District shall provide a cumulative total of 540 hours of compensation per semester to such Unit Members as may be designated by the Union for purposes of meeting and negotiation and the processing of grievances. Such Unit Members shall be compensated at their appropriate hourly rate on the part-time faculty schedule. Such compensation shall be considered as payment for professional ancillary activities and shall not be used for purposes of calculating eligibility for contract or regular status under the “sixty-seven percent law.” (Education Code Sec. 87482.5(c).) Not later than the first day of each semester, AFT Part-Time Faculty United will provide the Office of Human Resources and the Office of Payroll & Benefits with a list of such designated Unit Members and the number of hours of compensation awarded to each pursuant to this section. AFT Part-Time Faculty United shall promptly notify the District should subsequent changes be necessary. If an AFT Part-Time Faculty United designated representative must miss a class due to union business, the representative shall contact the appropriate xxxx so that every effort can be made to avoid a class cancellation. 4.11 By the end of the fifth week of each term, the District shall provide in electronic form to AFT Part-Time Faculty United the names, addresses, telephone numbers, e-mail address, and discipline(s) of all part-time faculty employed that term. In addition, at the close of each pay period, the District shall provide AFT Part-Time Faculty United with a list (in electronic form) of all part-time faculty paid during that pay period. 4.12 At least once each month, designated representatives of the District and AFT Part-Time Faculty United shall meet on a mutually agreed upon date, place, and time for the purpose of reviewing the administration of this Agreement and for the purpose of resolving any problems that may arise. Representatives of AFT Part-Time Faculty United may submit agenda items for discussion. The agenda will be prepared by the District and mutually agreed upon by both parties. 4.13 For those college-wide committees that have full-time union representation, the part-time faculty union shall also have representation. 4.14 The District shall post this Agreement on the District Web site and also make it available in PDF format for download from that Web site. The Office of Human Resources shall provide each newly hired part-time faculty member with instructions on how to find the Agreement on the District Web site. A unit member may obtain a printed copy of this Agreement by submitting a written request to the Office of Human Resources. 4.15 The District shall provide AFT Part-Time Faculty United with electronic access to current board policies on the District Web site.

The University will make available to the Union the name and address, university email address, department(s) of enrollment, job classification(s), University ID number (UIN), appointing department(s), percentage of AFT Partassistantship(s), and wages in electronic format ten (10) business days before the first pay period in the Fall Semester and five (5) business days after each other pay period, or as soon as practicable, for all new appointments in the classifications covered by this Agreement. C. The Union will be notified at least two (2) weeks in advance of all campus-Time Faculty United representatives wide and college scheduled orientations for graduate students, TAs and GAs. The Union will be placed on the agenda and given fifteen (15) minutes at such orientations, unless the Union otherwise notifies the University. Upon request, and by mutual agreement, the Union will be placed on the agenda and given fifteen (15) minutes at the end of scheduled Unit and Department orientations. Any Department or Unit that employs ten (10) or more TAs, GAs or any combination thereof may not deny the Union's request to speak at their orientation. For the purposes of this Article, an orientation shall be defined as events satisfying any of the following criteria: 1. Any event called an orientation or onboarding event; 2. Any event that is mandatory and addressing job duties of first time graduate students and/or graduate assistants. D. These notices and bulletins will be on the official letterhead of this Agreement the Union, bearing the name of an officer thereof. Notices and for bulletins permitted to be posted are: 1. Notice of Union meetings; 2. Notices of Union elections; 3. Notice of Union appointments and results of Union elections; and any others which the purpose of resolving any problems that University may arise. Representatives of AFT Part-Time Faculty United may submit agenda items for discussionapprove from time to time. The agenda number of copies which the Union wishes to have posted, plus one (1) will be prepared by filed with the District and mutually agreed upon by both partiesUniversity's Labor Relations Office. 4.13 For those college-wide committees that have full-time union representationE. In addition, the District shall provide to AFT Part-Time Faculty United existing documents and data necessary for the purposes of negotiations, administration of this Agreement. Such list will be periodically updated as needed. 10.4 Union representatives shall be given reasonable time by the University at all University, processing School, Department, or Program-level orientations at which Graduate Assistants are expected in order to address Graduate Assistants in attendance. A. The University shall notify the Union of grievancessuch orientations as soon as practicable, but no later than twenty-one (21) calendar days in advance of each orientation. B. The Union shall notify the University (or the relevant School, Department, or Program) of its intent to send representatives as soon as practicable, but no later than fourteen (14) days in advance of each orientation. C. If an orientation is scheduled without sufficient advance notice to comply with the above deadlines, the University shall notify the Union as soon as the orientation is scheduled, and representation the Union shall notify the University of the members of the Bargaining Unit. Upon request, the Employer’s Director of Academic Labor Relations (“Director”) shall meet with TAU officers once each semester. The meeting will be scheduled by the Director and will, absent mutual agreement, last not less than one (1) hour. At the meeting the parties will discuss general questions and issues concerning graduate teaching assistants; the meetings are not to discuss grievances or other negotiable terms and conditions of employment. TAU will develop and, at least twenty-four (24) hours prior to the close of each pay periodmeeting, present a meeting agenda to the Director. 10. At the meeting the parties will discuss general questions and issues concerning graduate teaching assistants; the meetings are not to discuss grievances or other negotiable terms and conditions of employment. TAU will develop and, at least twenty-wide committees that have full-time union representation, the part-time faculty union shall also have representation. 4.14 The District shall post this Agreement on the District Web site and also make it available in PDF format for download from that Web site. The Office of Human Resources shall provide each newly hired part-time faculty member with instructions on how to find the Agreement on the District Web site. Union Rights. 4.1 A ‌ Section 1. Upon written request, the Employer and Union shall furnish each other information readily available that is relevant to negotiations or necessary for the proper enforcement of this Agreement. Section 2. The employees shall conduct the internal business of the Union during their non-duty hours. However, the foregoing does not prohibit management from granting, as management deems appropriate, requests from authorized Union representatives allowing bargaining unit members opportunity to attend union functions and union business while on duty. Selected and designated Union officers or appointees shall be allowed a pre-approved reasonable number amount of AFT Part-Time Faculty United representatives paid time to investigate and process grievance and arbitration matters. The Employer will not compensate the Section 3. The Union’s staff will be allowed to visit work areas during working hours provided that notice is given to management. The Employer, within 30 days of the Union on other campus bulletin boards shall bear the date of posting and the designation of AFT Part-Time Faculty United and shall be removed by AFT Part-Time Faculty United no later than ten (10) days from the posting date. A copy of any posted materials shall be provided to the superintendent/president on the same day the item is posted. 4.4 A mailbox in the mailroom/staffroom, located in the same building as the AFT office, shall be provided for exclusive use of AFT Part-Time Faculty United. 4.5 Communications placed by AFT Part-Time Faculty United in institutional mailboxes shall bear the designation of AFT Part-Time Faculty United. 4.6 AFT Part-Time Faculty United will pay for its own supplies. 4.7 AFT Part-Time Faculty United shall be permitted free office space on the main campus. 4.8 AFT Part-Time Faculty United shall be permitted the use of other facilities and equipment subject to District policies and procedures governing their use. AFT Part-Time Faculty United may schedule the occasional use of classrooms and meeting facilities in the same manner as do other campus organizations and college departments, divisions, and committees. For such uses, the Union shall follow the same procedures for scheduling and use of campus facilities as are required of other campus organizations and college departments, divisions, and committees. 4.9 Upon request, AFT Part-Time Faculty United shall be provided existing District information and documents that are available to the public. In addition, the District shall provide to AFT Part-Time Faculty United existing documents and data necessary for the purposes of negotiations, administration signing of this Agreement, processing of grievances, and representation of the members of the Bargaining Unit. Such materials include, but are not limited to, existing financial reports and audits, rosters of all personnel, budget plans and projections, allocation of state and federal funds, and student enrollment data. Union requests for information not contained in existing documents can be submitted in writing. The District need not provide the requested information when to do so would be overly burdensome. If the District agrees to provide the information, AFT Part-Time Faculty United will bear the cost associated with complying with the request. The District shall provide AFT Part-Time Faculty United with an estimated date of completion. 4.10 In satisfaction of the requirements of Chapter 10.7 of Division 4 of Title 1 of the Government Code, during the regular semesters, the District shall provide a cumulative total of 540 hours of compensation per semester to such Unit Members as may be designated by present the Union for purposes of meeting and negotiation and the processing of grievances. Such Unit Members shall be compensated at their appropriate hourly rate on the part-time faculty schedule. Such compensation shall be considered as payment for professional ancillary activities and shall not be used for purposes of calculating eligibility for contract or regular status under the “sixty-seven percent law.” (Education Code Sec. 87482.5(c).) Not later than the first day of each semester, AFT Part-Time Faculty United will provide the Office of Human Resources and the Office of Payroll & Benefits with a list of such designated Unit Members the names and addresses of all current employees covered by this Agreement and shall notice the number union of hours all terminations or new hires as they occur. Section 6. Union representatives shall, with the written approval of compensation awarded the employee, have the right to each pursuant inspect an employee's personnel file. Section 7. The Employer agrees to this sectionprovide 21 calendar days advance notice to the Union of any employee layoff of fewer than 25 employees along with an opportunity to comment on the layoff. AFT PartFor layoffs of more than 25 employees, the employer agrees to follow the notice requirements in 2-Time Faculty United 18-1206 MCA. Section 8. Representatives of AFT Part-Time Faculty United may submit agenda items for discussion. Union Rights. 4.1 A reasonable number Section 1. To the extent permitted by the Family Educational Rights and Privacy Act (FERPA), the University shall provide the Union electronically with data about the bargaining unit as provided in this article. At the beginning of AFT Parteach semester, the University shall provide the Union electronically with the roster of the bargaining unit, including for each member: full name, employee identification number, appointment start date, appointment end date, job title, appointment type (teaching, research or teaching/research combination), percent appointment level, pay step (beginner, masters candidate, PhD candidate), bi-Time Faculty United representatives weekly stipend, work department or hiring unit, work location and department head. The University shall have also update the right roster at least monthly. Section 2. If the University conducts an orientation of GAs at the University, School, College or department level, it shall inform the Union of the schedule for contract the orientation and permit the Union to use the meeting space for thirty minutes after the conclusion of such orientation to meet with GAs who wish to do so. Section 11. The University shall allow three (3) GAs to serve as Release-Time Union Representatives. Two of the Release-Time Union Representatives shall receive stipends at the 20- hour per week level and one shall receive a 10-hour stipend (or 10-hour addition to the individual’s regular status under GA appointment level up to a 20-hour per week maximum) to devote such time to Union work. GAs in their first year of graduate study shall not be eligible for designation as a Release- Time Union Representative. AFT Part-Time Faculty United may schedule the occasional use of classrooms and meeting facilities in the same manner as do other campus organizations and college departments, divisions, and committees. Such list will be periodically updated as needed, processing provided that the Union notifies the University of grievances, and representation any changes in the personnel of those authorized to act on behalf of the bargaining unit members at least three (3) days in advance of the date such representative becomes so authorized to act. Section 4. Union representatives shall be given time on the agenda of any orientation given to new CAPs. If no such orientation is given, the University shall provide information about union membership, as provided by the Union, to new CAPs. Section 5. The University shall permit representatives of the Union to post notices of their meetings and other legitimate and appropriate Union activities specific to members of the Bargaining Unit. Simultaneously with posting, the Union will send a copy of each notice to the Deputy Xxxx of the College for Academic Programs. Representatives of AFT Part-Time Faculty United may submit agenda items for discussion. The agenda will be prepared by the District and mutually agreed upon by both parties. 4.13 For those college-wide committees that have full-time union representation, the part-time faculty union shall also have representation. 4.14 The District shall post this Agreement on the District Web site and also make it available in PDF format for download from that Web site. The Office of Human Resources shall provide each newly hired part-time faculty member with instructions on how to find the Agreement on the District Web site. A unit member may obtain a printed copy of this Agreement by submitting a written request to the Office of Human Resources. 4.15 The District shall provide AFT Part-Time Faculty United with electronic access to current board policies on the District Web site.

AFT Part-Time Faculty United may schedule the occasional use of classrooms and meeting facilities in the same manner as do other campus organizations and college departments, divisions, and committees. Representatives of AFT the Union will have the opportunity to speak to new Part-Time time Faculty United may submit agenda items for discussion. The agenda will be prepared by the District and Members at a time mutually agreed upon by both partiesthe Union and the University before, during, or after each orientation. 4.13 For those college-wide committees 4.5 The Union shall be permitted to post notices pertaining to legitimate and appropriate Union interests on designated University bulletin boards. The Union shall monitor the bulletin boards and shall promptly remove inappropriate or outdated material. The Union agrees that have full-time union representationit will not post materials derogatory to the University administration. The University may remove any material it deems inappropriate. 4.6 No action taken by the University with respect to a management or academic right shall be subject to the grievance or arbitration procedure or collateral suit unless the exercise thereof violates an express written provision of this Agreement. Notwithstanding the above, the part-time faculty union shall also have representationUniversity agrees to notify the Union of decisions affecting the bargaining unit and, upon request, will not refuse to bargain collectively with the Union regarding the effects of those decisions in accordance with its duties under the National Labor Relations Act. 4.14 The District shall post this Agreement on the District Web site and also make it available in PDF format for download from that Web site. The Office of Human Resources shall provide each newly hired part-time faculty member with instructions on how to find the Agreement on the District Web site. Workplace leaders and/or Union representatives shall be designated given up to ten (10) minutes’ time on the agenda of adjunct faculty orientation meetings, whether in-person or virtual, for undergraduate and graduate adjunct faculty members in order to present information about the Union and to recruit Union membership. E. At the time of scheduling of adjunct orientation for GPS, a blackboard shell will be created as a meeting room for SEIU to provide information to new adjuncts. GPS will enroll all members of the bargaining unit that participate in the orientation into the blackboard shell and make the shell available for a period of fourteen (14) days, starting on the day following the first orientation of the term. The College shall provide the Union with a Microsoft Teams site (or site based on a comparable software system as used by the College) which will be created as a meeting room for SEIU to provide information to all adjuncts. XxXxxxxx will make the Microsoft Teams (or comparable) software available to all members of the bargaining unit. Once the Microsoft Team (or comparable) site is established, it shall be SEIU’s responsibility to administer content for the site. F. The Employer shall furnish at least one (1) bulletin board on its campus in an area that is central and accessible and which is designed and provided by the Employer, and shall permit representatives of the Union and workplace leaders to post notices pertaining to legitimate and appropriate Union interests on the bulletin board. The Union shall monitor the bulletin board and shall promptly remove inappropriate or outdated material. The bulletin board shall meet the architectural design aesthetics of the building. Should the College find it necessary to renovate any of the above areas, the College will provide an alternative location for the bulletin board. This bulletin board shall be for the exclusive use of AFT Part-Time Faculty United at the following locations/buildings: Vocational Education, Gym, Academic Commons, Allied Health, Liberal Arts, Union. The Union shall be responsible for the posting of all items on the bulletin board. Each item posted shall be dated and the Advanced Technology Center (ATC). Items posted on this and other campus bulletin boards shall only contain official business of AFT Part-Time Faculty United. 4.3 All items to be posted initialed by the Union on other campus bulletin boards official approving the posting. The Union shall bear ensure that posted items are not illegal, defamatory, factually inaccurate, partisan, or political, and that no item is detrimental to the date safety and security of posting the College. Such list will be updated as needed. Section 3. As part of the orientation process for newly hired Faculty positions within the Bargaining Unit, MCAD shall inform the new hires of the Union’s exclusive recognition, and of the location where an electronic copy of this Agreement can be viewed and/or downloaded. Section 4. The Union shall have the right to post Union materials on the intranet as an MCAD Resource. Documents shall be furnished by and at the sole expense of access the Union, and will be uploaded only by a Union xxxxxxx. A link to areas the SEIU website may be included. As with all resource pages on the MCAD intranet site, updates are the responsibility of the sponsor of the resource page. Union Rights. 4.1 A reasonable number of AFT Part-Time Faculty United representatives A. Employees shall have the right for a Union Representative to be present, if the employee so requests, during disciplinary action hearing or meeting at which an employee is being questioned on a matter which may lead to discipline. Further, the Employer must notify the employee of his /her right prior to the meeting. The employee may waive hi/her right to have a Representative present but must do so in writing. A copy of such request shall be supplied to the Union. No recording devices of any kind shall be in use during any meeting, unless both the Union and the employer agree to their use, prior to the meeting in writing. Failure to obtain consent of all persons (Union and Employer) may constitute good cause for termination of employment of the party or parties involved in the recording. B. The Employer will provide the Union with an up-to-date-seniority list by September 30th of each year. The Employer shall also provide the union within thirty days, the names and addresses of any newly hires employees of the unit. C. The Employer will provide the Union, on January 15th of each year with a list of names and addresses of all employees in the bargaining unit. D. The Representative of the Union shall be permitted to transact Union business on the premises during working hours provided such access to areas in which employees work so long as the representatives do does not interfere with the work performance operations of any employeethe Employer. AFT Part-Time Faculty United may schedule the occasional use of classrooms and meeting facilities in the same manner as do other campus organizations and college departments, divisions, and committees. For such uses, the Union shall follow the same procedures for scheduling and use of campus facilities as are required of other campus organizations and college departments, divisions, and committees. 4.9 Upon request, AFT Part-Time Faculty United shall be provided existing District information and documents that are available to the public. In addition, the District shall provide to AFT Part-Time Faculty United existing documents and data necessary for the purposes of negotiations, administration of this Agreement, processing of grievances, and representation each year of the members of the Bargaining Unit. Such materials include, but are not limited to, existing financial reports and audits, rosters of all personnel, budget plans and projections, allocation of state and federal funds, and student enrollment data. Union requests for information not contained in existing documents can be submitted in writing. The District need not provide the requested information when agreement to do so would be overly burdensome. If the District agrees to provide the information, AFT Part-Time Faculty United will bear the cost associated with complying with the request. The District shall provide AFT Part-Time Faculty United with an estimated date of completion. 4.10 In satisfaction of the requirements of Chapter 10.7 of Division 4 of Title 1 of the Government Code, during the regular semesters, the District shall provide a cumulative total of 540 hours of compensation per semester to such Unit Members as may be designated by the Union for purposes of meeting and negotiation and the processing of grievances. Such Unit Members shall be compensated at their appropriate hourly rate on the part-time faculty schedule. Such compensation shall be considered as payment for professional ancillary activities and shall not be used for purposes of calculating eligibility for contract or regular status under the “sixty-seven percent law.” (Education Code Sec. 87482.5(c).) Not later than the first day of each semester, AFT Part-Time Faculty United will provide the Office of Human Resources and the Office of Payroll & Benefits with a list of such designated Unit Members and the number of hours of compensation awarded to each pursuant to this section. Representatives of AFT Part-Time Faculty United may submit agenda items for discussion. The agenda will be prepared by the District and mutually agreed upon by both partiesTownship Business. 4.13 For those college-wide committees that have full-time union representation, the part-time faculty union shall also have representation. 4.14 The District shall post this Agreement on the District Web site and also make it available in PDF format for download from that Web site. The Office of Human Resources shall provide each newly hired part-time faculty member with instructions on how to find the Agreement on the District Web site. A unit member may obtain a printed copy of this Agreement by submitting a written request to the Office of Human Resources. 4.15 The District shall provide AFT Part-Time Faculty United with electronic access to current board policies on the District Web site.

Union Rights. 4.1 A reasonable number of AFT Part-Time Faculty United representatives 35.01 The University shall provide adequate bulletin boards in appropriate locations which are accessible to employees upon which the Union shall have the right to post notices relating to matters of access interest to areas in which the Union and the employees. 35.02 The University agrees to acquaint new employees work so long as the representatives do not interfere with the fact that a Collective Agreement is in effect, provide them with a copy of the Agreement, and provide the new employee with the name, work performance location and phone number of any employee. The Union shall have access to space on campus, when available, for the purpose of AFT Part-Time conducting Union meetings, subject to College procedures regarding reservation and use of space and the needs of the College, provided there is no actual or attempted disruption of normal business and classroom activities. Only Union stewards can reserve space on behalf of the Union. Requests to reserve space will make clear that the purpose is for a Union meeting. Section 2. Within two weeks of the start of a Semester/Term, the Union shall provide to the Vice President of Academic Affairs a list of those Faculty United representatives who are designated to represent the Bargaining Unit in representation meetings, the adjustment of grievances, as well as in attending to other matters relating to the administration of this Agreement. Such list will be updated as needed. Section 3. As part of the orientation process for newly hired Faculty positions within the Bargaining Unit, MCAD shall inform the new hires of the Union’s exclusive recognition, and of the location where an electronic copy of this Agreement can be viewed and/or downloaded. Section 4. The Union shall have the right to post Union materials on the intranet as an MCAD Resource. Documents shall be furnished by and at the sole expense of access the Union, and will be uploaded only by a Union xxxxxxx. A link to areas the SEIU website may be included. As with all resource pages on the MCAD intranet site, updates are the responsibility of the sponsor of the resource page. The University shall provide the Union with notice of any scheduled orientations for Part-time Faculty Members, processing of grievancesincluding the time, date, and representation location of the members of orientation, at the Bargaining Unit. Such materials include, but same time that new Part-time Faculty Members are not limited to, existing financial reports and audits, rosters of all personnel, budget plans and projections, allocation of state and federal funds, and student enrollment data. AFT Part-Time Faculty United shall promptly remove inappropriate or outdated material. The Union agrees that it will not post materials derogatory to the University administration. The University may remove any material it deems inappropriate. 4.6. No action taken by the University with respect to a management or academic right shall be subject to the grievance or arbitration procedure or collateral suit unless the exercise thereof violates an express written provision of this Agreement. Notwithstanding the above, the University agrees to notify the District should subsequent changes be necessary. The Union’s right to be present shall not extend to informal discussions, such as but not limited to, discussions between the employees and supervisory personnel involving matters directly applying only to the employee, such as performance counseling, meaning and application of performance standards, and other matters not affecting employees generally. Normally, notice will be provided at least four hours prior to all formal discussion meetings. When meetings are scheduled regularly, the Union will be notified, in writing, prior to the first regularly scheduled meeting. Give active support to the Employer in institutional mailboxes shall bear its efforts to eliminate waste, conserve materials and supplies, improve the designation quality of AFT Part-Time Faculty Unitedworkmanship, combat tardiness, absenteeism, carelessness, and other similar practices, and encourage the submission of improvement ideas and cost reduction ideas. 4.6 AFT Part-Time Faculty United will pay for its own supplies.e. Encourage employees to: 4.7 AFT Part-Time Faculty United shall be permitted free office space on the main campus.(1) actively participate in and promote programs designed to improve work methods and conditions; 4.8 AFT Part-Time Faculty United shall be permitted the use of other facilities and equipment subject to District policies and procedures governing their use. AFT Part-Time Faculty United may schedule the occasional use of classrooms and meeting facilities in the same manner as do other campus organizations and college departments, divisions, and committees. For such uses, the Union shall follow the same procedures for scheduling and use of campus facilities as are required of other campus organizations and college departments, divisions, and committees. 4.9 Upon request, AFT Part-Time Faculty United shall be provided existing District information and documents that are available to the public. In addition, the District shall provide to AFT Part-Time Faculty United existing documents and data necessary for the purposes of negotiations, administration of this Agreement, processing of grievances, and representation of the members of the Bargaining Unit. Such materials include, but are not limited to, existing financial reports and audits, rosters of all personnel, budget plans and projections, allocation of state and federal funds, and student enrollment data. Union requests for information not contained in existing documents can be submitted in writing. The District need not provide the requested information when to do so would be overly burdensome. If the District agrees to provide the information, AFT Part-Time Faculty United will bear the cost associated with complying with the request. The District shall provide AFT Part-Time Faculty United with an estimated date of completion. 4.10 In satisfaction of the requirements of Chapter 10.7 of Division 4 of Title 1 of the Government Code, during the regular semesters, the District shall provide a cumulative total of 540 hours of compensation per semester to such Unit Members as may be designated by the Union for purposes of meeting and negotiation and the processing of grievances. Such Unit Members shall be compensated at their appropriate hourly rate on the part-time faculty schedule. Such compensation shall be considered as payment for professional ancillary activities and shall not be used for purposes of calculating eligibility for contract or regular status under the “sixty-seven percent law.” (Education Code Sec. 87482.5(c).) Not later than the first day of each semester, AFT Part-Time Faculty United will provide the Office of Human Resources and the Office of Payroll & Benefits with a list of such designated Unit Members and the number of hours of compensation awarded to each pursuant to this section. AFT Part-Time Faculty United shall promptly notify the District should subsequent changes be necessary. Representatives of AFT Part-Time Faculty United may submit agenda items for discussion. The agenda will be prepared by the District and mutually agreed upon by both partiesfellow employees. 4.13 For those college-wide committees that have full-time union representation, the part-time faculty union shall also have representation. 4.14 The District shall post this Agreement on the District Web site and also make it available in PDF format for download from that Web site. The Office of Human Resources shall provide each newly hired part-time faculty member with instructions on how to find the Agreement on the District Web site. A unit member may obtain a printed copy of this Agreement by submitting a written request to the Office of Human Resources. 4.15 The District shall provide AFT Part-Time Faculty United with electronic access to current board policies on the District Web site.

Union Rights. 4.1 A reasonable number of AFT Part-Time Faculty United representatives Section 1. The University will furnish to the Union a monthly new hire report listing new hires and transfers in the bargaining unit. The report will contain each ASE’s name, unique ID number, home department, start date, FTE percent time, job classification, and mail stop. Upon request, within two weeks, the University will provide a quarterly report listing the ASE’s name, unique ID number, home department, job code, job classification, status/action, mail stop, home address, and hire date. The University shall provide these lists in an electronic file when practicable. These lists shall be provided at no cost to the Union. Section 2. The Union will have the right of same access to areas the University mail system as all other unions representing University employees. Section 3. Following ratification and approval by the parties, the University shall publish the Agreement on a designated website. Section 4. In accordance with University/Department policy on access, representatives of the UAW shall be permitted access to employees’ work spaces for the performance of official union business, provided the University policy shall be non-discriminatory and shall be enforced in which employees work so long as the a non-discriminatory manner. Union representatives do will not engage in any disruption of University operations, interfere with the work performance assignment and direction of employees, or in any way impede the discharge of any employee’s duties and responsibilities. Section 5. AFT Part-Time Faculty United representatives may not have access to classrooms during class time The Union shall be provided 30 minutes for Union business orientation at any University, Hiring Unit, or may Department wide orientation for new ASEs, to distribute materials, including Union membership application and dues deduction authorization. Such meetings shall not disrupt count toward the learning and/or work environment220 hours expectation. The University and the Union shall meet semi-annually to discuss the efficacy of this provision. 4.2 Six bulletin boards shall be designated Section 6. The University will work in good faith to find ways to allow ASEs designated as stewards the time necessary to perform their responsibilities, which may include a reduced work assignment for the ASE. The Union will work in good faith with the University in the designation of AFT Partstewards so as to avoid appointing a xxxxxxx in situations that would create a hardship to the University. Section 8. The Union will submit to the Office of Labor Relations the name of each xxxxxxx and the assigned jurisdiction of the xxxxxxx. Union Rights. 4.1 A 5.2.1 The parties agree that the Union shall be entitled to all of the rights and privileges delineated in this Agreement. There shall be no rights implied beyond the specific terms of this Agreement. 5.2.1.1 Union officials and/or representatives not employed by the College shall have reasonable number access to the College's premises for the purpose of AFT Partconferring with the College's representatives and for the administration of this Agreement, provided that prior arrangement is made through the College's Human Resources Office. 5.2.1.2 Neither the Union nor the Local Union, nor any employee shall conduct Union business on the College’s premises except: 5.2.1.2.1 Solicitation of Union membership during lunch and break periods will be allowed. 5.2.1.2.2 Upon approval, Union representatives may confer with the College regarding the administration of this Agreement. 5.2.1.2.3 Notices, papers, leaflets, handbills and/or literature that have been approved by the College's Marketing and Communication Office may be posted on employee bulletin boards so long as nothing political, inflammatory, derogatory or disruptive to good labor/management relations is contained in the materials that are posted The parties agree that only mailings posted through the United States Postal Service may be sent through the College’s mail service. Employees disseminating information in accordance with this provision shall do so only on non-Time Faculty United representatives CNM paid time. 5.2.1.2.4 The Union shall have the right to use the electronic mail systems or other similar communication systems of access CNM to areas communicate with the bargaining unit regarding collective bargaining and the administration of the agreement, investigation of grievances or other disputes, and matters involving the governance or business of the Union. Nothing inflammatory, derogatory, or disruptive to good labor-management relations shall be contained in which employees work so the email or written documents to be distributed and/or posted or communications with any College student media. Such information will be distributed and/or posted by Union representatives. For email communications to the entire bargaining unit utilizing the CNM email system the Union agrees to provide a copy in advance. The College shall not unreasonably delay or unreasonably deny the Union’s request. Email communication between a Union representative and an individual or individuals in the bargaining unit shall not be subject to approval. College resources shall not be used for any union activity including but not limited to political issues or a campaign for an individual candidate or an organization unless specifically authorized elsewhere in this Agreement unless the parties agree to an exception. In the event the College believes a violation of this Article has occurred it shall be brought to the attention of the Union President and the distribution in question shall be halted. 5.2.1.2.5 CNM shall permit the Union to use facilities for the purpose of conducting meetings with the bargaining unit without undue interference and as long as the representatives such meetings do not interfere with the work performance operations of any employee. In addition, at the close of each pay period, the District shall provide AFT Part-Time Faculty United with contact information electronically for unit members as a list (in electronic form) of all part-time faculty paid during that pay period. 4.12 At least once each month, designated representatives of the District and AFT Part-Time Faculty United shall meet on a mutually agreed upon datefollowing information, placewith each field in its own column, for all bargaining unit members within five (5) days of the last payroll date of September, January, and time for May as follows: 1. Personal cellular telephone number (10 digits if available); 17. Personal email address of the purpose of reviewing the administration of this Agreement and for the purpose of resolving any problems that may arise. Representatives of AFT Part-Time Faculty United may submit agenda items for discussion. The agenda will be prepared by the District and mutually agreed upon by both parties. 4.13 For those college-wide committees that have full-time union representation, the part-time faculty union shall also have representation. 4.14 The District shall post this Agreement on the District Web site and also make it available in PDF format for download from that Web site. The Office of Human Resources shall provide each newly hired part-time faculty member with instructions on how to find the Agreement on the District Web site. A unit member may obtain a printed copy of this Agreement by submitting a written request to the Office of Human Resources. 4.15 The District shall provide AFT Part-Time Faculty United with electronic access to current board policies on the District Web site.employee (if available);

Union Rights. 4.1 A Section A. Representatives of the Union will be permitted to transact official business with appropriate representatives of the Employer at all reasonable number of AFT Part-Time Faculty United representatives shall have the right of access to areas in which employees work so long as the representatives do not interfere with the work performance of any employee. AFT Part-Time Faculty United representatives may not have access to classrooms during class time for Union business or may not disrupt the learning and/or work environmenttimes provided they follow regular University procedures. 4.2 Six bulletin boards shall Section B. Where facilities, including meeting rooms or equipment, such as duplicating, IT, computing, and audiovisual, are available for use by other unions, such facilities or equipment will be designated available to the Union in accordance with established University procedures. Section C. The University will provide a room (capacity 6-8), free of charge, on the Flint and Dearborn campuses for the exclusive use of AFT Part-Time Faculty United at the following locations/buildings: Vocational Education, Gym, Academic Commons, Allied Health, Liberal Arts, and the Advanced Technology Center (ATC). Items posted on this and other campus bulletin boards shall only contain official business of AFT Part-Time Faculty United. 4.3 All items to be posted by the Union on other campus bulletin boards shall bear to meet with their members once per month. The Union will provide the date of posting and the designation of AFT Part-Time Faculty United and shall be removed by AFT Part-Time Faculty United University with proposed dates no later than ten June 1 for the following academic year. If space is unavailable on the requested dates, the University will identify alternative dates. 1. The Union may post notices on existing bulletin board space which is not reserved for specific purposes, but in no case shall the Union be denied space sufficient to post one (101) days from 8½- inch by 14-inch sheet in an appointing unit employing Employees. 2. In addition, the posting dateEmployer shall provide the Union with bulletin board space designated with the Union’s name for its exclusive use in each building in which Employees work. 3. A copy The Employer shall provide a working and reasonably visible Internet link to this Agreement on the University’s website. Section E. The University shall provide the Union reasonable access to new Employees to inform them about the Union’s function, to explain union dues, to recruit Stewards, and to discuss current bargaining status or any other Union business. The Union may make arrangements to meet with each new Employee during the Employee’s regular work hours for a period no greater than forty-five (45) minutes. Section F. Union Representatives may use existing electronic media, including but not limited to telephones and email, for Union business. At the Union’s expense, Union Representatives may use unit office equipment for the purposes of any posted materials shall administering this Agreement. The Union’s officers may request and be provided granted a XXX photocopy account in their appointing unit to make occasional small numbers of copies for purposes of contract administration at the Union’s expense. Section G. United States mail that is received by the Employer bearing the name of the Employee with a correct specific campus address will be distributed to the superintendent/president on Employee in the same day the item is postednormal manner. 4.4 A mailbox in the mailroom/staffroom, located in the same building as the AFT office, shall Section H. Campus mail will be provided for exclusive use of AFT Part-Time Faculty United. 4.5 Communications placed by AFT Part-Time Faculty United in institutional mailboxes shall bear the designation of AFT Part-Time Faculty United. 4.6 AFT Part-Time Faculty United will pay for its own supplies. 4.7 AFT Part-Time Faculty United shall be permitted free office space on the main campus. 4.8 AFT Part-Time Faculty United shall be permitted the use of other facilities and equipment subject distributed to District policies and procedures governing their use. AFT Part-Time Faculty United may schedule the occasional use of classrooms and meeting facilities Employees in the same manner as do it is customarily distributed to other campus organizations and college departments, divisions, and committees. For such uses, the Union shall follow the same procedures for scheduling and use of campus facilities as are required of other campus organizations and college departments, divisions, and committeesfaculty. 4.9 Upon request, AFT Part-Time Faculty United shall be provided existing District information and documents that are available Section I. Union representatives may distribute Union material to the public. In addition, the District shall provide to AFT Part-Time Faculty United existing documents and data necessary for the purposes of negotiations, administration Employee mailboxes. Section J. Provisions of this AgreementArticle will be administered consistent with PERA and Employer policies, processing of grievances, and representation of the members of the Bargaining Unit. Such materials include, but are not limited to, existing financial reports and audits, rosters of all personnel, budget plans and projections, allocation of state and federal funds, and student enrollment data. Union requests for information not contained in existing documents can be submitted in writing. The District need not provide the requested information when to do so would be overly burdensome. If the District agrees to provide the information, AFT Part-Time Faculty United will bear the cost associated with complying with the request. The District shall provide AFT Part-Time Faculty United with an estimated date of completion. 4.10 In satisfaction of the requirements of Chapter 10.7 of Division 4 of Title 1 of the Government Code, during the regular semesters, the District shall provide a cumulative total of 540 hours of compensation per semester to such Unit Members as may be designated by the Union for purposes of meeting and negotiation and the processing of grievances. Such Unit Members shall be compensated at their appropriate hourly rate on the part-time faculty schedule. Such compensation shall be considered as payment for professional ancillary activities and shall not be used for purposes of calculating eligibility for contract or regular status under the “sixty-seven percent law.” (Education Code Sec. 87482.5(c).) Not later than the first day of each semester, AFT Part-Time Faculty United will provide the Office of Human Resources and the Office of Payroll & Benefits with a list of such designated Unit Members and the number of hours of compensation awarded to each pursuant to this section. AFT Part-Time Faculty United shall promptly notify the District should subsequent changes be necessary. If an AFT Part-Time Faculty United designated representative must miss a class due to union business, the representative shall contact the appropriate xxxx so that every effort can be made to avoid a class cancellation. 4.11 By the end of the fifth week of each term, the District shall provide in electronic form to AFT Part-Time Faculty United the names, addresses, telephone numbers, e-mail address, and discipline(s) of all part-time faculty employed that term. Upon AFT Part-Time Faculty United’s request, within two (2) days the Deans shall provide the assignment information for all individuals requested for specified time periods.
