UNION SECURITY AND DUES CHECK-OFF. 4.01 All current 4.1 It is agreed between the Company and the Union that to the extent allowed by law, any employee in the bargaining unit defined in Article 1 of this Agreement, who is or may hereafter become a member of the Union, or pays an agency fee, may authorize the collection of Union dues or agency fees by the signing of a payroll deduction form.
A. In the event of repeal or amendment of the provisions of the Virginia Law relating to Union Security, or in the event of new legislation or judicial decision rendering permissible a Union Shop provision, the Company will negotiate with the Union whether to add to this Agreement, a legally permissible Union Shop clause.
B. The Company will deduct from employee wages and turn over to the Union, the Union Membership Dues or agency fees of each employee who individually and voluntarily authorized the Company in writing to make such deductions. The terms “Union Membership Dues,” as used herein shall not include Union initiation fees, fines or penalties of any type, assessment’s or reinstatement fees of employees of rehired by the Company, willwith or without seniority, when such employees are reinstated or rejoin the Union, nor shall it include any back dues or agency fees owed by the employee as a condition of employment, become and remain members of the time of hire or that may come due thereafter, for example by virtue of having insufficient earnings at the time dues or fees are to be deducted.
C. Such deductions shall be made in accordance with the following provisions:
1. Such deductions shall be made only in accordance with instructions upon authorization cards (Employee Authorization for Payroll Deduction of Union in good standingDues and Initiation Fee for CWA). In order to be effective, as provided in the Constitution and By-laws of the Union. All current employees, who have not already done so, will such authorization cards shall be required to sign an application for membership and authorization for dues check off and initiation fee. The application form will be supplied delivered by the Union Secretary/Treasurer, to the Company.
2. To be effective, dues deduction and agency fee authorizations will be processed for payroll deduction during first full pay period of the month closest to receipt of the dues or agency fees deduction card.
3. This authorization is voluntarily made and is neither conditioned on the employee’s present or future membership in the Union, nor is it to be considered as a quid pro quo for membership. The form will be Authorization shall continue in effect until canceled by written notice signed by the individual and returned sent to the Local Union Financial Secretary within via registered or certified mail, or in the event the employee shall cease to be an employee as defined in Article 1 (Recognition of Rights) Section A of this Agreement.
4. This cancellation of authorization must be postmarked during the fourteen (14) days day period prior to each anniversary date of the execution of this Agreement. In current or any subsequent CBA, or during the case of a new employee, fourteen (14) day period prior to the form will be completed and forwarded within one week termination of the employee’s date of hirecurrent or any subsequent CBA.
4.02 5. Deduction for Union Membership dues shall be cancelled, suspended, or resumed by the Company as directed by the Union.
D. The Company will deduct bi-weekly, from the gross wages of each employee’s wages, any dues, initiation fees or assessments levied in accordance with the Constitution and By-laws of the Union. The total amount deducted will be equivalent to the Unifor, regular monthly dues of the Union. This amount will not be changed during the term of this Agreement, except in order said employee’s Union dues or agency fees and remit them to comply the duly authorized representative of the Union, together with a change in the Constitution and By-laws list of the names of the employees, the pay rate from whose pay deductions were made, and the pay period within thirty (30) days of the date the deductions were made.
E. The Company will deduct from the employee’s wages, during the term of this Agreement, said employee’s Political Contributions Committee as directed on the employee(s) voluntarily signed card (Political Contributions Committee Payroll Deduction Card), and remit them to the duly authorized representative of the Union, together with a list of the names of the employees from whose pay deductions were made and the pay period within thirty (30) days of the date the deductions were made.
F. The Company’s obligation to make such deductions will cease automatically upon the termination of the employee who signed the authorization, upon written request of the employee in accordance with Section D (5), or upon the employee’s transfer to a unit not covered by this Agreement.
G. Where funds have been deducted from the pay of any employee who does not owe such funds, it shall be the responsibility of such employee to obtain a refund from the local Union. The Union will provide agrees that it shall hold the Company harmless against any and all complaints, claims, judgments, or demands that may arise out of, or in any way be related to, compliance by the Company upon any document furnished to the Company written notice of by the amount of regular monthly dues.

UNION SECURITY AND DUES CHECK-OFF. 4.01 All current and any new employees A. Each Flight Attendant of the CompanyCompany covered by this Agreement who fails to voluntarily acquire or maintain membership in the Union, willshall be required, as a condition of continued employment, become within sixty (60) days following the beginning of such employment or as provided for in the Union's Constitution and remain members Bylaws after the effective-date this Agreement or the completion of the probationary period, whichever is later, to pay to the Union each month a service charge as a contribution for the administration of this Agreement and the representation of such employee. The service charge shall be an amount equal to the Union's regular and usual monthly dues and periodic assessments, including MEC assessments.
B. The provisions of this Section shall not apply to any employee covered by this Agreement to whom membership in good standingthe Union is not available upon the same terms and conditions as are generally applicable to any other Flight Attendant, or to any Flight Attendant to whom membership in the Union was denied or terminated for any reason other than the failure of the Flight Attendant to pay initiation (or reinstatement) fee, dues and assessments uniformly required. Nothing in this section shall require payment of any initiation (or reinstatement) fee, by any Flight Attendant not required to make such a payment pursuant to the Union's Constitution and By Laws.
C. If any Flight Attendant of the Company covered by this Agreement becomes delinquent in the payment of a service charge or membership dues, the Union shall notify such employee by Certified Mail, Return Receipt Requested, copy to the Vice President-Human Resources of the Company, or designee, that the Flight Attendant is delinquent in the payment of such service charge or membership dues as specified herein and is subject to discharge as a Flight Attendant from the Company. Such letter shall also notify the Flight Attendant that she/he/they must remit the required payment within a period of fifteen (15) days or be discharged.
D. If, upon the expiration of the fifteen (15) day period, the Flight Attendant remains delinquent, the Union shall certify in writing to the Vice President-Human Resources, with a copy to the Flight Attendant, that the Flight Attendant has failed to remit payment within the grace period allowed and is therefore to be discharged. The Vice President-Human Resources shall thereupon take proper steps to discharge such Flight Attendant from the service of the Company.
E. A grievance by a Flight Attendant who is to be discharged as a result of an interpretation or application of the provisions of this Section shall be subject to the following procedures:
1. A Flight Attendant who believes that the provisions of this Section have not been properly interpreted or applied as they pertain to the Flight Attendant, may submit a request for review, in writing, within five (5) days from the date of notification by the Vice President- Human Resources as provided in Paragraph D above. The request must be submitted to the Constitution Director-Inflight Services, or designee, who will review the grievance and Byrender a decision in writing not later than five (5) days following receipt of the grievance.
2. The Director-laws of Inflight Services, or designee, shall forward the decision to the Flight Attendant, with a copy to the Union. All current employeesSaid decision shall be final and binding on all interested parties unless appealed as hereinafter provided. If the decision is not satisfactory to either the Flight Attendant or the Union, then either may appeal the grievance within ten (10) days from the date of the decision directly to a neutral referee who have not already done somay be agreed upon by the Company and the Union within ten (10) days thereafter. In the event the parties fail to agree upon a neutral referee within a specified period, will be required either the Company or the Union may request the National Mediation Board to sign an application for membership and authorization for dues check off and initiation feename such neutral referee. The application form will decision of the neutral referee shall be supplied final and binding on all parties to the dispute. The fees and charges of such neutral referee shall be borne equally by the Company and the Union.
F. During the period a grievance is being handled under the provisions of this Section, and until final award by the Director-Inflight Services, designee, or the neutral referee, the Flight Attendant shall not be discharged from the Company nor lose any seniority rights because of non-compliance with the terms and provisions of this Section.
1. A Flight Attendant discharged by the Company under the provisions of this paragraph shall be deemed to have been "discharged for cause" within the meaning of the terms of this Section.
2. It is agreed that the Company shall not be liable for any time or wage claims of any Flight Attendant discharged by the Company pursuant to a written order by a authorized Union to representative under the Companyterms of this Section.
3. The form will be signed Union agrees to indemnify and returned hold the Company harmless against any suits, claims, and liabilities which arise out of, or by reason of, any action taken by the Company pursuant to a written order from an authorized Union representative under the Local Union Financial Secretary within fourteen (14) days terms of this Section.
G. 1. During the execution life of this Agreement. In the case of a new employee, the form will be completed and forwarded within one week of the employee’s date of hire.

All current employees, employees who have not already done so, new and probationary employees, will be required to sign an application for membership and authorization for dues check off of dues and initiation fee. The application form will be , supplied by the Union to the Company. .
2.02 The Local Union copy of this form will be signed completed within one (1) week of the employee’s hire and returned forwarded to the Local Union Financial Secretary within fourteen (14) days at the time of the execution of this Agreement. In the case of a new employee, the form will be completed and forwarded within one week of the employee’s date of hiredues remittance.
4.02 2.03 The Company will deduct bi-weekly, from the gross wages of each every employee, any dues, initiation fees or assessments levied levied, in accordance with the Union Constitution and By-laws of the Union. The total amount deducted will be equivalent to the Unifor, regular monthly dues of the Union. This amount will not be changed during the term of this Agreement, except in order to comply with a change in the Constitution and By-laws of the Unionlaws. The Union will provide to the Company with written notice of the amount of regular monthly dues. If there is a change in the amount of dues, the Union will give the Company written notice of the change. The Union indemnifies the Company against any claim that may arise as the result of dues deductions made by the Company in accordance with this Article.
4.03 2.04 All dues, dues and initiation fees and assessments deducted will must be remitted by cheque to the Local Union Financial Secretary within fourteen fifteen (1415) working days of the month following the deductions. The remittance will include , along with a statement listing each employees name list of names and the amount of each deduction. A copy of this statement will also be provided to the Union Chairperson when requested.
4.04 2.05 The Company will also provide supply a statement listing list of those employees members who did not have Union dues deducted and the reason why no deduction took place.
4.05 In any instance in which an error occurs in the amount of any deduction of dues from an employee's wages, the Company will adjust it directly with the employee. In the event of any mistake by the Company in the amount of its remittance to the Union, the Company will adjust the amount within seven (7) days of being notified of the error.
4.06 2.06 The Company will include supply the Local Union, on an employee’s T4 slipa monthly basis, the total amount of dues paid by following information necessary to administer the employee for contract. In addition, the relevant taxation yearUnion Chairperson may request this information from the Human Resource Manager and it will be provided as soon as possible.
4.07 The Union will indemnify 1. Employees who are in the Company against any claim bargaining unit regardless of whether or liability arising not they paid dues in the month.
2. Employee’s number and their hourly rate and classification.
3. Employees transferred into or out of the application bargaining unit.
4. The number of this Articlehours worked in the month.
5. Employees status (i.e. at work, except for on vacation, STD, LTD, WSIB, retired in the month, any claim other leave of absence) and the date of occurrence.
6. Employees laid off or liability arising out recalled.
7. Employees who have lost seniority.
8. Names, addresses, and postal codes of an error committed by the Companyall retired and active employees.
