UNION SECURITY AND DUES CHECK-OFF. Every employee within the scope of this Agreement, who is a voluntary member of the Union or who hereinafter becomes a member of the Union, shall maintain his membership in the Union as a condition of his employment. Should an employee be promoted or transferred to a position outside the bargaining unit and he is returned to the position he held within the scope of the Agreement within a period of three months from the date of pro- motion or transfer, he must pay the appropriate Union dues for the period that he was out of scope. Union local officers and stewards may visit em- ployees for the purpose of investigating complaints and the administration of the Collective Agreement but only with the prior of the Supervisor(s) of the employees involved. 4.1 Employees who are members of the scope recognized bargaining unit, who are not members of this Agreementthe Union, may join the Union by initiating their Union application form and dues deduction authorization form.

C. If a Flight Attendant of the Company covered by this Agreement becomes delinquent in the payment of her/his membership dues or service charge, the Union shall notify such Flight Attendant by Certified Mail, Return Receipt Requested, copy to the designated representative of the Company that she/he is delinquent in the payment of such service charge or membership dues as specified herein and is subject to discharge as a Flight Attendant and that she/he must remit the required payment within a period of thirty (30) days or be discharged.
D. If, upon the expiration of the thirty (30) day period, the Flight Attendant remains delinquent, the Union shall certify in writing to the designated Company representative, copy to the Flight Attendant that the Flight Attendant has failed to remit payment within the grace period allowed and is therefore to be discharged. The Company shall discharge such Flight Attendant from the service of the Company.
E. The Union agrees to deduct indemnify and hold the monthly union dues each month Company harmless against any suits, claims, and liabilities which arise out of or by reason of any action taken by the Company pursuant to a written order from the wages of all employees who are liable for such dues an authorized Union representative under the terms of this Agree- ment, and to pay the same to the Manitoba Government Employees’ Association on or before the day of the following month. UNION SECURITY AND DUES CHECK-OFF. Every employee within Section 1. Subject to applicable law, it shall be a condition of employment that all employees covered by this Agreement who are members of the scope Union in good standing as of its effective date, shall remain members in good standing, and those who are not members in good standing as of the effective or execution date of this Agreement, who whichever is a voluntary member of later, shall, on or after the Union or who hereinafter becomes a member thirtieth (30th) calendar day following the effective date, become and remain members in good standing of the Union, or in lieu of union membership pay an agency fee. Section 2. The Hospital will deduct from the pay of each associate covered by this Agreement all current and uniform Union membership dues and initiation fees, if any, provided that at the date time of such deduction there is, in the possession of the Hospital, a current written assignment, executed by the associate, in the form and according to the terms of a valid authorization form (Voluntary Authorization For Deduction Of Union Dues Form). The Hospital shall provide such a form to each associate entering the bargaining unit, sign an ap- plication for membership card. .
(a) The Employer agrees to Hospital will deduct the monthly union dues each month from the wages pay of all employees who are liable associates in any month only the Union membership dues becoming due and payable in the next succeeding month but only for such dues under amounts accrued while that associate was employed by the terms of this Agree- ment, and to pay Hospital.
(b) All sums deducted by the same Hospital shall be remitted to the Manitoba Government Employees’ Association on or before Union at an address certified in writing by the day Secretary Treasurer of the following month. The Union will notify the Employer of any changes in the union dues Local 459, if possible not later than the last day of the monthcalendar month for which such deductions are made.
Section 3. Provided he In the event a refund is due any individual for any sums deducted from wages and paid to the Union, it shall be the responsibility of such individual to obtain the appropriate refund from the Union.
Section 4. The Union shall indemnify and save the Hospital harmless against any and all claims, demands, suits or other forms of liability that shall arise out of or by reason of action
Section 5. The Hospital shall not be responsible liable for the remittance or payment of any sums other than those constituting actual deduction made; and if for any errors reasons the Hospital fails to make a deduction for any associate as above provided, it shall make that deduction from the associate’s next pay in which such deduction is normally deducted after the error has been called to its attention by the associate or omissions or subject to any penalties the Union.
Section 6. Union local officers and stewards may visit em- ployees for the purpose of investigating complaints and the administration of the Collective Agreement but only with the prior of the Supervisor(s) of the employees involved.
