Common use of Unjust Suspension or Discharge Clause in Contracts

Unjust Suspension or Discharge. Should it be found upon investigation that an employee was unjustly suspended or discharged he/she shall be immediately re-instated in his/her former position without loss of seniority. He/she shall be compensated for all time lost in an amount equal to his/her normal earnings during the pay period next preceding such discharge or suspension, or by any other arrangement as to compensation which is just and equitable in the opinion of the parties or in the opinion of an Arbitrator, if the matter is referred to Arbitration. Temporary employees shall only be compensated at the appropriate rate of pay for the time they would have worked.
