Unsafe Assignment/Personal Protective Equipment (PPE). It is agreed that both parties recognize the critical lack of Personal Protective Equipment (PPE) and the resulting variation from historic best practices that have been allowed by Oregon Health Authority and CDC. Caregiver safety is of paramount importance to ensure continued delivery of patient care to the greatest number of patients. It is the intent of Xxxxxx to follow OHA and CDC guidance on PPE in all cases. Any nurse who believes that the PPE and other precautions that are being provided are not in compliance with OHA guidelines shall follow their chain of command to raise their concern, starting with the charge nurse and following current contract guidelines for grievance/appeal process found in Article 17 summarized below:

Unsafe Assignment/Personal Protective Equipment (PPE). All Nurses working in the positions with a high likelihood of contact with the COVID-19 virus (swabbing stations, emergency department, birth center (admitting units), units caring for PUI and designated COVID units and home health) or at the request of a nurse will be prioritized for PPE and that use of N-95 or higher levels of protection (e.g. Controlled or Powered Air Purifying Respirators (CAPR’s or PAPRs) etc.), will be used. In the event a nurse exercises the opt-out option provided under and State or Federal rule or law to decline vaccination, the nurse may be required as a condition of employment to wear an N-95 mask and a new N-95 mask must be provided daily for that nurse.
