Utility Agreement. “Utility Agreement” means an agreement between the Authority and the Facility Owner, authorizing and providing for the performance of specific work and/or services and/or the purchase of materials and equipment.

Utility Agreement. (A) The Final Adoption of an agreement between the County and the Developer (and/or the CDD, as determined by the Developer) which sets forth the terms and conditions regarding how much potable water, reuse water and sewer capacity shall be provided to the Redevelopment Property, including, without limitation, the timeframes upon which such capacity shall be provided and the methods of how such capacity shall be provided, shall be a Purchase Condition Precedent.
