VACANCIES, PROMOTIONS, TRANSFERS. 7.1 Posting Process
1A. A vacancy shall be defined as any bargaining unit position newly created or not currently filled. Bargaining unit members who possess the stated qualifications for a position will be considered for vacancies on the following basis: Applicants who work in the classification in which there is a vacancy will be considered first with preference given to qualified applicants within the classification. If there is more than one qualified applicant from within the classification, seniority will be the weighing factor. If there are no qualified applicants from within the classification, consideration will be given to bargaining unit members outside the classification who meet the stated qualifications. A qualified bargaining unit member will be given preference over applicants from outside the bargaining unit.
E. Any new position which is created by the District will be posted accordingly. Employees who are transferred or assigned to a different classification shall retain their same rate for a period of thirty (30) days as a trial period. Effective with the satisfactory completion of the trial period the employee should return in the new classification shall be compensated at the rate for Step 1. Then at the 3rd year of employment, those employees would automatically be brought up to his/her former present wage of that position, management will transfer said employee. Vacancies after Employees who are transferred or assigned to different positions within the close same classification shall retain their same rate for a period of thirty (30) days as a trial period. VACANCIES, PROMOTIONS, TRANSFERS. 7.1 Posting ProcessA. A vacancy shall be defined as a newly created position or a present position within the bargaining unit which the district intends to fill and has become vacant due to resignation, retirement, termination, leave, death, demotion, transfer or promotion. Vacancies shall be posted within ten (10) working days of the vacancy. In cases where posting within ten (10) days isn’t possible, the Association President will be notified and provided with the circumstances and a new posting timeline. The posting shall be sent to the Association President and each Plant Engineer. The Plant Engineer will place the posting for five (5) working days in a designated location accessible to all members of the unit. Time limits may be altered by mutual agreement of the parties.
1B. A transfer shall be defined as a move between shifts and/or building locations within the same job classification. All members are eligible to Employees shall indicate their interest in transferring in writing. The most senior (department seniority) employee within the job classification will be awarded the position.
C. Should no one within the job classification apply for all open postings a transfer, other employees in the bargaining unit may apply and shall fill out receive consideration along with outside applicants. All vacancies within the bargaining unit shall be open and posted for at least six (6) days in each of the buildings where a secretary is employed. Any secretary may apply for such vacancies.
B. Secretaries who are interested in a change of position should advise their principals, as well as the personnel office, prior to the summer vacation. When vacancies occur during recess periods such that the six (6) days posting period, provided for in paragraph A above, will expire prior to the end of that recess period, the secretaries covered by this Agreement will be notified of such vacancies by email and posting on the school district’s website. 7.3 A WWESA employee hired to the District or transferring to a new assignment must remain in his/her position for one year before becoming eligible for another voluntary transfer. In such circumstances, the start date of the position(s) shall be the point from which to determine the employee’s eligibility under this section. Lateral moves, however, within a school or department are permissible at any time. All qualifications being equal, seniority shall prevail. This section does not apply to members placed into a lower classification, grade, or total weeks as a result of placement in accordance with Article 3.3.1.
7.3.1 In unusual circumstances, the transfer limitation cited in Article 7.3 may be waived by mutual consent of both parties.
7.4 Insofar as practicable, all vacancies will be filled by promotions. Whenever qualified personnel are not available, seniority being a consideration, administration may offer training and so notify WWESA through reposting of the position.
7.5 When reclassifications of WWESA personnel from one grade to another occur, they shall be moved to the same step in the grade as that which they have attained in the previous grade.

4. Acceptance of an offered position will remove the employee from any further consideration for vacancies occurring during that specific posting.
5. The District shall consider an applicant’s qualifications as outlined in the job description when filling grades 2title, 4 and 6 positions. All qualifications being equalcurrent salary range, seniority shall prevail.
6. The District will consider an applicant’s knowledge, skills group and abilities when filling Grade 8 and 10 positions. Grade 8 and 10 secretarial positions will not have any seniority provisions as part where applicable a brief description of the consideration for selecting a person.
7duties and responsibilities. If a WWESA member accepts a Grade 10 position, In addition the position s/he is leaving will be filled on a temporary basis for a 45-(work) day period. After this period of time, the position will be filled as a continuation posting shall include an indication of the posting that created current location of work to be performed. It is the opening.
8. On or about policy of the 45th workday, a meeting will be held for any WWESA member who accepts a Grade 10 position. If the employee wishes Employer to return promote from within where possible and reasonable to his/her former position, s/he may do so. Furthermore, if it is determined by management that the employee should return The Employer will make a hiring decision in respect of internal applicants prior to his/her former position, management will transfer said employee. Vacancies after the close of the school year will be placed on the District’s web site (xxxx://xxxxx.xxx). Letters of application received after the posted closing date shall not be considered. Every effort will be made to fill vacancies within two (2) weeks of the closing of a WWESA postinginterviewing any external candidates. The Employer is permitted to advertise externally at the same time to fill a vacancy as the internal posting is made.
23.02 Vacancies shall not exceed thirty (30) days, when possible. In the event a position is vacant be posted for a period of longer eight (8) calendar days and employees bidding on job vacancies must make application in writing and this must be received by the Director of Human Resources no later than the eighth (8th) day. Any resulting subsequent vacancies shall be posted for four (4) days.
(a) No permanent employee may apply for any vacant position until she has completed the probationary period. A permanent non-probationary employee who has successfully bid on a vacancy within the prior six (6) months may not apply for a further vacancy unless she has not started in her new position, in that she has not yet been assigned new cases in that position. Notwithstanding the above, if a permanent, non-probationary employee successfully bids on a temporary vacancy and that position becomes permanent or another permanent vacancy occurs in the same position on the same team, the employee may apply at any time for the new permanent position.
(b) Contract employees may not apply for any available temporary position unless the Employer, in its sole discretion, permits them to do so. Contract employees may apply for any permanent position.
23.04 Vacancies which will not or are not expected to exceed six (6) months and vacancies caused by absences due to illness, accident, leaves of absence (including pregnancy/parental leave) need not be posted. Such temporary vacancies may be filled at the discretion of the Employer, which shall include the temporary transfer of any employee or the temporary assignment of cases and/or duties. It is understood that employees who are temporarily transferred or temporarily assigned cases and/or duties pursuant to this provision shall be returned to their original job and will suffer no loss of pay. Temporary transfers and assignments of cases and/or duties may be extended beyond their original end date by mutual Agreement of the parties. It is understood that an employee who is temporarily transferred pursuant to this provision to a higher rated position shall be paid at the rate applicable to that job for the duration of the transfer. Where the higher position is outside the bargaining unit, the employee shall be deemed to be covered by all provisions of this Collective Agreement, including Article 7, (Check Off of Union Dues) during the period of temporary transfer.
23.05 In cases of vacancy, promotion or permanent transfer to a different position, the following factors shall be considered:
a) qualifications including skill, competence, experience, efficiency;
b) seniority with the Employer. When matters in factor (a) are relatively equal, then factor (b) shall govern.
23.06 It is understood that an employee may not be assigned from one location to another without her consent except when her position is being permanently moved to a different location to accommodate service demands. If there is more than one (1) weekemployee in the position to be moved, the affected Secretary and Administrator Employer will meet first seek volunteers. Where more than one employee volunteers to discuss what additional timemove, if anythe employee with the most seniority will be moved. However, where there are no volunteers, the employee in the position with the least seniority will be moved. An employee being moved will be given as much notice as possible to allow for necessary personal arrangements, bearing in mind service demands. The parties agree that there may be required employees whose positions have been identified but who are not considered appropriate for movement under this process.
23.07 Effective the date of ratification, should qualifications for a position be changed by the Employer, employees holding that position will be deemed qualified for it. Those qualifications for which an employee has been deemed qualified will be transferable to complete any other position within the necessary work. WWESA members responsible bargaining unit requiring those qualifications.
23.08 Where the vacancy is not filled under the Employer’s normal internal posting and recruitment processes, the Employer may fill the job in question in its discretion.
23.09 Where the vacancy is filled by an individual who, when awarded the job, is employed by another Children’s Aid Society in Ontario, the employee’s service for covering dual WWESA roles, due to an unfilled vacancy, the purposes of determining the applicable wage rate shall be reimbursed an additional $15.00 per day after based on the length of her most recent period of continuous service with the other Children’s Aid Society. The foregoing does not apply to seniority-based entitlements and in no way reduces the probationary period which the employee must serve with the Employer.
23.10 The Employer will advise the Union of the name of the successful applicant within five (5) days for the additional workload.
7.1.1 All laid-off and returning from leave WWESA personnel shall receive copies of all WWESA position postings.
7.2 WWESA and WWESA applicants shall receive written notice acceptance of the successful applicantappointment.
