The decision of the Superintendent shall be final and not subject to the grievance procedure. Effective with the satisfactory completion of the trial period the employee in the new classification shall be compensated at the rate for Step 1. Then at the 3rd year of employment, those employees would automatically be brought up to present wage of that position. Effective with the satisfactory completion of the trail period, the employee shall be compensated at the rate for the new position and for purposes of step placement will be treated as if he/she had not changed position. An employee who had voluntarily been placed in a part-time position shall have a right to continue only on a part-time basis, subject to possession of necessary seniority, certification and qualification. Such voluntary part-time bargaining unit members may apply for transfer to a vacancy in a full-time position in accordance with this Article.
3. Any bargaining unit member may apply for a vacancy. In filling such vacancy the Board agrees to give due weight to professional background and attainments and the length of time each applicant has been employed by the District. Where certification, qualification and professional background are essentially equal, a vacancy will be awarded to the most senior applicant. The decision shall be made by the Superintendent. All applicants currently employed by the Board shall be notified of the decision in writing.
4. A wage requirement based upon a grant wage limitation may be utilized by the Superintendent when necessary to fill a vacancy.

J. An employee who transferred to an administrative or executive position prior to July 1, 1982 and later returns to a position within the bargaining unit shall resume seniority and all other rights and benefits under the contract that he/she had prior to leaving the bargaining unit.
K. If an employee and the Administration mutually agree that the employee will move from his/her current assignment to an assignment in a new pilot or experimental program (as they occur of vacancies. They determined by the Administration), the affected employee shall have tenthe right to return to his/her former assignment at the end of the first year in the pilot or experimental program. An employee who is employed in a job classification on a substitute basis or due to a temporary transfer shall not gain seniority in that classification. Instead, seniority shall continue to accrue in the employee’s regular classification. If however, the employee who has been temporarily reassigned becomes a regular employee in the new classification, seniority credit will be given for the time worked during temporary reassignment.
J. When a position is eliminated and is later reinstated, the employee transferred out of the Michigan Department of Education and Highly Qualified requirements.
E. During the summer months (non session days) those persons wanting notification of vacancies shall leave their name, address and phone number where they may be reached with central office by June 1st each year. VACANCIES, PROMOTIONS, TRANSFERS. A. The Association Board recognizes that it is desirable in making assignments, transfers and promotions to consider the fact that when interests and aspirations of its teachers. A teacher may apply for any position at any time. Such applications should be in writing addressed to the Superintendent of Schools. Applications will be considered should vacancies occur during the school year, it may be difficult to fill then from within the district without undue disruption to the existing instructional program. Vacancies either during the school year or during the summer requiring adjustments for the fall semester. This application should be reviewed annually.
B. In filling a vacancy within the professional staff, the Board agrees to give due credit to the background and attainments of all applicants, the length of time each has been in the school system, and other relevant factors. However, the decision of the Board as to the filling of such vacancies shall be defined final; but no teacher shall be denied a requested position without a stated reason.
C. Whenever a vacancy occurs in the professional staff, the Board will give written notice to the Association and post in each building as vacancies that occur after August 15th soon as possible. E. During the summer months (non session daysschool year, the Elementary Principal will announce any proposed teaching changes at staff meeting(s). In the summer, the Elementary Principal will send notices to teachers at their last known address of any proposed teaching changes. Teacher(s) those persons wanting notification will submit their request in writing for any open position(s). The most senior qualified teacher(s) will be chosen for the opening(s).
F. In filling promotional vacancies to administrative positions the Board shall consider the professional qualifications, background, attainments, and other relevant factors, including service in the school district, of all applicants from within the school district, as well as applicants from outside the school district. The parties recognize, however, that the filling of vacancies shall leave their name, address at the supervisory and phone number where they may be reached administrative levels and the filling of newly created supervisory and administrative positions is a prerogative of the Board; and the decision of the Board with central office by June 1st each year. Those persons respect to such matters shall be mailed notifications final.
G. Any teacher who shall be transferred to a supervisory or executive position and shall later return to a teacher status shall be entitled to retain such rights as they occur of vacancies. C. Teachers may file with the Superintendent advance notice in writing expressing desires for changes in assignment. This notice should be submitted no later than April 1 of each year.
D. In filling a Schedule B vacancy, the following criteria and procedures shall apply:
1. All Schedule B appointments are on an annual basis. If a bargaining unit employee is recommended for nonrenewal in a Schedule B position, the reasons for that recommendation shall be communicated to that individual through a written evaluation or other performance documentation.
2. If a bargaining unit employee receives a “satisfactory” evaluation and wishes to remain in any Schedule B position (other than a club sponsor), he/she will be allowed to do so. Within thirty (30) days of receipt of the “satisfactory” evaluation, the bargaining unit employee will notify the administrator that completed the bargaining unit employee’s evaluation of his/her intent to continue in the future for position. If the bargaining unit employee does not wish to continue in the position, then the position will be posted. This language does not supersede contract language in Article 21, A and B.
3. In filling a period ninety days or longer that are non supervisory Schedule B vacancy within the bargaining unit, the Board agrees to give due weight to the professional background and attainments of all applicants, the length of time each has been in nature the District and other relevant factors. The decision of the Board as a result to the filling of approved leaves or announced and accepted retirements/resignationssuch vacancies shall, however, be final.
4. Vacancies Each extra-duty position shall be posted during the school term for a period of ten (10) school days.
